The Regular City Commission Meeting of the City of Hollywood, Florida, was called to order by Mayor Levy on Wednesday, May 18, 2022 at 1:09 PM in the City Commission Room, Room 219, 2600 Hollywood Blvd., Hollywood, Florida. 1. Moment of Silence The Commission announced the passing of Barry Faske and expressed their condolences. 2. Pledge of Allegiance 3. Recognition of Veterans, Active Service Personnel & Their Families 4. Roll Call Present: Vice Mayor Caryl Shuham, Commissioner Linda Anderson, Commissioner Traci Callari, Commissioner Adam Gruber, Commissioner Kevin D. R-2022-130 A Resolution Of The City Commission Of The City Of Hollywood, Florida, Approving And Authorizing The Appropriate City Officials To Execute A Blanket Purchase Agreement With All Paving, Inc. For Paving Construction Services Of Parking Lots And Park Roads At Dowdy Sports Field, A General Obligation Bond Project, In An Amount Not To Exceed $46,110.00, Based On Palm Beach County’s Bid For Project No. 2020055 In Accordance With Section 38.41(C)(5) Of The Procurement Code (“Piggyback”). R-2022-131 A Resolution Of The City Commission Of The City Of Hollywood, Florida, City of Hollywood Page 1 Regular City Commission Meeting Meeting Minutes May 18, 2022 Authorizing The Appropriate City Officials To Execute The Attached Amended And Restated 401(A) Pre-Approved Plan And The 457(B) Deferred Compensation Plan Between Nationwide Retirement Solutions, Inc. And The City Of Hollywood. ACTION: This Resolution was moved by Commissioner Callari, which was seconded by Commissioner Biederman, and adopted on the Consent Agenda. The motion passed unanimously. R-2022-133 A Resolution Of The City Commission Of The City Of Hollywood, Florida, Approving And Authorizing The Appropriate City Officials To Execute An Agreement With The Highest Ranked Firm, Wells Fargo Bank, N.A., For Banking Services For A Term Of Six Years With Three Two-Year Renewal Periods For An Estimated Annual Amount Of $95,000.00. R-2022-135 A Resolution Of The City Commission Of The City Of Hollywood, Florida, Approving And Authorizing The Appropriate City Officials To Terminate The Property Access Agreement With Walgreen Co. And To Execute A Property Access Agreement With Limestone WGFL LLC For The Purpose Of Installing, Operating And Maintaining The City’s Communication Equipment For Its CCTV Project. ACTION: The City Manager withdrew the Resolution from consideration. Enactment No: O-2022-12 11. P-2022-29 Presentation Of The Seven Seals Award To The City Of Hollywood By The Dept. Of Defense/Employer Support Of The Guard Reserve (ESGR). Peter Caspari, Director Employer Outreach Guard Reserve, and Victor Olshansky, Civilian Aide to the Secretary of the Army, presented the seven seals award to the City Commission for their support of The Department of Defense / Employer Support of the Guard Reserve (ESGR). 12. P-2022-30 A Proclamation In Recognition Of Asian American and Pacific Islander Heritage Month, May 2022. Commissioner Biederman read the proclamation in recognition of Asian American and Pacific Islander Heritage Month, May 2022. Ty Javellana and Yoshiko Carlton accepted the proclamation and thanked the Commission for the recognition. 13. P-2022-31 A Proclamation In Recognition Of Mental Health Awareness Month, May 2022. Commissioner Callari read the proclamation in recognition of Mental Health Awareness Month, May 2022. P-2022-32 A Proclamation in Recognition Of National Beach Safety Week, May 23- 30, 2022. Vice Mayor Shuham read the proclamation in recognition of National Beach Safety Week, May 23-30, 2022. Rona Tratchenberg, U.S. Coast Guard Auxiliary, accepted the proclamation and thanked the Commission for the recognition. 16. P-2022-34 A Proclamation in Recognition of Historic Preservation Month, May 2022. Commissioner Sherwood left the meeting at 1:51 PM. P-2022-35 Presentation By Leslie Del Monte, Planning Manager, In Honor Of The 2022 Historic Preservation Award Recipients. Leslie Del Monte, Planning Manager, introduced the item. Terry Cantrell and Steve Toth, Historic Preservation Board members, presented awards to the various recipients. Commissioner Sherwood returned to the meeting at 2:04 PM. 18. P-2022-36 Presentation By Gray Robinson On The 2022 State Of Florida Legislative Session. Joseph Salzverg, Gray Robinson, provided a presentation on the legislative session. Mayor Levy passed the gavel to Vice Mayor Shuham and left the meeting at 2:21 PM, he returned at 2:23 PM. Discussion ensued among Mr. Salzverg and members of the Commission. 