Tuesday, September 1, 2020
I. CALL TO ORDER
Mayor March called the Committee Meeting to order at 3:31 p.m., in the
City Council Chambers, City Hall, 240 Water Street, Henderson, Nevada 89015.
Mayor March announced due to the COVID-19-related Public Meeting
Restrictions in effect at this time, there will be no in-person attendance at this
meeting, and those present will be practicing social distancing in conformance
with the State of Nevada Executive Department Declaration of Emergency
Directive 006, dated March 22, 2020, as extended by Emergency Directive 029,
dated July 31, 2020, extending public meeting closures and restrictions for the
duration of the current state of emergency, unless terminated by a subsequent
directive or by operation of law associated with lifting the Declaration of
Emergency. However, the individuals may provide public comment in person at
the microphone set up immediately outside of the Council Chambers under the
two designated public comment sections. The public may also view or listen to
this meeting online at https://cityofhenderson.com/ or YouTube, and may
indicate their desire to address the Council live via WebEx. Mayor March also
stated if online participants experience any technical difficulties participating in
today’s meeting, they may contact 702-267-2300 for assistance.
II. CONFIRMATION OF POSTING AND ROLL CALL
The City Clerk confirmed the Committee Meeting had been noticed in
compliance with the Open Meeting Law by posting the Agenda three working
days prior to the meeting at City Hall, the Multigenerational Center, the Whitney
Ranch Recreation Center, Fire Station No. 86, the Nevada Public Notice
Website, the City of Henderson Website, and by mailing a copy of the Agenda
to everyone appearing thereon on the Agenda Master Mailing and Emailing List.

III. PUBLIC COMMENT
Michael Gagnon, 89052, present from the City Hall lobby, voiced his support for
the short-term vacation rentals (STVR) moratorium under agenda item C-1. He
stated STVR homes are having an adverse effect on the surrounding residents
in his neighborhood, and listed several guidelines he would like to have added
to the STVR rules and regulations.

Alfredo Montero, no ZIP code provided; Malee Simpson, no ZIP code provided;
and Thomas Davis, no ZIP code provided; voiced their opposition to the STVR
moratorium under agenda item C-1 via WebEx. A summary of the reasons they
oppose the moratorium include:
Belief that homes not regulated by a homeowner’s association should have
the flexibility and right to allow STVRs at their property.
STVRs provide a source of income for homeowners in a tough economic
climate.
All owners allowing STVRs should not be punished for the actions of a few
bad ones; instead, the bad renters should be penalized harder.
Belief that it provides a benefit to surrounding residents by increasing their
home values and stimulating the local economy.
The added tax revenue it provides to the City.
Belief that STVRs provide a unique rental option for guests.
High occupancy rates show the demand for STVRs.
Not an adequate amount of time yet to determine if STVRs are properly
functioning.
Belief that STVRs have an unfair image than what actually occurs, such as
most owners properly vet potential renters, do not allow “party houses”, and
provide superior standards of cleanliness for their properties.

short-term vacation rentals (STVR) moratorium under agenda item C-1 via
WebEx. A summary of reasons they support the moratorium include:
Opposed to having STVRs in residential neighborhoods.
The adverse effects STVRs cause to the surrounding neighbors including
noise, traffic, decreasing property values and quality of life, property
destruction and pollution, and safety concerns.
Some neighborhoods have a high concentration of STVRs.
Belief that STVRs harm the family-friendly atmosphere of Henderson.
Requests for stricter regulations for STVRs.
Surrounding residents should not be punished for living in an area without a
homeowner’s association.
The lengthy amount of time it takes for complaints to be rectified.
Neighbors not having a voice to determine the number of STVRs and the
rules regulating them in their neighborhoods.
There are plenty of hotels available to utilize.

MORATORIUM ON APPLICATIONS FOR SHORT-TERM VACATION
RENTALS
COMMUNITY DEVELOPMENT AND SERVICES
City Manager/CEO Derrick introduced and read this bill by title.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON,
NEVADA, TO IMPOSE A MORATORIUM ON APPLICATIONS FOR
SHORT- TERM VACATION RENTALS IN THE CITY OF HENDERSON
PURSUANT TO HENDERSON MUNICIPAL CODE SECTION 19.5.3.G TO
ALLOW FOR IMPLEMENTATION OF REVISIONS TO THE APPLICATION AND
ENFORCEMENT PROCESSES FOR SHORT-TERM VACATION RENTALS.

Michael Tassi, Community Development and Services Director, gave a
PowerPoint presentation titled Short-term Vacation Rentals (STVR). Areas of
discussion included: the history of the STVR ordinance’s creation in Henderson,
specifics of the STVR process, STVR and Code Enforcement on STVR statistics,
STVR issues that staff believes need to be addressed, specifics of the requested
90-day moratorium, and the next steps in STVR regulation staff will be
addressing with the Council.
Mayor March thanked Mr. Tassi for reviewing the STVR process and stated she
hopes the 90-day moratorium will allow staff to engage feedback from STVR
owners and their neighbors to refine the process to be suitable for all residents.
Councilman Marz stated he agreed with some of the complaints expressed by
residents and requested staff look at measures that will strongly penalize STVR
owners that allow renters who party and disturb nearby neighbors.

Councilman Dan H. Stewart moved to refer Bill No. 3462 to the Regluar Meeting
with a do-pass recommendation.
The roll call vote favoring passage was: Those voting aye: Debra March,
John F. Marz, Michelle Romero, Dan K. Shaw, and Dan H. Stewart.
Those voting nay: None. Those absent: None. Those abstaining: None.
