Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes September 24, 2019 7:30 p.m. The Public Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal Building at 333 Warren Avenue, Ho-Ho-Kus, NJ on September 24, 2019. The meeting was called to order at 7:30 p.m. by Mayor Randall who asked the Municipal Clerk to read the open a public meeting statement: The Public Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”. Notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Record and the Ridgewood News. FLAG SALUTE: Mayor Randall led those present in the salute to the American Flag. APPROVAL OF MINUTES A motion was offered by Councilman Shell, seconded by Councilman Rorty to approve the minutes of August 20, 2019 – Closed and Combined Meeting of the Mayor and Council. Motion carried on a roll call vote – all present voting “Ayes. PUBLIC DISCUSSION Mayor opened the meeting to the public. He stated if anyone desired to be heard, please raise your and to be recognized, come forward to the microphone and state your name and address for the record. Seeing none, the Mayor closed the meeting to the public. ADMINISTRATOR’S REPORT Administrator reported on the following; Old Business Library – The Library Board will be meeting with the Mayor and Council in executive session at the October 15th, 2019 work session meeting. 1-9 East Franklin Turnpike Issues – No updates DOT Train Station - No updates 124 Elmwood (Stone Wall in ROW) – Borough Attorney emailed the resident advising them the he is not required to name the Borough as an additional insured on his home owner’s policy as it is cover under Jif. However, he advised him he is still required to sign the Hold Harmless Agreement. 598 Cliff Street, Ridgewood (Widen of Driveway in ROW) – Owners filed all the necessary paperwork and paid the 1 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes September 24, 2019 7:30 p.m. escrow fees that were required. New Business Garbage/Solid Waste/Recycling – we are currently out to bid for this contract. There will be a pre-bid conference held on October 1, 2019 at 2pm in the Council Chambers. Bid opening scheduled for November 12, 2019 at 10am. Shred Day – Scheduled for October 5th, 2019 from 9am – 1pm for residents only. Richard’s Run – Scheduled for October 6th, 2019 starting at 8am. Firehouse Open house – Scheduled for October 13h, 2019 from 1-4pm. Curfews – Administrator will be putting out notices regarding curfews on October 30 & 31, 2019. CORRESPONDENCE a) Board of Chosen Freeholds Event on Tuesday, October 1, 2019 for 10 Years of Preventing & Ending Homelessness. b) MEL’s Annual local official training class at the League - Wednesday November 20th. c) Letter from BC Community Development notifying the Borough that the application period to received FY 2020-2021 funding will begin on Monday, September 23, 2019. d) Northwest BC Utilities Authority Special Meeting October 15, 2019 at 7pm to introduce the budget for the fiscal year 2020. e) Tinton Fall Resolution – To urge voter to support the referendum of the election ballot in November, so that veterans or windowed spouses of veterans who reside in continuing care retirement communities (CCRC) will be eligible for property tax deduction. ADOPTION OF ORDINANCES and PUBLIC HEARING ORDINANCE 2019-26 AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 79 OF THE CODE OF HO-HO-KUS ENTITLED VEHICLES AND TRAFFIC BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen, State of New Jersey, that pursuant to Code Section 79-5, Schedule VI is hereby amended and supplemented as follows: Section I Schedule VI The following described intersection is hereby designated as a Stop Intersection: Intersection Stop Sign On Cliff Street and First Street Cliff Street All other provisions of Schedule VI not amended herein, remain in full force and effect. Section II – Severability. If any portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered. Section III – Repealer. All other provisions of this chapter which are not affected by this ordinance are hereby ratified and confirmed and shall remain in full force and effect. However, all ordinances or parts of ordinances which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Section IV – Effective Date. This ordinance shall take effect upon passage and publication as required by law. 2 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes September 24, 2019 7:30 p.m. PUBLIC HEARING Mayor opened the meeting to the public. He stated this is the time and place for the public hearing on Ordinance #2019-26 and all persons who wishes to be heard, please state your name and address before making your statement. Seeing none, the Mayor closed the meeting to the public. A motion was offered by Councilman Rorty and seconded by Councilman Crossley to adopt Ordinance #2019-26. Motion carried on a roll call vote – All present voting “Aye”. INTRODUCTION OF ORDINANCES ORDINANCE 2019-27 AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 79 OF THE CODE OF THE BOROUGH OF HO-HO-KUS ENTITLED VEHICLES AND TRAFFIC BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen, State of New Jersey, that Chapter 79 of the Code is hereby amended and supplemented as follows: Article V Emergency No Parking 79-37 – Emergency No Parking. Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary emergency no-parking signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of said emergency no-parking signs when weather conditions, accidents, fires, roadwork, paving, leaf removal or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the emergency no-parking signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs. 79-38 - Violations and Penalties. Unless another fine is expressly provided for by the New Jersey statutes, every person convicted of a violation of a provision of this Article or any supplement thereto shall be liable for a fine of not more than $60.00 or imprisonment for a term not exceeding 15 days, or both. Severability. Resolution #19-89 – Introduced and read by Council President Troast A Resolution - Accept and Comply Audit findings for 2018 WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and WHEREAS, the Annual Report of Audit for the year 2018 has been filed by a Registered Municipal Accountant with the Municipal Clerk pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body; and, WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and, WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all 7 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes September 24, 2019 7:30 p.m. members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Comments and Recommendations, and; WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “Comments and Recommendations, as evidenced by the group affidavit form of the governing body attached hereto; and; WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and; WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board, and; WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to with: R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office. WHEREAS, the Borough of Ho-Ho-Kus Mayor and Council has the need to engage the services of an engineering consultant for the Hollows at Ho-Ho-Kus project, to provide engineering services which are vital and necessary for the operation; and WHEREAS, the Mayor and Council is required to comply with the New Jersey Local Unit Pay-to-Play Law, N.J. S.A. 19:44-20.5 et seq. LIAISON REPORTS Recreation – Councilman Iannelli absent – no report Library – Councilman Policastro reiterated with Administrator Jones stated, Library Board will be attending the Mayor and Council meeting in executive session on October 15th, 2019. Board of Education – Councilman Policastro stated he will be attending a Stigma Fee meeting at the public school September 25, 2019. Will be meeting with the school board in the next few months at which time he will have a report. Ambulance Corp. – Council Crossley had no report as the next meeting for the Ambulance Corp is next week. However, he wanted to thank all the volunteers for all their hard work and dedication. Fire Department – Councilman Rorty report this past weekend was the Fireman Convention in Wildwood and they had a good attendance. Chamber of Commerce – Councilman Shell reported September is Turn the Towns Teal month which creates awareness of Ovarian Cancer. MAYOR'S REMARKS – no report John Hanlon, Chair of the Planning Board Mr. Hanlon updated the Mayor and Council of the Master Plan asking them to review and email the Planning Board Secretary with any comments/changes they feel is necessary as they need their assistance moving forward. He stated they are going to be adding a new element which is going to part of the flood zone. We are going to do a layout for the residents to learn and understand the flood area. He also advised them of the possible traffic/ parking problems that may occur with the traffic pattern changes of HHK Hills as all the traffic will be coming down First Street as well as the new developments that are coming into the town. OFF-CONSENT RESOLUTION Resolution #19-97 – Introduced and read by Council President Troast A Resolution – Approving Employee Salary Adjustment WHEREAS, the Mayor and Council of the Borough of Ho-Ho-Kus has determined that a salary adjustment for Administrator, William Jones is appropriate; and WHEREAS, the Mayor and Council has approved a 10% increase for Ho-Ho-Kus Borough Administrator, William Jones at a salary of $135,771.00; and NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Ho-Ho-Kus hereby approve the salary adjustments for Ho-Ho-Kus Borough Administrator, William Jones. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Payroll Supervisor. A motion was offered by Council President Troast and seconded by Councilman Crossley to approve Resolutions 19- 97.
