Chairman David Jenkins called the meeting to order at 6:30 p.m. via a Zoom video conference.
OPENING STATEMENT/VOTE:
“It has been determined that meeting electronically is necessary to protect the public health,
safety, and welfare in light of the coronavirus. A recording of this meeting will be made

MOTION BY Longmire, seconded by Lea, to approve the above statement and hold the meeting
electronically. Altizer, Bryant-McCormick, Hardcastle, Jenkins, Lea, Longmire, Peterson, and
Silkwood voted aye. Nay: None. Abstained: None. Absent: Hardwick and Stringfellow. Motion

and to approve a Preliminary Development Plan called Anderson Hill. The property is located at
201 Anderson Lane, on the north side of Anderson Lane, as identified by Sumner County Tax
Map 159N K 018.00.

STAFF REPORT
A Final Plat for Section 35 of Durham Farms has been previously approved with the Developer
agreeing to staff comments. The Developer is requesting to break the plat into sections (35A
and 35B), which will separate the Estate Villas in Section 35A from the Cottage and Carriage
homes in Section 35B.

For the critical access to Long Hollow Pike to be completed, a number of items remain to be
worked out as part of this plat in terms of contingencies. This includes a request from the
developer to be added into the city’s urban growth boundary (UGB) being approved by the
Tennessee Economic and Community Development’s Local Government Policy Advisory Council
(LGPAC), and a subsequent annexation request will need to be provided to incorporate two
parcels included in Section 36 into the City of Hendersonville.
This section includes 17 of the remainder of the Estate Villa lots and two open space tracts (the
other Estate Villas were approved in Sections 16 and 27). This includes the previously agreed to
25’ Tree Preservation and Planting Buffer adjacent to Long Hollow Pointe.

The Meadows of Indian Lake was originally approved as an SR-1 Alternative Open Space
subdivision in February 2001.

At the time of the approval, this 1.97-acre section of the subdivision in front of Indian Lake
Elementary School was designated as a daycare area. It did not develop that way, and in August
2010, original Preliminary Plat approval was given showing the area converted to 5 residential
lots. This Final Plat is in substantial compliance with the Development Plan, the Preliminary Plat
approved in 2010, and the Preliminary Plat approved on January 5, 2021.

20-100-001: OLD SHACKLE ISLAND COTTAGES – PRELIMINARY PLAT:
STAFF REPORT
This submittal includes 8 single-family homes and 1 Open Space lot, located on Old Shackle
Island Road, between Wessington Place and New Shackle Island Road. The property is zoned
Multi-Family Residential (MFR), and the Applicant was approved for a 14-unit Townhome Site
Plan in 2020. The Developer has indicated the multifamily development costs for the property
are not feasible due to the slope, curvature of the road, and other issues.
The new plan proposes

1. Add Note stating, “MFR zoning requires a minimum 35% brick/stone exterior for dwellings.”
2. Add Note stating, “Each lot will be required to have two 9’x18’ minimum spaces or a
minimum 18’x36’ pad to provide the required parking as garages do not count toward
parking requirement.” (also need to make sure shared drive does not create block to
vehicles coming and going). Current drawing does not reflect the required driveway and
should be amended to show flexibility until further information is available.
3. Applicant will need to submit layouts for the proposed homes and driveways in order to
determine how the drive access will function and how far the joint access easements will
need to extend. This will need to be provided before Final Plat approval.
4. Identify critical lots with steep slopes with an asterisk and a add a plat note stating that a
site plan will be required.
5. Confirm with USPS what form of mail receptable will be allowed. If a kiosk is required,
provide a turnaround area with a minimum of 2 spaces accessible to the kiosk.
6. Rather than the typical easement diagram, note that those areas will be a PUDE in a plat
note.
7. Show the distance of the lot frontages and ensure that each lot will have 50’ minimum
width at the building setback line.
8. Add note stating that this will nullify any previous approvals for the property including the
approved site plan for Old Shackle Island Townhomes.
9. Add to note #14 the HOA shall maintain “open space and landscaping areas”.
10. Due to water line and sight distance conflicts, at a note stating that one canopy tree will be
provided in the front yards per lot, between the proposed homes and a minimum of 6’ from
the existing water line location. Open space will also need a minimum of 3 canopy trees.
11. Provide flares at driveway connections for easier access.

