CITY OF HENDERSON PLANNING COMMISSION MINUTES Thursday, August 15, 2024 I. CALL TO ORDER (Minutes/Discussion) Chair Bill Bokelmann called the Henderson Planning Commission meeting to order at 4:00 p.m., in the City Council Chambers, City Hall, 240 S. Water Street, Henderson, Nevada 89015. II. CONFIRMATION OF POSTING (Minutes/Discussion) Michelle Menor, Planning Commission Coordinator, confirmed the Henderson Planning Commission meeting had been noticed in compliance with the Nevada Open Meeting Law. III. ACCEPTANCE OF AGENDA (For Possible Action) (Minutes/Discussion) Brian Adams, Principal Planner, read the following changes to the agenda into the record: Item 5, staff memorandum dated August 15, 2024, modifying paragraph 4 on page 7 of the staff report regarding the parks and recreation reservations, and amending conditions on CUP-2015500267-A1 regarding sound mitigation to revise condition 7 and add conditions 8 and 9. Item 7, staff memorandum dated August 12, 2024, disclosing the removal of duplicate pages in the backup and changing the language of condition 3 for both VAA-2024014943 & MSP-2024014795. Item 9, staff memorandum dated August 12, 2024, adding a site plan showing the sight visibility zone. (Motion) Commissioner Rebecca Grismanauskas introduced a motion accept the agenda, as amended. PRESENTATION UNIVERSITY AREA LIVABLE CENTERS STUDY COMMUNITY DEVELOPMENT AND SERVICES DEPARTMENT Presentation of the update to the City of Henderson’s 2004 College Area Plan with the University Area Livable Centers Study through the Regional Transportation Commission of Southern Nevada’s (RTC) Livable Centers Study Program. (Minutes/Discussion) Andrew Powell, Long-Range Planning Manager, introduced Michelle Laramy, RTC Project Lead, and Lindsay Saner, Kimley Horn Project Manager. Ms. Saner presented an update to the City of Henderson’s 2004 College Area Plan with the University Area Livable Centers Study and actions to move forward with the plan. A brief discussion ensued regarding mobility centers and different mobility choices and opportunities. VII. CONSENT AGENDA 2. MINUTES PLANNING COMMISSION MEETING JULY 11, 2024 Approve the Planning Commission meeting minutes of July 11, 2024. (Motion) Commissioner Jennifer Lewis introduced a motion to approve the Planning Commission meeting minutes of July 11, 2024. TMA-2022009904-A1 - TENTATIVE MAP AMENDMENT OMP GATEWAY 11 APPLICANT: EL DORADO ROCK & SAND, LLC; EL DORADO VALLEY OWNER, LP Amend a tentative map to increase the total acreage from 125.4 to 125.9 acres, adding a 0.5-acre parcel to an existing 2-lot commercial subdivision, generally located southwest of the Interstate 11 off-ramp and Railroad Pass Casino Road, in the Eldorado Valley Area. (Motion) Commissioner Jennifer Lewis introduced a motion for final approval of TMA-2022009904-A1, subject to conditions. PUBLIC WORKS CONDITIONS 1. The acceptance or approval of this item does not authorize or entitle the applicant to construct the project referred to in such application or to receive further development approvals, grading permits or building permits, nor does it infer approval for final lot configuration, geometry, or roadway layout. Public Works Department approval is based upon review of the civil improvement plans and associated studies, not planning documents. 2. Applicant shall obtain and provide all necessary permissions/approvals from Nevada Department of Transportation. 3. Applicant shall apply and receive approval of a revocable permit for all non-standard items within the public right-of-way (or City-owned property). 4. The applicant must construct Railroad Pass Casino Road and Whidbey Road per the Eldorado Valley design standards. These improvements must be shown on the civil improvement plan. 5. A copy of the cross-access agreement for APN 189-11-110-003 must be provided with the traffic study submittal. 6. A truck queuing analysis must be provided with the traffic study. The engineer must contact the City for a scope. The study must address on-site truck queuing and demonstrate how the truck queue will be assigned to the appropriate driveways/truck queue location. 7. Depending on the findings of the traffic study, changes to onsite circulation may be required. Any changes that may be required must be addressed prior to submitting the civil improvement plan. 8. The applicant must construct a 5-foot-wide concrete sidewalk along property frontage on the south side of Railroad Pass Casino Road and east side of future Whidbey Road. These improvements must be shown on the civil improvement plans. Planning Commission Page 5 of 30 Thursday, August 15, 2024 – Minutes 9. The applicant must construct a 12-foot-wide asphalt trail along property frontage on the north side of Railroad Pass Casino Road and west side of future Whidbey Road. These improvements must be shown on the civil improvement plans. 