Building Code Board of Appeals

BUILDING CODE BOARD OF APPEALS MEETING 11-25-13 2:00 p.m. Members: Laurence Nisley^ Sherman Crawley, Alan Bourne, Frank Feagan, Dexter Godfrey Steven Shapiro Attendees: Sr. Deputy City Attorney, Lesa Yeatts, Steven Shapiro, Chip McErlean, Robert Noble Purpose of Meeting: To Hear Case HOI-IS, Concerning the Property Located at 36 Edmonds Cove Road owned by Ms. Kimberly A. Pope & Eric Engler Vice-Chair, Larry Nisley - Opened the meeting requesting the roll to be called. After the roll was called, Mr. Nisley asked Mr. Shapiro to brief the Board on the City's position on the appeal. Mr. Shapiro stated that he had a letter to read from Atty. Leonard C. Heath, Jr. on behalf of Ms. Pope & Mr. Engler. Mr. Shapiro - Read the attached letter which stated that the City of Hampton has withdrawn the Notice of Violation relating to IRC Section 502.7 Lateral Restraint at Supports. In addition, the letter stated that Ms. Pope and Mr. Engler are willing to comply with IRC Section 401.3 Drainage. On behalf of Atty. Heath's clients, he is requesting the Building Code Board of Appeals grant a 60-day continuance. His clients' intent is to comply with the drainage/landscaping requirement and thus totally eliminate the need for any subsequent hearing before the Board. Mr. Nisley - Asked for a motion. Mr. Bourne - Moved to grant Ms, Pope and Mr. Engler the 60-day continuance requested, which would be January 27, 201^.4 Mr. Crawley - 2™* the motion made by Mr. Bourne Mr. Nisley - Called for the vote and it was unanimous. Meeting was adjourned at 2:30 p.m.
