CITY OF HENDERSON CITY COUNCIL MINUTES COMMITTEE MEETING Tuesday, October 20, 2020 I. CALL TO ORDER Mayor Pro Tem John F. Marz called the Committee Meeting to order at 3:45 p.m., in the City Council Chambers, City Hall, 240 South Water Street, Henderson, Nevada 89015. Mayor Pro Tem Marz announced due to the COVID-19-related Public Meeting Restrictions in effect at this time, there will be no in-person attendance at this meeting, and those present will be practicing social distancing in conformance with the State of Nevada Executive Department Declaration of Emergency Directive 006, dated March 22, 2020, as extended by Emergency Directive 029, dated July 31, 2020, extending public meeting closures and restrictions for the duration of the current state of emergency, unless terminated by a subsequent directive or by operation of law associated with lifting the Declaration of Emergency. However, individuals may provide public comment in person at the microphone set up immediately outside of the Council Chambers under the two designated public comment sections. The public may also view or listen to this meeting online at https://cityofhenderson.com/ or YouTube, and may indicate their desire to address the Council live via WebEx. Mayor Pro Tem Marz also stated if online participants experience any technical difficulties participating in today’s meeting, they may contact 702-267-2300 for assistance. II. CONFIRMATION OF POSTING AND ROLL CALL The Assistant City Clerk confirmed the Committee Meeting had been noticed in compliance with the Open Meeting Law by posting the Agenda three working days prior to the meeting at City Hall, the Multigenerational Center, the Whitney Ranch Recreation Center, Fire Station No. 86, the Nevada Public Notice Website, the City of Henderson Website, and by mailing and emailing a copy of the Agenda to everyone appearing thereon on the Agenda Master Mailing and Emailing Lists. Mayor Pro Tem Marz made the following disclosure statement: “This item is an ordinance that will amend the plan for the Eastside Redevelopment Area to extend the termination date of the plan, extend the time of issuing indebtedness to finance projects with the area, and expand the boundaries of the area. In my private capacity, I am a partner in Touch Squared Marketing. Touch Squared does work for Cadence, which is located within the Eastside Redevelopment area. Cadence would benefit from the proposed ordinance. However, any benefit accruing to Cadence from the proposed ordinance is not greater than the benefit accruing to any other property owner or developer in the Eastside Redevelopment area. As a result, I do not believe that the independence of my judgement on this item, or that of a reasonable person in my situation, would be materially affected by my professional work for Cadence, and I intend to vote on this item. Michael Cathcart, Business Operations Manager, stated this item is an update to Henderson Municipal Code Chapter 4.05, which contains the schedule for all business license fees. Mr. Cathcart said this amendment will add classifications and requirements for sports venue establishments, portable bars, the Artisan’s Beer and Wine Room, which is a satellite location for Nevada licensed liquor manufacturers, and cannabis deliveries. He said the cannabis delivery license fee is being added to Henderson Municipal Code Chapter 4.05; however, the prohibition against cannabis delivery still needs to be eliminated and will be presented to Council within the next few weeks. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, TO AMEND CHAPTER 4.36 – LIQUOR-REGULATIONS AND LICENSES - OF THE HENDERSON MUNICIPAL CODE. Michael Cathcart, Business Operations Manager, stated this item is an update to Henderson Municipal Code Chapter 4.36, which is the City’s chapter on liquor regulations and licenses. Mr. Cathcart said these changes will establish the license requirements for the three new liquor licenses that were discussed under item C-8. He said the license requirements will assist in establishing rules and regulations for consumption of alcohol on City property during watch parties, or other events, on the newly renovated city hall grounds within the special events district. Mr. Cathcart said the amendment to Chapter 4.36 was also needed to make technical corrections and other minor changes, such as references to the Nevada Revised Statutes regarding meal services. Mayor Pro Tem Marz declared the motion carried. Henderson City Council Committee Meeting Page 11 of 12 Tuesday, October 20, 2020 – Minutes C-10 BILL NO. 3477 AMEND HENDERSON MUNICIPAL CODE SECTION 15.12 – PROPERTY MAINTENANCE CODE COMMUNITY DEVELOPMENT AND SERVICES City Manager/CEO Derrick introduced and read this bill by title. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, AMENDING TITLE 15.12 – PROPERTY MAINTENANCE CODE - OF THE HENDERSON MUNICIPAL CODE. Ian Massey, Senior Code Enforcement Officer, displayed a PowerPoint presentation titled “Property Maintenance Code Update,” and gave a brief summary of the updated building codes, the additional enforcement provisions to gain increased voluntary compliance, and the process improvements that were built into the code to resolve cases sooner. Mr. Massey said the Council’s previous directions, concerns, and recommendations were also incorporated into this amendment. Councilwoman Romero thanked Mr. Massey for his presentation and stated the code updates will make it easier for the City to fix some of the neighborhoods that consistently have problems and complaints. Responding to an inquiry from Mayor Pro Tem Marz regarding how property maintenance-related complaints are divided, Michael Tassi, Community Development and Services Director, said the director, or his designee, is charged with enforcement of the Code; therefore, the case work can be divided amongst the different designees. Mr. Tassi said this same process is used for short-term vacation rental issues and complaints. (Motion) Councilman John F.