10. Traffic shall not stop, stand or park on public roadways while waiting to enter into the site. If operations for the warehouse occur in a way that disrupts traffic, the City will require the developer to employ all means necessary to remedy the situation at the sole cost of the owner/operator of the warehouse. Additionally, an update to the traffic impact study will be required. Mitigation measures shall be to the satisfaction of the City and shall be completed within a time frame determined by the City. 11. The applicant must construct a northbound to westbound left turn lane on Dawson at the driveway at APN 189-11-110-003. These improvements must be shown on the civil improvement plans. 12. NDOT review/approval is required. 13. Parcel is located adjacent to Nevada Department of Transportation (NDOT) right of way; therefore, concurrence will be required from NDOT including the drainage study. 14. Depending on the findings of the traffic study, a number of on-site truck parking spaces will be required. Changes to the site plan may be required to accommodate truck parking. Any changes that may be required must be addressed prior to submitting the civil improvement plan. 15. Trees shall not be planted within 50 feet in front of a traffic sign, signal indication, and beacons. Please show on all landscape plan sheets. 16. The applicant must provide and install a pedestrian flashing beacon system on Railroad Pass Casino Road, including all associated signing and striping. The exact location of the beacon system will be determined during the civil improvement plan review process. 17. Applicant shall submit a drainage study for Public Works' approval. 18. Applicant must address the Las Vegas Valley Parking Lot Low Impact Development Criteria as set forth in Section 1500 of the Clark County Regional Flood Control District Design Manual. 19. Applicant shall construct full offsites per Public Works' requirements and dedicate any necessary right-of-way. 20. Applicant shall submit Civil Improvement Plans per Public Works' requirements. 21. Applicant shall dedicate public right-of-way per Public Works' requirements. 22. Applicant must apply and receive approval to vacate unnecessary rights-of-way and/or easements per Public Works’ requirements. Planning Commission Page 6 of 30 Thursday, August 15, 2024 – Minutes 23. All parcels and property owners within this commercial subdivision, whether or not an owner association is formed or whether such association is active, shall be jointly and severally responsible for maintaining any common or open space areas or any parcels deeded to an owner association within the commercial subdivision, in compliance with all applicable codes, and shall not be relieved of individual responsibility for complying with all conditions of approval of the commercial subdivision by the formation of an owner’s association. This joint and several responsibility shall remain for the life of this commercial subdivision. All property owners within this commercial subdivision hereby grant all rights and permissions necessary, whether in the form of an easement, permit or other grant, to all other property owners within the commercial subdivision for all shared responsibilities, including, but not limited to, landscaping, fire system components, and utility access, repair and maintenance. 24. Applicant shall submit a traffic impact study to address traffic concerns and to determine the proportionate share of this development's local participation in the cost of traffic signals and/or intersection improvements. Applicant shall comply with conditions of the traffic study. 25. All street intersections and driveways must have adequate sight visibility per CCAUSD 201.2 and H.M.C. 19.12.5.D.3. Trees, landscape, berms, block wall, and/or (above ground) utilities that is 24 inches in height or greater must be located outside of the sight visibility zones. 26. Applicant must manage pedestrian and vehicular traffic queueing onsite. If traffic issues which negatively impact public right-of-way should arise, this application may be revoked and / or future applications may be denied. Throat depth must be minimum 75 feet, or the required length per the queuing analysis, whichever is longer. 