REGULAR MEETING MINUTES
Thursday, November 9, 2017
I. CALL TO ORDER
Chairman Scott Carls called the Civil Service Board meeting to order at
5:02 p.m., in the Council Chambers Conference Room, City Hall,
240 Water Street, Henderson, Nevada.
II. CONFIRMATION OF POSTING AND ROLL CALL
Ms. Parra, Official Records Reporter, confirmed the Civil Service Board meeting
had been noticed in compliance with the Open Meeting Law by posting the
Agenda three working days prior to the meeting at City Hall, the
Multigenerational Center, the Whitney Ranch Recreation Center, Fire Station
No. 86, the Nevada Public Notice Website, the City of Henderson Website, and
by mailing a copy of the Agenda to everyone appearing thereon on the Agenda
Master Mailing List.

III. PUBLIC COMMENT
There were no comments presented by the public.
IV. ACCEPTANCE OF AGENDA
(Motion) Ms. Wittenberger introduced a motion to accept the agenda as
presented. The vote favoring approval was unanimous.
Chairman Carls declared the motion carried.
V. NEW BUSINESS
NB-1 CLOSED SESSION
NB-2-JOSEPH A. HOECKENDORF APPEAL SUBMISSION
HUMAN RESOURCES
Pursuant to NRS Chapter 241, motion for a closed meeting to discuss an
employee's character, alleged misconduct, professional competence, or
physical or mental health at this initial meeting, unless the employee waives the
closure of the meeting.
Chairman Carls abstained from discussing and voting on this item due to
applying for a position with the City of Henderson.
Vice-Chairman Weidauer presided over the remainder of the meeting.
Ms. Wittenberger introduced a motion to enter into a closed meeting. The vote
favoring approval was unanimous. Mr. Carl abstained. Vice Chairman
Weidauer declared the motion carried.
NB-2 INITIAL MEETING REGARDING NOTICE OF APPEAL
HUMAN RESOURCES
Receipt of Joseph A. Hoeckendorf's appeal to determine whether the issue
complained of is a receivable appeal under the Civil Service Rules.
Kristina Gilmore, Assistant City Attorney III, gave a brief presentation on the
proposed item. She noted that due to the argument based on race
discrimination, this is not an appealable argument that the Board can hear. She
stated that other portions may be heard by the Board, excluding the references
regarding race.
Gregg Hubley, attorney for Mr. Hoeckendorf, concurred with Ms. Gilmore. He
noted that under the rules this is a receivable appeal.

Ms. Wittenberger introduced a motion to re-open the meeting. The vote favoring
approval was unanimous. Mr. Carl abstained. Vice Chairman Weidauer
declared the motion carried.
Ms. Wittenberger introduced a motion to accept Mr. Hoeckendorf’s appeal
regarding the unfair treatment, but to deny any reference to any racial
discrimination. The vote favoring approval was unanimous. Mr. Carls
abstained. Vice Chairman Weidauer declared the motion carried.
VI. CHAIRMAN\MEMBER COMMENTS
There were no chairman or member comments presented.
VII. SET NEXT MEETING
The parties mutually agreed to extend the 40-day time frame for scheduling the
appeal hearing. A date will be forthcoming.
VIII. PUBLIC COMMENT
There were no comments presented by the public.
IX. ADJOURNMENT
There being no further business to be discussed, the meeting was adjourned at
5:13 p.m.
