57 MINUTES OF PRE -COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, DECEMBER 19, 2023 The City Council of the City of Hueytown, Alabama, met at 5: 30P. M. in the Council Chamber meeting room at the City of Hueytown, City Hall, on Tuesday, December 19, 2023. President Wright called the meeting to order with Council Members Zinnerman, Pickens, Hurliman and Jacks present. Mayor Stephen Ware and City Attorney, Charlie Waldrep, of Waldrep Stewart 8a Kendrick, LLP were also present. There were five individuals in the audience. The purpose of the meeting was to discuss general municipal business and review the City Council Meeting Agenda. MINUTES OF CITY COUNCIL MEETING CITY OF HUEYTOWN, ALABAMA TUESDAY, DECEMBER 19, 2023 A regular meeting of the City Council of the City of Hueytown, Alabama, was held in the Council Chamber meeting room at the Hueytown City Hall on Tuesday, December 19, 2023. 1. CALL TO ORDER: The meeting was called to order by Council President Wright at 6: 01P. M. with approximately thirty- one individuals present in the audience. 2. INVOCATION: The invocation was given by Council Member Pickens. 3. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was lead by Council Member Jacks. 4. ROLL CALL Upon Roll Call, Council Members Wright, Zinnerman, Pickens, Hurliman and Jacks being present. Mayor Stephen Ware was Present. City Attorney Charlie Waldrep of Waldrep Stewart and Kendrick, LLP was absent. 5. MEDIA RECOGNITION: Kailah Hegler from the Western Star was identified at the meeting. 6. APPROVAL OF MINUTES Council Member Pickens made a motion followed by a second to the motion by Council Member Jacks to approve the December 12, 2023 Pre -Council and Council Meeting minutes as previously received and thereby dispensing with reading of the minutes. Upon roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. President Wright declared the minutes approved. 7. ADOPT AGENDA FOR THE MEETING: Council Member Pickens made a motion to adopt the meeting agenda as published followed by a second to the motion by Council Member Hurliman. President Wright declared the meeting agenda adopted. 8. MAYORS REPORT The Mayor welcomed everyone present for taking time from their schedule to attend the Council Meeting. Mayor thanks the Police, Fire and Public Works Departments and to all others who put forth efforts to make the recent Events possible leading into the Holiday Season. The Mayor states this is the last Council Meeting for 2023 and wishes everyone a Merry Christmas. The Mayor recognized Public Works Director, Mike Butts who has served the City for thirty years of service and is retiring. The Mayor presented a plaque to Mike which recognized Mike' s commitment to servicing the Citizens of the City. 9. STANDING COMMITTEE REPORTS a) Finance Committee: Council Member Zinnerman, no report. b) Planning and Development Committee: Council Member Pickens, no report. c) Public Safety Committee: Council Member Hurliman, no report. d) Public Works and Parks Committee: Council Member Jacks, honors Mike Butts for his leadership in the City' s Public Works Department. 10. OFFICERS REPORT a) Police Department: Chief Yarbrough - states there has been one arrest with the possibility of another related to a homicide which occurred in the City a couple months past. b) Fire Department: Chief Sullivan - no report. c) Public Works/ Street and Parks Department: Director Butts - no report. d) Building and Zoning Department: Inspector Humphries - no report. 11. GREAT THINGS HAPPENING IN HUEYTOWN a) Hueytown Chamber of Commerce, Debbie Kiker Reports: i. The Christmas Storefront decorating contest was fun and festive with the business winner being the TeriDonna School of Dance and the Church winner being the North Highlands Baptist Church. ii. The Chamber' s Scholarship/ Sponsorship donors program is underway for 2023- 2024. Early thank yous to the Black Family Restaurants, Charlie Waldrep Firm, Teresa Hester and L& L American. iii. The Chamber presented a check of $ 7, 000. 00 which are the proceeds from the Breast Cancer awareness event, to the Baptist Health Foundation. The check was accepted by Ms. Thea Benson, Board Coordinator of the Baptist Health Foundation. iv. Upcoming event in 2024 are Munch and Mingle, Career/ Job Fair, Women Business Owners, Cash Mob and a Possible Spring Market. v. Thanks Mike Butts for all he has done for the Chamber. vi. Planning continues with ticket sales for the special event of Sean Dietrich being scheduled to perform on April 13, 2024 at the North Highlands Baptist Church. ii. Presented a check to the Neighborhood Bridges over $ 2, 300. 