19. PO-2022-10 An Ordinance Of The City Of Hollywood, Florida, Amending Chapter 98 Of The Code Of Ordinances Entitled “Marine And Waterway Regulations; Boats And Other Vessels” To Allow The City Manager To Approve Boat Dock Lease Agreement Terms And Conditions And To Further Authorize City of Hollywood Page 4 Regular City Commission Meeting Meeting Minutes May 18, 2022 The City Manager Or Designee To Grant All Approvals And Renewals Of Boat Dock Lease Agreements. The Mayor announced the ordinance was advertised in conformance with Florida Statutes and City Codes. The public hearing was opened; there being no one present who wished to speak, the public hearing was declared closed. The City Clerk read the ordinance title on second and final reading. ACTION: Motion was made by Commissioner Callari, which was seconded by Commissioner Sherwood, to adopt on second and final reading the Ordinance. R-2022-136 A Resolution Of The City Commission Of The City Of Hollywood, Florida, Authorizing The Appropriate City Officials To Accept, If Awarded, 2021 Hazard Mitigation Grant Program Funds In The Amount Of $2,784,441.00 For The Sanitary Sewer Lift Stations Project; Authorizing Appropriate City Officials To Execute All Applicable Grant Documents And Agreements; Amending The Fiscal Year 2022 Operating Budget and Capital Improvement Plan. Vivek Galav, Director of Public Utilities, explained the intent of the resolution. ACTION: Motion was made by Commissioner Callari, which was seconded by Vice Mayor Shuham, to adopt the Resolution. On a voice vote the motion passed unanimously. (7-0) 22. P-2022-37 Presentation By Andria Wingett, Assistant Director Of Development Services, and Granicus, Regarding The Granicus Short Term Rental Software Progress Update. Andria Wingett, Assistant Director of Development Services, gave a presentation on the item. Graeme Dempster, Granicus Solutions, gave a presentation on how the program works. Extensive discussion ensued among staff, Mr. Dempster and members of the Commission. Commissioner Callari left the meeting at 3:58 PM and returned at 4:03 PM. Douglas Gonzales, City Attorney, responded to concerns raised by the Commission. Discussion ensued among staff, Mr. Dempster and members of the Commission. Shiv Newaldass, Director of Development Services, provided additional information. Discussion ensued among staff and members of the Commission. Rolando Rodriguez, Code Compliance Officer, provided additional information. Commissioner Biederman left the meeting at 4:18 PM and returned at 4:20 PM. Vice Mayor Shuham, District 1 Leadership Hollywood Vice Mayor Shuham congratulated Leadership Hollywood Class of 45 for their leadership projects: Spark, Natural Planting at the Chamber and All In Day at the Beach. Becker Family Vice Mayor Shuham congratulated the Becker Family in receiving their historical plaque for their house on Tyler Street. Fred Lippman Multipurpose Center Vice Mayor Shuham announced this Thursday, from 3:00 PM to 5:00 PM, there will be a Metropolitan Planning Organization (MPO) opportunity with the State to do a walk through audit at the Fred Lippman Multipurpose Center to consider the site for Broward Light Rail. Vice Mayor Shuham stated she will be out of town but hopes to hear great things from the City of Hollywood Page 6 Regular City Commission Meeting Meeting Minutes May 18, 2022 event when she returns. Condo Safety Vice Mayor Shuham thanked Alison Saffold, Civic Affairs Administrator, for the Tuesday Night Report. Vice Mayor Shuham requested that the City look at our ordinances for condo safety since the State took no action on it. She does not want to wait for other agencies and to have staff work on a plan to improve what the County is currently doing. Inspection Requirement Vice Mayor Shuham requested Commission support for staff to come back with a pre sale inspection requirement for every house sold in the City. This will help the City with respect to unpermitted improvements and the influx of illegal vacation rentals. Mayor Levy stated he has concerns on liability issues and the hardships on innocent homeowners, as well as the City employees who would have to research all the