CITY OF HENDERSON REDEVELOPMENT AGENCY MINUTES REGULAR MEETING Tuesday, November 19, 2019 I. CALL TO ORDER Chairman March called the Redevelopment Agency Meeting to order at 5:32 p.m., in the City Council Chambers, City Hall, 240 Water Street, Henderson, Nevada 89015. Chairman March announced the meeting is being video recorded and streamed live over the Internet. II. CONFIRMATION OF POSTING AND ROLL CALL The Secretary confirmed the Redevelopment Agency Meeting had been noticed in compliance with the Open Meeting Law by posting the Agenda three working days prior to the meeting at City Hall, the Multigenerational Center, the Whitney Ranch Recreation Center, Fire Station No. 86, the Nevada Public Notice Website, the City of Henderson Website, and by mailing and emailing a copy of the Agenda to everyone appearing thereon on the Agenda Master Mailing and Emailing List. Present: Debra March, Chairman John F. Marz, Member Dan K. Shaw, Member Dan H. Stewart, Member Absent: Michelle Romero, Member Officers: Richard Derrick, Executive Director/CEO Sabrina Mercadante, Secretary Nicholas Vaskov, General Counsel Absent: None Staff: Jim McIntosh, Treasurer Alyssa Rodriguez, Assistant Director of Public Works Michael Tassi, Community Development and Services Director Victoria Dasis, Deputy City Clerk Andre Dixon, Deputy City Clerk Alyssa Perea, Deputy City Clerk Redevelopment Agency Meeting Page 2 of 4 Tuesday, November 19, 2019 – Minutes III. ACCEPTANCE OF AGENDA (Motion) Member Dan K. Shaw moved to accept the agenda as presented. The roll call vote favoring passage was: Those voting aye: Debra March, John F. Marz, Dan K. Shaw, and Dan H. Stewart. Those voting nay: None. Those absent: Michelle Romero. Those abstaining: None. Chairman March declared the motion carried. IV. ITEMS OF BUSINESS RDA-1 MINUTES REDEVELOPMENT AGENCY MEETING OCTOBER 15, 2019 REDEVELOPMENT City of Henderson Redevelopment Agency Meeting minutes of October 15, 2019. (Motion) Member John F. Marz moved to adopt the City of Henderson Redevelopment Agency Meeting minutes of October 15, 2019. The roll call vote favoring passage was: Those voting aye: Debra March, John F. Marz, Dan K. Shaw, and Dan H. Stewart. Those voting nay: None. Those absent: Michelle Romero. Those abstaining: None. Chairman March declared the motion carried. RDA-2 REDEVELOPMENT AGENCY ANNUAL AUDIT FISCAL YEAR 2018-2019 REDEVELOPMENT Submission of Redevelopment Agency Annual Audited Financial Statements – Fiscal Year 2018-2019 And Required Communications Letter. Redevelopment Agency Meeting Page 3 of 4 Tuesday, November 19, 2019 – Minutes Chairman March made the following disclosure statement: “I need to disclose that the accounting firm of Piercy, Bowler, Taylor, and Kern, that performed the annual audit for the Redevelopment Agency, also provides services to my campaign. I had no involvement in the selection of Piercy, Bowler, Taylor, and Kern by the Redevelopment Agency, and this item simply seeks the acceptance of the annual audit of the Redevelopment Agency. I do not believe that the independence of the judgment of a reasonable person in my situation would be compromised, and I intend to vote on this matter. Nonetheless, I have been advised by counsel to make this disclosure pursuant to the Nevada Ethics in Government Act and to promote transparency.” Member Shaw made the following disclosure statement: “I need to disclose that the accounting firm of Piercy, Bowler, Taylor, and Kern, who performed the annual audit for the Redevelopment Agency, also provides services to me and my campaign. I do not believe that the independence of judgement of a reasonable person in my situation would be compromised, and I intend to vote on this matter.” Anthony Molloy, Redevelopment Manager, presented a summary of this item and stated the Redevelopment Agency received a clean unmodified opinion, and there are no findings or significant adjustments to the annual audit. (Motion) Member Dan K. Shaw moved to accept the Redevelopment Agency’s Fiscal Year 2018-2019 Audited Financial Statements. The roll call vote favoring passage was: Those voting aye: Debra March, John F. Marz, Dan K. Shaw, and Dan H. Stewart. Those voting nay: None. Those absent: Michelle Romero. Those abstaining: None. Chairman March declared the motion carried. Redevelopment Agency Meeting Page 4 of 4 Tuesday, November 19, 2019 – Minutes V. CHAIRMAN\MEMBER COMMENTS There were no Chairman\Member comments presented. VI. PUBLIC COMMENT Tim Griswold, 89015, stated he lives in the Downtown Henderson Townsite community and believes this area is the foundation of Henderson. He expressed concerns with the sidewalks being incompliant with the Americans with Disabilities Act and stated he would like to see additional infrastructure efforts put into the neighborhood. VII. Listening devices are available for persons with hearing impairments. The Chairman reserves the right to hear agenda items out of order, combine two or more agenda items for consideration, remove an item from the agenda, or delay discussion relating to an item on the agenda at any time. Public comment will be taken on each agenda item as it is heard. If you desire to provide public comment on an agenda item, please complete a green speaker card and submit it to the RDA Secretary prior to the item being heard. Individuals speaking on an item will be limited to three (3) minutes and spokespersons for a group will be limited to ten (10) minutes. The Chairman reserves the right to curtail abusive, offensive, inflammatory or repetitive comments that disrupt, disturb or otherwise impede the orderly conduct of the Redevelopment Agency meeting. In addition, any person willfully disrupting the meeting may be removed from the room by the presiding officer. See, NRS 241.030(4)(a). Examples of disruptive conduct include, without limitation, yelling, stamping of feet, whistles, applause, heckling, name calling, use of profanity, personal attacks, physical intimidation, threatening use of physical force, assault, battery, or any other acts intended to impede the meeting or infringe on the rights of the Henderson Redevelopment Agency, City staff, or meeting participants. CHAIRMAN\MEMBER COMMENTS The Chairman and Members may speak on any subject under this section of the agenda. The Chairman and Members may comment on matters including, without limitation, future agenda items, upcoming meeting dates, and meeting procedures. Comments made cannot be acted upon or discussed at this meeting, but may be placed on a future agenda for consideration by the Redevelopment Agency.