PRELIMINARY AND FINAL DEVELOPMENT PLANS:
21-008-001: ANDERSON HILL – PDP:
Grant Green summarized the Staff Report.
Cal Gentry, representative for Southeastern Building Corporation, addressed public comments
related to the development, including unit values, blasting, stormwater and runoff, cemetery
maintenance, and traffic through the adjacent subdivision. He also offered to design the
entrance onto Legends Drive as a forced left-turn only.
David Jenkins expressed concern about traffic along Anderson Lane and asked what kind of
road improvements would be required on Anderson Lane associated with the development.
Rick Mayo said the Public Works Department is in the process of conducting a signage study in
the Anderson Lane area to help slow traffic down, etc. The sight distance requirements would
need to be addressed at a later review. Sidewalks and curb and gutter would also be required
with the site plan.
Charles Lea expressed concerns about traffic, blasting, and drainage.
Vanessa Silkwood asked for more information on how stormwater would be managed.

Gentry said stormwater will be managed with two detention areas and berms on the lower
areas of the property.
Owen Hardcastle discussed the development’s proposed entrances.
Gentry said they are willing to pay payment-in-lieu fees to be used for Anderson Lane
improvements, but if it’s better to make some improvements on Anderson in front of the site,
they’d be happy to do that. They could also limit access on that entrance.
Lee Peterson asked if the cemetery requires special zoning.
Green said cemeteries are regulated by the State and don’t require separate zoning, but must
be protected and cannot be built upon.

Board of Mayor and Aldermen, with all staff comments as listed below. Motion withdrawn.

STAFF REPORT
The Developer is proposing a new Preliminary Development Plan (PDP) for Anderson Hill, with
44 multi-family units on 4.25 acres (10.35 units/acre), accessed from Legends Drive and
Anderson Lane. This PDP proposal includes a rezoning of the property to Multi-Family
Residential, Planned Development (MFR-PD). Currently, the property is zoned Suburban
Residential, Medium Density, Planned Development (SR-2 PD) and approved for 12 single-
family residential units (2.82 units/acre) that have not been constructed.

Proposed Anderson Hill Development (44 Units)
The proposed density is 10.35 units per acre, which is less than the maximum 15 units per acre
density requirements of MFR-PD. There are 94 parking spaces per the plan, 4 of which are
shown to be ADA compliant (88 spaces are required). The initial submittal included 43 units and
was redesigned drastically to meet staff comments with a much more functional layout, and
the resubmittal now includes 44 units. The Developer has stated that these units will not
include garages.
At Staff request, a playground area has been added as an
amenity, and dedicated parking to the community mailbox
kiosk has also been provided. Street trees are being shown
along the road frontages, and a 20’ buffer type B is shown
adjacent to single family homes (Vintage Knoll) and the two
properties to the southwest. A 10’ buffer Type C is labeled
along the multifamily development to the east (Deer Point).
The Applicant has stated the development will be 55%
Open Space, which would meet the 35% minimum
requirement; however, Staff has not determined what areas are considered in the 55% Open
Space calculation and how much of these areas would be considered as approved Open Space
by Planning Staff (see Staff Comment #4).

The elevations have been updated from the initial submittal to show brick as a significant
portion of the exteriors. The percentages of exterior materials used will need to be provided.
Two-thirds of all sides is required to be brick or stone for multi-family, and vinyl would not be
permitted. In addition, the rear of the units do not meet the required minimum percentage.
This could be shown for all units as one elevation or alternate the units and specify with a plan
sheet which buildings are specified by elevation.
At staff request, rear stoops and increased architectural features have been added to better
conform to design guideline requirements which require both horizontal and vertical
articulation.
CURRENT APPROVAL OF PROPERTY
The property is currently SR-2 PD and approved for 12 single-family home lots on a cul-de-sac,
with Open Space (2.82 units/acre). This 2008 approval was named the Enclave at Anderson
Lane, zoned R-15 PD at the time. The proposed Anderson Hill PDP would rezone the property to
MFR-PD and would be an increase of 32 dwelling units on the 4.25 acres.