permits on a house and the workload. Mayor Levy stated upon his own research, he found there were about 3,600 transactions in the City, with about 17 certifications a day. Dr. Wazir Ishmael, City Manager, stated some of the reasons that the Mayor listed are issues as to why this type of research has not been done before. He also warned that in older communities like the City, you will find lots of unpermitted work done over the years. Commissioner Callari stated she has concerns with this item based on proposed hardships to the homeowner, when they are trying to sell. Vice Mayor Shuham and Commissioner Biederman both agreed that having a program of this nature can absolutely stifle investors from making unpermitted work. Vice Mayor Shuham, Commissioner Biederman and Commissioner Anderson supported a discussion on the issue. 25. Commissioner Anderson, District 2 Firefighter Orientation Commissioner Anderson thanked everyone involved in the firefighters orientation held last night, another orientation will be held in the near future. 26. Commissioner Callari, District 3 City of Hollywood Page 7 Regular City Commission Meeting Meeting Minutes May 18, 2022 Barry Faske Commissioner Callari thanked Mayor Levy and staff for their sympathy on the recent passing of Barry Faske, it is a huge loss for the City, and she requested that everyone keep his family in their prayers. Human Life Commissioner Callari spoke about current events and the lack of respect for human life, with regards to the mass shootings that have recently occurred. Commissioner Callari encouraged everyone to be kind and respectful to one another. Broward League of Cities Commissioner Callari thanked the Broward League of Cities for their gala held at Margaritaville Hotel and Resort. Over 410 participants came to our great City and congratulations to Adam Reichbach, Assistant City Manager for Finance and Administration, on receiving his award for the Cares Act funding. 1818 Velm The Old Great Southern Building Tour Commissioner Callari stated today she toured 1818 Velm, the old Great Southern building, and it was beautiful. Positivity In Life Commissioner Callari stated everyone needs to find the positivity in life, when she was driving around to address complaints she received she watched two people pickup up trash with a claw picker and garbage can on Taft Street. When she spoke with them, they stated it was their daily exercise and how they take care of their community. Everyone needs to focus on the good. 27. Commissioner Gruber, District 4 Broward League of Cities Commissioner Gruber congratulated Adam Reichbach, Assistant City Manager for Finance and Administration, on receiving his award for the Cares Act funding from the Broward League of Cities. 1818 Velm The Old Great Southern Building Tour Commissioner Gruber stated he also toured 1818 Velm, the old Great Southern building, and it was impressive. Stirling Road Landscaping Commissioner Gruber requested staff to get back to him on the Stirling Road landscaping status, on what is coming and when, so that he can let the residents know. City of Hollywood Page 8 Regular City Commission Meeting Meeting Minutes May 18, 2022 46th Avenue Wall Commissioner Gruber thanked staff for getting back to him quickly and he understands the 46th Avenue wall project was delayed about six months. Commissioner Gruber stated he just wants to have an idea on some interim solutions. 28. Commissioner Biederman, District 5 70th Avenue and 70th Terrace Clean Up Commissioner Biederman thanked the Boy Scout Troop 118, Driftwood Civic Association and Arthur Codrington, Youth Ambassador, for helping to clean up 70th Avenue and 70th Terrace. All In Beach Day Commissioner Biederman stated the All In Beach Day was an amazing event with over 35 physically challenged participants that were able to get into the ocean. Memorial Day Celebration Commissioner Biederman announced the Memorial Day celebration on Sunday, May 29th from 6:00 PM to 8:30 PM at Boulevard Heights Community Center. Commissioner Biederman invited everyone to come help support the Silver Wings Band and memorialize the Fallen Soldiers and First Responders. 