00 as proceeds from the recent Gospel Fest event. ii. Thanks Mike Butts for all he has done for the Arts Council. 12. CORRESPONDENCE a) A Public Notice regarding Pipeline Safety was received and distributed to the Mayor and Council. 13. BILLS FOR APPROVAL Council Member Zinnerman presented a list of bills totaling $ 489, 719. 69 and made a motion to approve the list of bills which were presented for payment followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. There were no nay votes. The motion carried unanimously. RESOLUTIONS: a) Resolution 6717 Resolution 6717 was presented to the City Council to confirm the report of costs and create a Public Nuisance Lien on the property located at 209 Tyree Street, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6717 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. b) Resolution 6718 Resolution 6718 was presented to the City Council to confirm the report of costs and create a Public Nuisance Lien on the property located at 632 Sunrise Boulevard, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6718 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. c) Resolution 6719 Resolution 6719 was presented to the City Council to confirm the report of costs and create a Public Nuisance Lien on the property located at 1101 25`h Avenue North, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6719 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. d) Resolution 6720 December 19, 2023 City Council Meeting Minutes Page 3 Of 5 1 Resolution 6720 was presented to the City Council to confirm the report of costs and create a Public Nuisance Lien on the property located at 1412 26t' Avenue North, Hueytown. A motion by Council Member Zinnerman was made to adopt Resolution Number 6720 followed by a second to the motion by Council Member Jacks. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. e) Resolution 6721 Resolution 6721 was presented to the City Council to declare a Public Nuisance and to order the abatement of weeds, trash and/ or inoperable vehicle for the property located at 131 Patricia Street, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6721 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. f) Resolution 6722 Resolution 6722 was presented to the City Council to authorize a Postage Meter Machine Lease agreement. A motion by Council Member Zinnerman was made to adopt Resolution Number 6722 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. g) Resolution 6723 Resolution 6723 was presented to the City Council to declare a Public Nuisance of an unsafe structure located at the property of 98 Wheeler Drive, Hueytown. A motion by Council Member Pickens was made to adopt Resolution Number 6723 followed by a second to the motion by Council Member Hurliman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. h) Resolution 6724 Resolution 6724 was presented to the City Council to release the security funds due to the completion of sectors twelve and thirteen of the Westwind Subdivision. A motion by Council Member Jacks was made to adopt Resolution Number 6724 followed by a second to the motion by Council Member Zinnerman. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. i) Resolution 6725 Resolution 6725 was presented to the City Council to authorize the License Agreement with Alabama Renewable Resources, LLC which is the location where the Hueytown Police Department firing range is located. A motion by Council Member Hurliman was made to adopt Resolution Number 6725 followed by a second to the motion by Council Member Pickens. Upon a roll call vote, President Wright and Council Members Zinnerman, Pickens, Hurliman and Jacks voting yes. The motion carried unanimously. 15. ORDINANCES: a) There were no Ordinances To Consider. EXTEND THE FLOOR TO THE PUBLIC Prior to the extension of the floor to the public, President Wright reminds everyone wishing to address the Council to state their name and address; must be a resident of Hueytown to speak and shall limit comments to three minutes. a) No one present addressed the Mayor and Council. 17. ADJOURNMENT With no further business to come before the Council Meeting, Council Member Pickens made a motion to adjourn. Council President Wright declared the meeting adjourned at 6: 37P. M..
