Ordinances and Resolutions A. 3rd Readings ORD. 19-004 AN ORDINANCE AMENDING THE CODIFIED ORDINANCES OF GROVEPORT - PART THREE - TRAFFIC CODE, TITLE SEVEN, CHAPTER 351, SECTION 351.17, TRUCK PARKING IN City of Groveport Page 1 City Council Meeting Minutes March 11, 2019 RESIDENTIAL AREAS AND THE DECLARATION OF AN EMERGENCY Sponsors: Hutson Attachments: ORD. 19-004 Exhibit A.pdf Law Director, Kevin Shannon, advised that staff is requesting that Council consider making a motion to postpone this Ordinance to the March 25, 2019 City Council meeting for third reading so that Council, at next week's Committee of the Whole meeting, can consider the information provided by Council Member Dildine and other concerns of Council. Mr. Dildine added some additional information on gross and curb vehicle weights on popular large vehicles. He wants Council to be well informed on the matter of weight limits in the language of the ordinance which could affect a resident's ability to park a personal vehicle on the street or in their own driveway. Every Homeowners Association (HOA) has different restrictive covenants. Most covenants, as long as they are properly recorded and of record in the County Recorder's Office, are enforcible by each and every resident of a particular subdivision. Therefore, a HOA could have prohibitions against certain types of vehicles. If Groveport does not have something on the books, as far as a limitation, then a resident would not be hauled into a mayor's court or municipal court to address that situation. But, if the limitation matter is addressed within the restrictive covenants, then the HOA has the ability to bring an action to enforce the restrictive covenant in civil court. If a resident is in compliance with the City statute, no enforcement action would be taken against them. However, they would still be subject to civil suit of a particular HOA, which gave notice when the lot was sold to the homeowner that there are restrictions on types of vehicles. In Mr. Shannon's experience, HOA restrictions tend to touch on huge vehicles, such as, Winnebagos. Groveport already has provisions in its code pertaining to recreational vehicles and trailers being parked on streets within the municipality. Recreational vehicles can be parked on private property under certain restrictions. Clerk of Council Ross read by title Ordinance No. 19-004. Mayor - Lance Westcamp Mayor Lance Westcamp reported that he and two Council Members attended the State of the Schools Celebration at the Groveport Madison High School. The event was well run and had a huge turnout. Eastland Vocational Culinary students provided appetizers during the event. B. Administrator - Marsha Hall Administrator Marsha Hall clarified figures regarding the proposed gas tax increases she had submitted in her Council Report. The figures were based on the higher amount of 18 cents that was originally proposed by Governor Mike DeWine. The matter still has to go through the Ohio Senate and Ms. Hall is not sure if the proposed 10.7 cents will change those amounts. Once the final amounts are known, Ms. Hall will report them back to Council. #044-2019 Adm Report to Council - Mar 11 Attachments: Adm Report to Council - Mar 11.pdf C. Chief of Police - Ralph Portier Chief Ralph Portier reported on the invitations and RSVPs he has received from the Mayor and Council to the Police Awards night event. D. Director of Finance - Jeff Green Assistant Administrator / Finance Director, Jeff Green, reported that the City of Groveport Page 4 City Council Meeting Minutes March 11, 2019 splitting of GAP and Old Navy will have no impact on the GAP expansion project whatsoever. The only thing that is uncertain is if the building will be owned by GAP or Old Navy. The Groveport location could be a GAP facility or an Old Navy facility. E. Director of Law - Kevin Shannon Nothing further to report. F. Council Members - Jean Ann Hilbert, Ed Dildine, Shawn Cleary, Becky Hutson, Scott Lockett and Chad Grashel Nothing to report. G. Clerk of Council - Ruthanne Sargus Ross Nothing to report. H. Standing Committees Council Member Dildine updated Council on the Trees & Decorations Committee meeting that was held earlier tonight. All Committee members were present and new member Terri Ray was introduced to the group. The Arbor Day Celebration the City coordinates with Groveport Elementary can't be celebrated on the last Friday of April this year. Patty Storts was informed by Mrs. Bray, Groveport Elementary Principal, that the Groveport Madison School District is on spring break that Friday. The school would be available to participate the following Friday, May 3rd and would like to start the program around 1:30 p.m. if possible. The Committee is planning on celebrating the oldest tree known in Groveport which is located by Glendening Elementary. Ms. Storts has not heard back from Mr. Brogan, Glendening Elementary Principal. Once Ms. Storts gets confirmation from the schools involved, Mr. Dildine will make sure everyone is informed of the date and time. The plaque in memory of Jan Stoots will be installed on Arbor Day with the tree to be planted in her memory. All the stumps of the Bald Cypress trees in Grovepointe have been removed. Letters will go out to the residents, followed by post cards, to get feedback on what types of trees the residents want in the subdivision. The Committee suggested two (2) trees to be replanted; the Ivory Silk Japanese Lilac tree and the Hedge Maple tree. Each resident will be given the option of choosing which tree or no tree at all. The cost will be roughly $34,000. The Committee decided at a previous meeting the replanting will more than likely be done over a 2 or 3 year City of Groveport Page 5 City Council Meeting Minutes March 11, 2019 period. There were approximately 90 trees removed and ground down. Two benches, each with a plaque, will be dedicated on Apple Butter Day in memory of Donna Drury and Linda Crowder. The committee was informed that the City received no response to the RFQ that was sent out for a contract Arborist. The Committee will be reaching out to Hocking Technical College for possible prospects. Administrator Marsha Hall had been contacted by a Human Resources group about Upper Arlington looking to hire a part-time arborist. Ms. Hall responded asking if they found someone, if they would be willing to share, to please contact her. Upper Arlington will contact Ms. Hall if they find an arborist. Mr. Dildine introduced the idea of a tree farm that was suggested by Council Member Lockett at a previous Council meeting. The Committee will be looking to get a lot more information about the possibility of a tree farm. There are many things to consider. IX. Other Business a. Executive Session Law Director Shannon requested Council to consider making a motion to go into Executive Session pursuant to Ohio Revised Code Section 121.22(G) to discuss matters related to economic development. To include all members of Council, the Mayor, the Administrator, Finance Director and himself. A motion was made by Council Member Cleary, seconded by Council Member Lockett, to go into Executive Session at 6:55 p.m. pursuant to Ohio Revised Code Section 121.22(G) to discuss matters related to economic development. To include all members of Council, the Mayor, the Administrator, Finance Director and the Law Director.
