CITY OF HENDERSON PLANNING COMMISSION REGULAR MEETING Thursday, September 13, 2018 Council Chambers Time: 6:00 PM 240 Water Street Meeting Inquiries: (702) 267-1500 Henderson, Nevada 89015 NOTICE To persons with special needs: For those requiring special assistance or accommodation to attend or participate in this meeting, arrangements for a sign language interpreter or services necessary for effective communication for qualified persons with disabilities should be made as soon as possible, but no later than 72 hours before the scheduled event. Individuals speaking on an item will be limited to three (3) minutes and spokespersons for a group will be limited to ten (10) minutes at the discretion of the Chairman. The Chairman reserves the right to curtail abusive, offensive, inflammatory or repetitive comments that disrupt, disturb or otherwise impede the orderly conduct of the meeting. In addition, any person willfully disrupting the meeting may be removed from the room by the presiding officer. See NRS 241.030(4)(a). Examples of disruptive conduct include, without limitation, yelling, stamping of feet, whistles, applause, heckling, name calling, use of profanity, personal attacks, physical intimidation, threatening use of physical force, assault, battery, or any other acts intended to impede the meeting or infringe on the rights of the commission members, City staff, or meeting participants. Planning Commission's recommendation on agenda items containing comprehensive plan amendments, zone changes, master streets and highway amendments, and vacations are forwarded to City Council for review and decision unless Planning Commission acts otherwise. All other items will receive final action by the Planning Commission unless otherwise noted. Appeals of final decisions by Planning Commission must be submitted to the Director of Community Development within nine (9) calendar days of notice to the City Clerk. If the ninth day falls on a City- observed holiday, the time is extended to the next City working day. Appeals of final decisions will be forwarded to City Council for consideration. CONTINUED PUBLIC HEARING DEV-2018000450 - DEVELOPMENT AGREEMENT UNION VILLAGE MAJOR MODIFICATION APPLICANT: UNION VILLAGE, LLC To be heard at City Council on October 2, 2018 (For Possible Action) Major Modification to amend and restate the Union Village Development Agreement to: (i) include standards in Section 4.1.vi, Master Sign, Plan to address the criteria for existing Off-Premises Signs (Billboards), (ii) update the terms of the agreement to account for past performance of certain obligations, and (iii) make other administrative modifications, including allowing for future recording of certain modifications executed by the Developer and VHS without other owner consent, so long as such modification does not materially affect the rights or obligations of such other owner(s), and also eliminating the requirement that major modifications require an amendment and restatement of the development agreement, for a planned community on 155 acres generally located northwest of Gibson Road and Galleria Drive, in the Eastside Redevelopment Area and Midway Planning Area.
