CITY OF HENDERSON REDEVELOPMENT AGENCY ADVISORY COMMISSION MINUTES REGULAR MEETING Tuesday, September 24, 2019 I. CALL TO ORDER Chairman Ronald Leavitt called the Redevelopment Agency Advisory Commission Meeting to order at 4:05 p.m. in the Annex Conference Room, City Hall Annex, 280 Water Street, Henderson, Nevada. II. CONFIRMATION OF POSTING AND ROLL CALL Brittany West, Redevelopment Commission Coordinator, confirmed the meeting had been noticed in accordance with the Open Meeting Law by posting the Agenda three working days prior to the meeting at City Hall, Henderson Convention Center, Green Valley Police Substation, Fire Station No. 86, the Nevada Public Notice Website, the City of Henderson Website, and by mailing and emailing a copy of the agenda to everyone appearing thereon on the Agenda Master Mailing List and Email List. PUBLIC COMMENT There were no public comments presented. IV. ACCEPTANCE OF AGENDA Mr. McGinty introduced a motion to accept the agenda as presented. The vote favoring approval was unanimous. Chairman Leavitt declared the motion carried. V. NEW BUSINESS RAC-1 MINUTES REDEVELOPMENT AGENCY ADVISORY COMMISSION MEETING AUGUST 27, 2019 Redevelopment Agency Redevelopment Agency Advisory Commission meeting minutes of August 27, 2019. Victoria Dasis, Deputy City Clerk, said she will correct the meeting minutes of August 27, 2019, to reflect Mr. Leavitt as the Chairman. (Motion) Mr. McGinty introduced a motion to adopt the Redevelopment Agency Advisory Commission meeting minutes of August 27, 2019, as amended. The vote favoring approval was unanimous. Chairman Leavitt declared the motion carried. RAC-2 RESOLUTION FUNDING AGREEMENT TO ALLOCATE CONSTRUCTION FUNDING FOR CORNERSTONE PARK BRIDGE Redevelopment Agency A RESOLUTION OF THE CITY OF HENDERSON REDEVELOPMENT AGENCY, CLARK COUNTY, NEVADA, APPROVING A FUNDING AGREEMENT BETWEEN THE CITY OF HENDERSON AND THE REDEVELOPMENT AGENCY TO FUND CONSTRUCTION AND DESIGN COSTS FOR THE REPLACEMENT OF A PEDESTRIAN BRIDGE AT CORNERSTONE PARK LOCATED GENERALLY AT 1600 WIGWAM PARKWAY AND IDENTIFIED AS CLARK COUNTY ASSESSOR’S PARCEL NUMBERS 178-16-601-005, 178-16-501-001, AND 178-16-510-002 WITHIN THE CORNERSTONE REDEVELOPMENT AREA, IN AN AMOUNT NOT TO EXCEED $500,000.00. Redevelopment Agency Advisory Commission Page 3 of 6 Tuesday, September 24, 2019 – Minutes David Vorce, Principal Redevelopment Fiscal Administrator, stated a pedestrian bridge at Cornerstone Park is currently submerged under water due to the pond’s current water table level; therefore, staff is recommending the Redevelopment Agency support reconstruction costs in an amount not to exceed $500,000.00. Following an inquiry by Chairman Leavitt regarding whether Cornerstone Park is in a Redevelopment project zone, Mr. Vorce stated Cornerstone Park does reside within a Redevelopment zone and provided a financial history of Redevelopment’s investment into the park. Mr. Foster disclosed his firm has been approached by consultants to potentially repair the trail lights around the pedestrian bridge that are also submerged underwater. Mr. Foster stated he will abstain from the vote to avoid any potential conflict. (Motion) Mr. McGinty introduced a motion to recommend adoption of the resolution of the City of Henderson Redevelopment Agency, Clark County, Nevada, approving a funding agreement between the City of Henderson and the Redevelopment Agency to fund construction and design costs for the replacement of a pedestrian bridge at Cornerstone Park located generally at 1600 Wigwam Parkway and identified as Clark County Assessor’s parcel numbers 178-16-601-005, 178-16-501-001, and 178-16-510-002 Within the Cornerstone Redevelopment area, in an amount not to exceed $500,000.00. The roll call vote favoring passage was: Those voting aye: Nathan Henderson, Ronald Leavitt, Mark McGinty, and John VanderPloeg. Those voting nay: None. Those absent: Richard Serfas and Laura Jane Spina. Those abstaining: Tom Foster. Chairman Leavitt declared the motion carried. Redevelopment Agency Advisory Commission Page 4 of 6 Tuesday, September 24, 2019 – Minutes RAC-3 RESOLUTION TO RATIFY DONATION OF $250,000.00 TO THE COLLEGE OF SOUTHERN NEVADA Redevelopment Agency A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF HENDERSON, NEVADA, RATIFYING THE DONATION OF TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000.00) TO