27. Commercial driveways shall be dedicated and constructed per Clark County Area Standard Drawings No 222.1 and 225. PARKS AND RECREATION CONDITION 28. Applicant shall provide a trail corridor with a 10-foot-wide asphalt trail along Public Street and a 12-foot-wide brown asphalt trail on the north-south street along Building 2. Trail corridor width, landscape, lighting, signage, and irrigation to be per the Standardized Design Guidelines for the City of Henderson Parks and Recreation Department. Landscape, irrigation and lighting shall be owner maintained, installed per Development Code and lighting shall be per AASHTO Standards. Trail surface and signage shall be City of Henderson maintained. Applicant shall grant a public access easement over the trail. Applicant shall pay fees and bond for improvements as part of the Civil Improvement Plan process. Planning Commission Page 7 of 30 Thursday, August 15, 2024 – Minutes UTILITY SERVICES CONDITIONS 29. Applicant shall submit a utility plan and utility analysis for Department of Utility Services' approval. 30. Applicant shall comply with the requirements of the master utility plan established for the project area. 31. Applicant shall grant a municipal utility easement per the Department of Utility Services' requirements. 32. Applicant shall resolve all mapping concerns per the Department of Utility Services' requirements. 33. All onsite utilities shall remain privately owned and maintained. 34. Civil improvement plans shall comply with the requirements of the Uniform Design and Construction Standards for Water Distribution Systems and the Design and Construction Standards for Wastewater Collection Systems. 35. Applicant shall prepare water and sewer system design in accordance with the Department of Utility Services' requirements. Approval of this application does not infer Department of Utility Services' approval for the water and sewer system layout as reflected on the application. 36. Applicant may be required to provide a water and/or sewer system capacity analysis covering the overall water and/or sewer system providing service to the project, prior to submitting civil improvement plans to the City. Preparation of said capacity analysis shall be coordinated with the Department of Utility Services. 37. Applicant may be responsible for performing water and/or sewer system upgrades in accordance with the results of the system capacity analysis or, at a minimum, applicant shall be responsible for participating in a proportionate share of the costs to complete these system upgrades. 38. Applicant shall extend water and sewer facilities full frontage of unnamed street on west side of proposed project from shown round-a-bout to property line. COMMUNITY DEVELOPMENT PLANNING SERVICES CONDITIONS 39. Approval of this application requires the applicant to comply with all Code requirements not specifically listed as a condition of approval but required by Title 19 of the Henderson Municipal Code, compliance with all plans and exhibits presented and amended as part of the final approval, and compliance with all additional items required to fulfill conditions of approval. Subsequent changes or revisions to any of these plans and/or exhibits are subject to an amendment to this application for approval. 40. Approval of this tentative map amendment, for a 2-Lot commercial subdivision, shall be for a period of four years from the effective date of the original approval. Applicant shall submit a list of proposed street names to Community Development for approval prior to approval of the final map. 42. Prior to issuance of a building permit for buildings, the applicant shall submit to Community Development and Neighborhood Services a copy of the Owner's Association's (i.e., Property Owner's Association or Landscape Maintenance Association) articles of incorporation to include association name, officers, addresses, and resident agent (if applicable). 43. All grading and construction/staging activity must remain completely on-site, or will require the approval of any and all affected adjacent property owner(s). 