29. Commissioner Sherwood, District 6 Block 40 Commissioner Sherwood thanked the Department of Information Technology for making arrangements for her and Commissioner Anderson to provide a virtual view of Block 40. She believes Joseph Young would be proud of this building. Tuesday Night Report Commissioner Sherwood thanked Alison Saffold, Civic Affairs Administrator, for starting up the Tuesday Night Report at their request . She stated she finally received an answer to her request of the old Bank of America building, which will be redeveloped to an Auto Zone. Condos Inspection Commissioner Sherwood stated the Condo’s are having problems with the 40 and 50 year condo inspections which are used to help keep buildings safe. However, this is stressing the smaller condos, where the residents live on a fixed income. Commissioner Sherwood stated she City of Hollywood Page 9 Regular City Commission Meeting Meeting Minutes May 18, 2022 would like staff to come up with ideas on grants that can be received. Happy Memorial Day Commissioner Sherwood wished everyone a Happy Memorial Day. 30. Mayor Levy Leadership Hollywood Mayor Levy congratulated Leadership Hollywood for the All In Beach Day event. Unfortunately, he was not able to attend, however he viewed the photos and saw the Leadership Hollywood group was super enthusiastic and determined to make this an annual event. Chamber Planning Event Mayor Levy stated he attended the Chamber Planning event and it was very nice. Rotary Club Auction Mayor Levy stated the Rotary Auction took place, and all proceeds raised went towards scholarships for Hollywood residents. There are a lot of civic associations and other organizations within the next few weeks who will also be giving out scholarships. Housing Affordability Summit Mayor Levy stated he attended the Housing Affordability Summit, along with Raelin Storey, Director of Communications, Marketing & Economic Development. Hollywood is doing a lot with regards to affordable housing, and the County is talking about dedicating a lot more dollars to this initiative. Fallen Officers Memorial Service Mayor Levy stated the Hollywood Police Department Fallen Officers Memorial was very honorable for those that we lost. Masonic Lodge Mayor Levy thanked Ray Faulkerson for the food drive that took place at the Masonic Lodge. Grape Stars Memorial Mayor Levy thanked the Counsel General of Canada, Susan Harper, for attending the Grape Stars memorial at the bandshell to honor Canadian driver Gilles Villeneuve. The event was very nice, and shared across media in Canada about Hollywood joining the Canadian community in honoring his memory. City of Hollywood Page 10 Regular City Commission Meeting Meeting Minutes May 18, 2022 Israeli Independence Day Mayor Levy thanked the organizers for the Israeli Independence Day Celebration at ArtsPark on Mother’s Day. School Visitation Mayor Levy stated he visited a religious school in North Miami, and tomorrow he will speak at Career Day at Orangebrook Elementary School, and he is looking forward to this as these are fun events for an elected official. Traffic Calming Initiatives Mayor Levy requested that Jose Cortes, Director of Design and Construction Management, include in the Tuesday report, an update on the traffic calming initiatives as part of the General Obligation Bond (GOB). 31. City Attorney Executive Session Douglas Gonzales, City Attorney, announced pursuant to Florida Statutes 286.011(8)(a), an executive session would be held on Wednesday, June 8, 2022 at 2:30 PM in the West Construction v. City of Hollywood litigation. Attending the session will be the Mayor, Commissioners, City Manager, City Attorney and Chief Litigation Counsel John Wien, and outside Counsel Victor Sanabria and Joseph T. Maria. 32. City Manager National Police Offices Memorial Day Dr. Wazir Ishmael, City Manager, stated the Police Chief, the Police command staff, along with Commissioner Anderson were in Washington, D.C. taking part in the National Police Officers Memorial Day events to recognize fallen officers. Sheridan Street Bridge Closure Dr. Wazir Ishmael, City Manager, stated the Florida Department of Transportation (FDOT) project for the Sheridan Street bridge closure on Intracoastal waterway will begin on Monday, June 13, 2022 and last for 90 days and there will be a number of improvements associated with the project. COVID And Testing Dr. Wazir Ishmael, City Manager, stated the COVID numbers are going up again. He reminded everyone that Oak Lake Park is still in operation providing COVID testing.
