CITY OF HENDERSON PLANNING COMMISSION REGULAR MEETING AGENDA Thursday, July 14, 2022 Council Chambers 4:00 PM 240 Water Street Meeting Inquiries: (702) 267-1500 Henderson, Nevada 89015 Notice to persons with special needs: For those requiring special assistance or accommodation to participate in this meeting, arrangements for a sign language interpreter should be made as soon as possible, but no later than 72 hours before the scheduled meeting. The Chair reserves the right to hear agenda items out of order, combine two or more agenda items for consideration, remove an item from the agenda, or delay discussion relating to an item on the agenda at any time. Public comment will be taken on each agenda item as it is heard. Public comment will be taken during the designated Public Comment period, on Consent Agenda items that have been pulled for discussion, and on Public Hearing items. Individuals will be limited to three (3) minutes and spokespersons for a group will be limited to ten (10) minutes at the discretion of the Chair. The Chair reserves the right to curtail abusive, offensive, inflammatory, or repetitive comments that disrupt, disturb, or otherwise impede the orderly conduct of the meeting. See NRS 241.030(4)(a). Examples of disruptive conduct include, without limitation, yelling, stamping of feet, whistles, applause, heckling, name calling, use of profanity, personal attacks, intimidation, threats, or any other comments intended to impede the meeting or infringe on the rights of the Henderson Planning Commission, City staff, or meeting participants. Planning Commission's recommendation on agenda items containing comprehensive plan amendments, zone changes, development agreements, master streets and highway amendments, and vacations are forwarded to City Council for review and decision unless Planning Commission acts otherwise. All other items will receive final action by the Planning Commission unless otherwise noted. Appeals of final decisions by Planning Commission must be submitted to the Director of Community Development within nine (9) calendar days of notice to the City Clerk. If the ninth day falls on a City-observed holiday, the time is extended to the next City working day. Appeals of final decisions will be forwarded to City Council for consideration. RECOMMENDATION: Final denial by Planning Commission Waiver request from the Development Code standards to reduce the interior side setback from 5 feet to 0 feet, reduce the setback from the primary dwelling to an existing accessory structure (RV shade structure) from 6 feet to 4 feet 10 inches, and increase the maximum size of an accessory structure from 1,045 feet to 1,323 square feet located at 621 E. Fairway Road, in the Black Mountain Planning Area. 17. PUBLIC HEARING WOS-2022010292 - WAIVER OF STANDARDS TOONE RESIDENCE RV AWNING APPLICANT: CAMILLE TOONE For Possible Action. RECOMMENDATION: Continue to the August 11, 2022, Planning Commission meeting. Waiver request from Development Code standards to reduce the minimum interior side setback from 5 feet to 0 feet and reduce the setback from the primary dwelling to an existing accessory structure (RV shade structure) from 6 feet to 0 feet located at 623 E. PUBLIC HEARING DEV-2022009814 DEVELOPMENT AGREEMENT AMENDED AND RESTATED CADENCE DEVELOPMENT AGREEMENT APPLICANT: THE LANDWELL COMPANY, LP For Possible Action. RECOMMENDATION: Recommended approval; to be heard by City Council on July 19, 2022. Major modification to the Cadence Development Agreement (Landwell 2200) to, among other things, 1) remove the Urban Core land use from the Cadence Master Plan and replace it with Neighborhood and Village Center land uses; 2) reduce the overall maximum unit count from 13,250 dwelling units to 12,250 dwelling units; 3) make adjustments to the Cadence Design Standards including: a) amending Exhibit 3.1 to remove Urban Core areas and replace those in Villages L and M with Residential and Village N with Village Center; b) amend Table 3.1 to reflect the reduced maximum dwelling unit and commercial square footages; c) amend Section 3.4 to reflect new Village descriptions; d) amend several product types of Section 5 to allow for unique housing products in Villages K, L, and M; e) amend the Boulder Highway street section to account for residential products adjacent to the road right-of-way; and, 4) amend and restate the Development Agreement to incorporate all prior amendments, Major Modifications, and Minor Modifications for a Planned Community on 2200 acres generally located northeast of Boulder Highway and Lake Mead Parkway, in the Eastside Redevelopment and Cadence Planning Areas. IX. PUBLIC COMMENT Items discussed under Public Comment cannot be acted upon at this meeting but may be referred by Planning Commission to the appropriate body for follow- up (NRS 241.020). Public Comment will be limited to three (3) minutes at the discretion of the Chair.