44. Applicant must grant, with recordation of the final map, a perpetual, non-exclusive easement for ingress, egress, and use upon and over all portions delineated as a private street for the benefit of all lots shown hereon. All private streets must be privately maintained. TMA-2024014979 - TENTATIVE MAP TERRA ROSA SUBDIVISION APPLICANT: SARATOGA VEGAS, LLC A 6-lot (5 single-family, 1 common) residential subdivision on 3.4 acres generally located east on Westridge Drive, approximately 1,470 feet south of its intersection with Horizon Ridge Parkway, in the McCullough Hills Planning Area. (Motion) Commissioner Jennifer Lewis introduced a motion for final approval of TMA-2024014979, subject to conditions. PUBLIC WORKS CONDITIONS 1. The acceptance or approval of this item does not authorize or entitle the applicant to construct the project referred to in such application or to receive further development approvals, grading permits or building permits, nor does it infer approval for final lot configuration, geometry, or roadway layout. Public Works Department approval is based upon review of the civil improvement plans and associated studies, not planning documents. 2. Applicant shall submit a traffic impact study to address traffic concerns and to determine the proportionate share of this development's local participation in the cost of traffic signals and/or intersection improvements. Monument signs, trees, landscape, and/or (above ground) utilities that are 24 inches in height or greater shall not be located within public rights-of-way, easements or the sight visibility restriction zones per Clark County Area Standard Drawing No. 201.2 and H.M.C. 19.12.5.D.3. BUILDING AND FIRE SAFETY CONDITIONS The authority for enforcing the International Fire Code is NRS 477.030 and Ordinance Number 3510 as adopted by the City of Henderson. Building and Fire Safety approval is based upon review of the civil improvement or building drawings, not planning documents. 10. Applicant shall submit plans for review and approval prior to installing any gate, speed humps (speed bumps not permitted), and any other fire apparatus access roadway obstructions. 11. Applicant shall submit fire apparatus access road (fire lane) plans for Fire Department review and approval. Planning Commission Page 10 of 30 Thursday, August 15, 2024 – Minutes 12. Applicant shall submit utility plans containing fire hydrant locations. Fire Department approval is based upon the review of the civil improvement drawings, not planning documents. Fire hydrants shall be installed and operational in accordance with the Henderson Fire Code. 13. Applicant shall provide approved primary and secondary roads from the proposed project to existing paved roadways. 14. Applicant shall provide a dual water source (if possible) as approved by Public Works and the Fire Department. 15. Applicant shall provide a minimum turning radius of 52 feet outside and 28 feet inside for all portions of the fire apparatus access road (fire lane). This radius shall be shown graphically and the dimensions noted on the drawings. 16. Applicant shall install an approved sprinkler system in all buildings / dwelling units as required by the Hillside Ordinance. COMMUNITY DEVELOPMENT PLANNING SERVICES CONDITIONS 17. Approval of this application requires the applicant to comply with all Code requirements not specifically listed as a condition of approval but required by Title 19 of the Henderson Municipal Code, compliance with all plans and exhibits presented and amended as part of the final approval, and compliance with all additional items required to fulfill conditions of approval. Subsequent changes or revisions to any of these plans and/or exhibits are subject to an amendment to this application for approval. 18. Approval of this tentative map for a 6-lot (5 single-family, 1 common) residential subdivision shall be for a period of four years from the effective date of approval. 19. The proposed street names are not approved through this application. Applicant shall submit a list of proposed street names to Community Development for approval prior to approval of the final map. 20. Prior to issuance of a building permit for homes, the applicant shall submit to Community Development and Neighborhood Services a copy of the Owner's Association's (i.e., Homeowners Association or Landscape Maintenance Association) articles of incorporation to include association name, officers, addresses, and resident agent (if applicable). 21. Applicant must post a bond with the Public Works Department for the installation of all perimeter landscaping and common open space landscaping and amenities prior to approval of the Civil Improvement Plans. 22. Applicant must post a hillside restoration bond with the Public Works Department prior to approval of a Grading Permit. 