SURROUNDING ZONING AND LAND USE
The properties to the north and west are zoned SR-2 (Suburban Residential). This development
is single-family residential. To the east, the property is zoned MXR (Mixed Residential), and the
use is primarily multi-family residential. To the south, the properties across Anderson Lane are
zoned SR-1 (Suburban Residential), and are single family homes.
The future land use outlined for the property in the 2009 City of Hendersonville Land Use and
Transportation Plan is Suburban Living. The Suburban Living Character Area supports multi-
family residential as a secondary use, corresponding with the requested MFR-PD zoning, and
thereby does not require an amendment to the Future Land Use Map. The adjacent multi-
family Deer Point development is zoned MXR and does not correspond with Suburban Living
but was existing prior to the adoption of the 2009 Land Use and Transportation Plan.

!!IMPORTANT!! The Planning Commission in its review and recommendation and the Board of
Mayor and Aldermen (BOMA) in its deliberations shall determine if the planned development is
in the public interest and make specific findings with regard to the following grounds for an
amendment to change the existing zoning classification:
a. The zone change amendment is in agreement with the Land Use Plan.
b. There will be no significant adverse effect upon adjoining property owners, unless
such effect can be justified by the overwhelming public good or welfare.
c. Conditions affecting the area have changed to a sufficient extent to warrant an
amendment to the area’s Land Use Plan, and subsequently, the Zoning Map.

zoned Industrial (I). The lot to the east is zoned Heavy Commercial Planned Development (HC-

This lot was rezoned in 2019 from Industrial to Heavy Commercial to accommodate the Baker
Roofing Company use.
Baker Roofing has erected approximately 520 linear feet of galvanized chain-link fence around
the rear part of their lot (see highlighted below). The fence was not shown on the approved Site
Plan. During a site inspection for the site construction, Planning staff informed the general
contractor that while the fence could be approved, it would have to be black or dark-green
vinyl coated fencing in order to comply with the City’s Zoning Ordinance, which does not permit
un-coated fencing in commercial zones. Rather than pull up the entire line of fencing, they are
requesting a waiver to allow them to keep the existing fencing. They are proposing that the
section of fencing and gate facing the street will be compliant with the requirement for vinyl-
coated fencing.
Baker Roofing has provided the attached photos showing the existing un-coated fencing on
their property. They have also provided photos of un-coated fencing on the lots surrounding
them. These lots are zoned Industrial, which allows for un-coated chainlink.

Tractor Supply is requesting to build an overhead canopy structure and greenhouse within the
existing outdoor sales area. Underneath a portion of the canopy, towards the rear of the
building, they are proposing to add an enclosed feed storage area. The image below shows the
proposed greenhouse and covered area hatched in red, and the enclosed feed storage area is

shown in light yellow. The dark green line shows the existing ornamental fencing and brick
columns (which are to remain). The existing building is shown shaded in blue. The building front
entry is at the bottom of the graphic.
The proposed canopy would be a rigid structure on steel support posts. The greenhouse roof
and walls would be covered with translucent polycarbonate panels, while the covered portion
that forms a leg off of the greenhouse would have metal roofing and EIFS gable ends facing
Centerpoint Road. The image below is of another Tractor Supply with a similar setup. The
difference between the photo and what is proposed for the Hendersonville location is that the
three gable ends towards the left side of the photo would be reduced to two, and would have
not metal but EIFS gable ends. The first two gable ends in the photo and the elevations below
show the polycarbonate panels that are proposed for this location. Also, the first and second
rows of steel supports closest to the front parking lot will be bricked from grade to ceiling
height. The remaining steel support poles will not be bricked.