THE COLLEGE OF SOUTHERN NEVADA FOUNDATION FOR THE CONSTRUCTION OF THE COLLEGE OF SOUTHERN NEVADA/NEVADA STATE COLLEGE HEALTH AND SCIENCE BUILDING LOCATED AT THE COLLEGE OF SOUTHERN NEVADA HENDERSON CAMPUS AS A PORTION OF THE PRIVATE CONTRIBUTIONS, IN THE APPROXIMATE AMOUNT OF SIX MILLION DOLLARS ($6,000,000.00) REQUIRED BY THE STATE LEGISLATURE TO PROVIDE THE REMAINING FUNDING FOR THE PROJECT, IN THE APPROXIMATE AMOUNT OF SEVENTY MILLION SEVEN HUNDRED SIXTY-THREE THOUSAND SEVEN HUNDRED AND FORTY-ONE DOLLARS ($70,763,741.00). David Vorce, Principal Redevelopment Fiscal Administrator, discussed how officials in the last legislative session and community members in survey responses have ranked healthcare and education as top investment priorities for Nevada. Mr. Vorce presented the potential benefits the College of Southern Nevada/Nevada State College Health and Science Building could bring to the eastside and why City of Henderson officials approved a donation of $250,000.00 from Redevelopment funds to the project. Chairman Leavitt stated he supports educational projects; however, he does not believe contributions should come from Redevelopment funds due to the project falling outside of what he believes is the purpose of the Redevelopment Agency. Mr. McGinty disclosed that his firm was previously hired to create the design for the building; however, because the work by his firm has already been completed and paid for, Mr. McGinty believed he did not need to abstain from the vote. Chairman Leavitt disclosed that he is a Finance Committee member for Nevada State College; however, since he is not a voting member on the Governance Board, Chairman Leavitt believed he did not need to abstain from the vote. Mr. Henderson commented that the colleges are required to raise private contributions to support the building and believed the ratification would be contrary to the Legislature’s conditions. Redevelopment Agency Advisory Commission Page 5 of 6 Tuesday, September 24, 2019 – Minutes (Motion) Mr. VanderPloeg introduced a motion to recommend approval of a resolution of the Redevelopment Agency to ratify the donation of $250,000.00 to the College of Southern Nevada Foundation for the construction of the College of Southern Nevada/Nevada State College Health and Science Building located at the College of Southern Nevada Henderson Campus with the State Legislature agreeing to provide $70,763,741.00, nearly 92 percent, which is conditioned on the College of Southern Nevada and Nevada State College raising private contributions for the remaining amount of approximately $6,000,000.00 or eight percent. The roll call vote favoring passage was: Those voting aye: None. Those voting nay: Tom Foster, Nathan Henderson, Ronald Leavitt, Mark McGinty, and John VanderPloeg. Those absent: Richard Serfas and Laura Jane Spina. Those abstaining: None. Chairman Leavitt declared the motion failed. (Motion) Mr. Henderson introduced a motion to recommend denial of a resolution of the Redevelopment Agency to ratify the donation of $250,000.00 to the College of Southern Nevada Foundation for the construction of the College of Southern Nevada/Nevada State College Health and Science Building located at the College of Southern Nevada Henderson Campus with the State Legislature agreeing to provide $70,763,741.00, nearly 92 percent, which is conditioned on the College of Southern Nevada and Nevada State College raising private contributions for the remaining amount of approximately $6,000,000.00 or eight percent. The vote favoring denial was unanimous. Chairman Leavitt declared the motion for denial carried. VI. CHAIRMAN\MEMBER COMMENTS A discussion ensued regarding the Commissioners’ concerns with applying Redevelopment funds outside of Redevelopment areas. Chairman Leavitt reiterated the Commission’s purpose within the Redevelopment Agency. Following an inquiry from Mr. Vanderploeg regarding the Commissions’ vote on RAC-3, Bethany Sanchez, Assistant City Attorney III, explained the ratification process of Redevelopment items. David Vorce, Principal Redevelopment Fiscal Administrator, explained that the Nevada Revised Statue 279 states that Redevelopment funds may be applied to areas outside of Redevelopment zones as long as there is justification. Redevelopment Agency Advisory Commission Page 6 of 6 Tuesday, September 24, 2019 – Minutes VII.
