Internal Revenue Code Section 125 Flexible Spending Account Plan Amendment Recommended Action: Staff recommends that the City Council adopt Resolution No. 2014-004 and the Hesperia Water District Board adopt Resolution No. 2014-03, authorizing the City Manager to approve an amendment to the City’s Internal Revenue Code Section 125 Flexible Spending Account Plan to allow participants to carryover up to $500 of unused health Flexible Spending Account (FSA) funds from one plan year to the next, beginning in plan year 2013. In addition, staff recommends that the Council/Board authorize the City Manager to approve and implement future changes and amendments to the City’s Section 125 Flexible Spending Account Plan as necessary for any subsequent amendments to the Internal Revenue Code.