23. All grading and construction/staging activity must remain completely on-site, or will require the approval of any and all affected adjacent property owner(s). Plant varieties shall be rated at least three stars or above, be low or very low water use, and be water efficient and drought tolerant. CONTINUED PUBLIC HEARING A) CUP-2015500267-A1 - CONDITIONAL USE PERMIT AMENDMENT B) CUP-2024014903 - CONDITIONAL USE PERMIT STRONG TOWER NEW SANCTUARY APPLICANT: CENTRO CRISTIANO TORREON FUERTE A) Expansion of an existing Religious Assembly, located at 6100 Mountain Vista Street, Suites 110, 120, and 130; and B) A School located at 1999 Whitney Mesa Drive; generally located southeast of the intersection of Mountain Vista Street and Whitney Mesa Drive, in the Green Valley North Planning Area. (Minutes/Discussion) Erica Sosa, Senior Planner, provided a summary of this item and stated staff recommends approval. Jared Tasko, Principal Planner, provided a history of this item and reviewed the staff memorandum and conditions. Edgar Miron, 89014, representing the applicant, agreed with staff's recommendation and the conditions of approval. Chair Bill Bokelmann opened the public hearing. Nathan Whittaker, 89014, voiced concerns regarding parking, noise, students playing in the parking lot, and lack of permits in place when concerns were originally brought to the City. Planning Commission Page 12 of 30 Thursday, August 15, 2024 – Minutes Chris Ohrm, 89014, landlord of the site, encourages all tenants to obtain required permits and comply with the Henderson Municipal Code. Carrie Buck, 89015, and Godwin Ozeka, 89012, spoke in support of the project. There being no one else wishing to speak, the public hearing was closed. (Motion) Commissioner Michael Brunson introduced a motion for final approval of CUP-2015500267-A1 and CUP-2024014903, subject to findings of fact and conditions. CUP-2015500267-A1 FINDINGS OF FACT A. The proposed use complies with all applicable provisions of this Code unless otherwise expressly stated. B. There is a need for the proposed use at the proposed location. C. The proposed use is compatible with adjacent uses in terms of scale, site design, and operating characteristics (hours of operation, traffic generation, lighting, noise, odor, dust, and other external impacts). D. Any significant adverse impacts resulting from this use will be mitigated or offset to the maximum practical extent. E. The proposed use will not cause substantial diminution in value of other property in the neighborhood in which it is to be located. F. Public safety, transportation, and utility facilities and services will be available to serve the subject property, while maintaining sufficient levels of service for existing development. G. Adequate assurances of continuing maintenance have been provided. H. Any significant adverse impacts on the natural environment will be mitigated to the maximum practical extent. PUBLIC WORKS CONDITION 1. The acceptance or approval of this item does not authorize or entitle the applicant to construct the project referred to in such application or to receive further development approvals, grading permits or building permits, nor does it infer approval for final lot configuration, geometry, or roadway layout. BUILDING AND FIRE SAFETY CONDITIONS The authority for enforcing the International Fire Code is NRS 477.030 and Ordinance Number 3510 as adopted by the City of Henderson. Applicant shall obtain a Fire Department permit for place of assembly prior to engaging in a hazardous activity or use. (A1) 3. The structural system for the building will need to be evaluated by a Nevada Licensed Engineer for any future expansion of the religious facility for worship. A technical opinion and report or building remodel permit addressing any structural changes shall be submitted to the City of Henderson Building and Fire Safety for review and approval prior to any future expansion. (A1) 4. Applicant shall obtain a Building remodel permit for change of occupancy prior to utilizing this building for assembly use. (A1) COMMUNITY DEVELOPMENT PLANNING SERVICES CONDITIONS 5. Approval of this application requires the applicant to comply with all Code requirements not specifically listed as a condition of approval but required by Title 19 of the Henderson Municipal Code, compliance with all plans and exhibits presented and amended as part of the final approval, and compliance with all additional items required to fulfill conditions of approval. 