The City of Hampton Board of Zoning Appeals held a work session on Monday, September 10,
6 2018 at 4:35 p.m. in the Hardy Cash Conference Room, City Hall, 22 Lincoln Street, Hampton,
7 Virginia.

9 In attendance were: Chairman John C. Pope, Vice-Chair Linda Ellis, and Board Members Dr.
10 Arne Hasselquist, Richard Rudnicki, and Thomas Savage. Also present were Zoning
11 Administrator/Community Development Department (CDD) Deputy Director Steve Shapiro,
12 Deputy City Attorney Bonnie Brown, Development Services Center Manager Hannah Sabo,
13 Zoning Officials Melvion Knight, Kenar Johnson, and Angela Leflett, and Senior Administrative
14 Assistant/Recording Secretary Ann Crist.

Chairman Pope called the work session to order at 4:35 p.m.

17 After some discussion regarding VA18-00009, including the construction of unpermitted
18 structures on the site, methodology for calculating rear-yard setback on a waterfront lot, and
19 mitigation requirements, Deputy City Attorney Bonnie Brown advised the Board to have their
20 discussion during the hearing so it would be on the record. Board Member Savage stated that
21 due to his involvement with the project, he will recuse himself from the discussion and voting on
22 this case.

24 Regarding VA18-00019, Zoning Administrator/Community Development Department (CDD)
Deputy Director Steve Shapiro confirmed that the variance request would need to be deferred
25
so it could be re-advertised and that the Board would need to take action to defer this case.

27 Regarding VA18-00020, Zoning Official Melvion Knight stated that architect would be
28 presenting the Board with documentation regarding the historical designation of the property.
29 Vice-Chair Ellis inquired as to why this property was zoned residential since there are only
30 dormitories on the property. Steve Shapiro advised the property has always been zoned
31 residential and it is legal non-conforming. Steve Shapiro stated they have talked with the
32 University about a separate category for Institutional or a use permit for University covering the
33 entire university area but those discussions have not moved forward.

There being no further items to discuss, the work session adjourned at 4:51 p.m.

6 Chairman Pope called the meeting to order at 5:00 p.m.

8 A call of the roll noted those present: Chairman John C. Pope, Vice-Chair Linda Ellis, and Board
9 Members Dr. Arne Hasselquist, Richard Rudnicki, and Thomas Savage.

11 Also present were Zoning Administrator/Community Development Department (CDD) Deputy
12 Director Steve Shapiro, Deputy City Attorney Bonnie Brown, Development Services Center
13 Manager Hannah Sabo Zoning Officials Melvion Knight, Kenar Johnson, and Angela Leflett,

17 A motion was made by Vice-Chair Ellis and seconded by Board Member Savage, to approve
18 the August 6, 2018 Board of Zoning Appeals work session and public hearing meeting minutes.

20 A roll call vote on the motion resulted as follows:

23 NAYS: None

26 ITEM III. PUBLIC HEARING ITEMS:

28 A. VA18-00009: Nguyen Nguyen, 20 Great Lakes Dr., LRSN 8002772, a variance to
29 reduce the rear yard setback from 30.0’ to 23.0’ to construct an addition on a single
30 family dwelling.

32 Zoning Administrator/Community Development Department (CDD) Deputy Director Steve
33 Shapiro advised Chairman Pope that Mr. Nguyen had been informed that Board Member
34 Savage would not be able to participate in the discussion nor the vote on this case. Mr.
Nguyen requested the case be deferred until the October 1, 2018 hearing so that Alternate
35
Smith would be in attendance to allow for five voting board members on this case.

37 A motion was made by Vice-Chair Ellis to defer this case until the October 1, 2018 meeting. The
38 motion was seconded by Board Member Rudnicki.

increase the maximum height of a fence to enclose a generator from 6’ to 9’ 6”.
