Accept Construction of the Main Street Bridge Rehabilitation and FY 2013-14 Annual Street Improvement Projects (CO 7127 & 7128) Recommended Action: It is recommended that the City Council accept construction of the Main Street Bridge Rehabilitation and FY 2013-14 Annual Street Improvement projects constructed by Hardy and Harper, Inc., (Construction Order No. 7127 & 7128); authorize staff to record a "Notice of Completion" and release all withheld retention after 35 days from the date of recordation. Assignment of Water Rights from Lake Arrowhead Community Services District Recommended Action: It is recommended that the Board of Directors of the Hesperia Water District authorize the assignment of free production allowance water in the Alto Subarea from Lake Arrowhead Community Services District in the amount of $143,344. Annual Report on Status and Implementation of the General Plan Recommended Action: The Planning Commission recommends that the City Council review this annual report, and direct staff to transmit copies to the Governor's Office of Planning and Research, and the Department of Housing and Community Development as required by law. Contract for Fiscal Year 2014-15 Recommended Action: It is recommended that the Board of Directors of the Hesperia Water District City of Hesperia Page 4 Printed on 4/1/2015 City Council Meeting Agenda April 7, 2015 authorize the City Manager to increase the current contract with Badger Meter, Inc. in the not-to-exceed amount of $320,000 for the purchase of water meters and related water meter parts. WAIVE READING OF ORDINANCES Approve the reading by title of all ordinances and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. PUBLIC HEARING 8. Adoption of the City of Hesperia’s Five-Year Consolidated Plan (2015-2019), One-Year Action Plan (2015-2016), and Analysis of Impediments to Fair Housing Recommended Action: It is recommended that the City Council conduct a public hearing and upon accepting public testimony: (1) Adopt Resolution No. 2015-009 approving a) the City’s Five-Year Consolidated Plan (2015-2019), b) One-Year Action Plan (2015-2016) as recommended by the City Council Advisory Committee (CCAC) including any modifications or amendments thereto by the City Council, and c) Analysis of Impediments to Fair Housing; (2) Authorize staff to modify the Consolidated Plan, Action Plan and Analysis of Impediments to Fair Housing based upon the Council’s direction; and (3) Authorize the City Manager to execute and transmit all necessary documents, including the adopted Five-Year Consolidated Plan, One-Year Action Plan and Analysis of Impediments and any amendments, to assure the City’s timely receipt of CDBG funding. Prohibition of Commercial Medical Marijuana Cultivation Recommended Action: It is recommended that the City Council adopt Urgency Ordinance No . 2015-02, prohibiting the commercial cultivation of marijuana within nonresidential land use designations or zones in the City of Hesperia, making findings pursuant to Government Code Section 65858(a) and declaring the urgency thereof.
