The Chairman reserves the right to hear agenda items out of order, combine two or more agenda items for consideration, remove an item from the agenda, or delay discussion relating to an item on the agenda at any time. Public comment will be taken on each agenda item as it is heard. Public comment will be taken during the designated Public Comment period, on Consent Agenda items that have been pulled for discussion, and on Public Hearing items. Individuals will be limited to three (3) minutes and spokespersons for a group will be limited to ten (10) minutes at the discretion of the Chairman. The Chairman reserves the right to curtail abusive, offensive, inflammatory, or repetitive comments that disrupt, disturb, or otherwise impede the orderly conduct of the meeting. See NRS 241.030(4)(a). Examples of disruptive conduct include, without limitation, yelling, stamping of feet, whistles, applause, heckling, name calling, use of profanity, personal attacks, intimidation, threats, or any other comments intended to impede the meeting or infringe on the rights of the Henderson Planning Commission, City staff, or meeting participants. All other items will receive final action by the Planning Commission unless otherwise noted. Appeals of final decisions by Planning Commission must be submitted to the Director of Community Development within nine (9) calendar days of notice to the City Clerk. If the ninth day falls on a City-observed holiday, the time is extended to the next City working day. Appeals of final decisions will be forwarded to City Council for consideration. RECOMMENDATION: Recommended approval; to be heard at City Council on December 7, 2021. City-initiated amendment to the Cadence Development Agreement (Landwell 2200), to revise Section 4.15 to include a new provision for construction and cost-sharing of a new wastewater lift station to serve Villages A and C and existing development west of Cadence, and provide for the potential combination of reservoirs 1780 and 1877 with a cost sharing provision, for a planned community on 2200 acres generally located northeast of Boulder Highway and Lake Mead Parkway, in the Eastside Redevelopment and Cadence Planning Areas. RECOMMENDATION: Recommended denial; to be heard at City Council on December 7, 2021. A) Amend the Comprehensive Plan Land Use category from LDR (Low Density Residential) on 5.8 acres and PS (Public/Semipublic) on 5.6 acres to MDR (Medium-Density Residential) on 11.4 acres; B) Amend a zone change/master plan (MacDonald Highlands) to rezone from RS-2-MP-H (Low Density Residential) to PS-MP-H (Public / Semipublic), all with Master Plan and Hillside Overlays, on approximately 19.0 acres within PA-7A; and to rezone from RS-4-MP-H (Low-Density Residential) on 5.8 acres and PS- MP-H (Public / Semipublic) on 5.6 acres to RM-16-MP-H (Medium-Density Residential) in PA-18, all with Master Plan and Hillside Overlays, and create a new Planning Area (PA-28) on 11.4 acres; amend the master plan to increase the maximum overall residential unit cap from 1,062 to 1,221 units; and include the following waivers for the new PA-28 only: pp) to increase maximum height for multi-family buildings from 35-feet to 323 feet for the “north tower” and to 307 feet for the “south tower” and reduce the setbacks of primary buildings to 20 feet for all north ground level units, 302 feet (north) and 22 feet (west) for the “north tower“, and 282 feet (west) and 74 feet (south) for the “south tower“, where the setbacks are required to match the height of the building, qq) to allow for one restaurant with a bar by right within a proposed multi-family tower, and rr) to increase the maximum vertical cut height from 35 feet to 75 feet; C) Amend the tentative map for PA-18 to reduce the acreage from 342 to 330.6 acres, and reduce the number of lots from 266-lots (234 single-family, 31 common, 1 remnant) to 265-lots (233 single-family, 31 common, 1 remnant), and create a separate 11.4-acre parcel for a proposed multi-family development; and D) Review of architecture and site design for a 181-unit, multi-family high rise residential development, on 11.4 acres, generally located northeast of the intersection of Cityview Ridge Drive and Rock Peak Drive, in the MacDonald Ranch Planning Area. RECOMMENDATION: Final Action by Planning Commission Allow a maximum building height of 39 feet from finished grade where 35 feet is permitted without a required stepped or terraced horizontal offset and allow a rear setback of 15 feet where 30 feet is required, located at 500 Dragon Gate Court in the MacDonald Ranch Planning Area. 18. PUBLIC HEARING ZCO-2004670085-A3 - ZONE CHANGE AMENDMENT ANTHEM MINI-STORAGE APPLICANT: DALLENBACH COLE ARCHITECTURE For Possible Action. RECOMMENDATION: Recommended approval; to be heard at City Council on December 7, 2021. Amend a zone change/master plan (Anthem) with Planned Unit Development to review architectural design and site modifications for a new mini-storage building within an existing mini-storage facility with a waiver request to reduce the required drive aisle widths for a mini-storage facility from 32 feet to 28 feet, located at 2950 Bicentennial Parkway in the Anthem Planning Area.