6. This conditional use permit for an expansion of an existing religious facility shall lapse one year from the effective date of approval unless the use is established, commenced or extended in accordance with Section 19.22 of the Development Code. (A1) 7. Prior to issuance of a building permit, the applicant shall demonstrate how sound mitigation has been provided to the partition walls separating the use from the adjacent businesses to reduce the impacts of the noise created from the music and operations of the religious assembly in compliance with Henderson Municipal Code Title 8. Failure to comply with Code may start revocation of the CUP. (A1) 7. Prior to issuance of the building permit, the applicant must show on the permit plan set, sound mitigation and wall details for the partition walls separating the use from the adjacent businesses per the ASTM E90 standard with a rating of not less than 45 decibels. (A1) 8. Provide evidence of a sound test from a third-party verifying a Normalized Noise Isolation Class (NNIC) rating of not less than 45 decibels prior to final inspection. This report shall be submitted as a deferred submittal prior to final inspection. (A1) 9. Conditions #7 and #8 referencing sound mitigation shall be noted on the cover sheet of the plan set. Civil improvement plans shall comply with the requirements of the Uniform Design and Construction Standards for Water Distribution Systems and the Design and Construction Standards for Wastewater Collection Systems. BUILDING AND FIRE SAFETY CONDITIONS The authority for enforcing the International Fire Code is NRS 477.030 and Ordinance Number 3510 as adopted by the City of Henderson. Building and Fire Safety approval is based upon review of the civil improvement or building drawings, not planning documents. 7. Applicant shall submit plans for review and approval prior to installing any gate, speed humps (speed bumps not permitted), and any other fire apparatus access roadway obstructions. 8. Applicant shall submit fire apparatus access road (fire lane) plans for Fire Department review and approval. 9. Applicant shall submit utility plans containing fire hydrant locations. Fire Department approval is based upon the review of the civil improvement drawings, not planning documents. Fire hydrants shall be installed and operational in accordance with the Henderson Fire Code. 10. Applicant shall provide secondary access as approved by Public Works and the Fire Department. Applicant shall provide a minimum turning radius of 52 feet outside and 28 feet inside for all portions of the fire apparatus access road (fire lane). This radius shall be shown graphically and the dimensions noted on the drawings. 13. Applicant shall install an approved fire sprinkler system as required by Code. 14. Applicant shall install an approved fire alarm system as required by Code. COMMUNITY DEVELOPMENT PLANNING SERVICES CONDITIONS 15. The applicant shall submit to the Community Development Department an electronic copy of the site plan with building footprints, driveways, parking, fire hydrants, Fire Department connections, and unit numbers in the latest AutoCAD release prior to issuance of building permits. 16. All aboveground public and private-owned utility equipment shall be screened by a cabinet, landscaping or decorative wall. 17. Approval of this application requires the applicant to comply with all Code requirements not specifically listed as a condition of approval but required by Title 19 of the Henderson Municipal Code, compliance with all plans and exhibits presented and amended as part of the final approval, and compliance with all additional items required to fulfill conditions of approval. Subsequent changes or revisions to any of these plans and/or exhibits are subject to an amendment to this application for approval. 18. All walls, fences, and gates visible from streets, parking lots, and common areas shall be constructed of decorative materials and installed by the applicant. Unless specifically shown on the approved plans, the use of chain link fence or colored, common gray or painted CMU block shall not be permitted. 19. Applicant shall submit landscaping and irrigation construction documents for Community Development staff to review and approve prior to the issuance of a building permit. Landscape and irrigation construction documents shall include all required common area, parking lot, and perimeter landscaping. 20. Unless approved by a phasing plan, all landscaping shall be installed with the first phase of development. All landscaping shall be maintained by the applicant or property owner(s) association. 21. Approval of this design review for improvements to an existing building to be repurposed as a new fire station shall be for a period of 18 months from the effective date of approval, unless the approval is extended in accordance with Section 19.24 of the Development Code.
