COMMON COUNCIL COUNCIL CHAMBERS-CITY HALL SEPTEMBER 15, 2020 -7:00 P.M. Public Hearing- 2021 Budget The public hearing for the 2021 budget was held and no comments were given. Public Hearing- Annexation Attorney Doug Atz presented the Clerk Treasurer, Katie Ritchie, with proof of publication of the public hearing for the annexation. Gary Gatman from the Noble County EDC came forward and stated that this is a big deal for Kendallville and Noble County because the City needs workers and these workers need homes. Kristen Johnson, Chamber of Commerce Director, stated that people call the Chamber looking for housing continuously and are resorting to rentals because the market is so thin. Brian Lietch- ENSC stated that the land was originally intended to either be a soccer field for the high-school or either a potential property for the East Noble Middle School. Since the high-school put in a turf football field and the new middle school was built on Drake Road this property is obsolete to its intended purpose. Brad Griffith and Jamie Lancia- Springmill Woods Development LLC. approached the Council and gave them a brochure of floor plans of houses that would go into the area. Mr. Lancia stated that 72 lots will go in the 35 acre area with homes ranging from 1200-2000 square feet and will consist of single family homes with a possibility of retirement homes possibly going on the south side in the future depending on the need of living situations in the City at that point. The Common Council of the City of Kendallville met in regular session Tuesday September 15, 2020 at 7: 15 P.M. Roll call was answered by: Mayor SuzAnne Handshoe, Council Member Regan Ford, Council Member Corey Boese, Council Member Jim Dazey, Attorney Doug Atz, Council Member Steven Clouse, Council Member Amy Ballard. MY AC Member Kyle Blackbum was absent. Others present were: Andy Barrand- KPC News, Lance Waters, Katie Ritchie, Jeremy McKinley, Scott Derby, Kristen Johnson, Ann Linson- ENSC Superintendent, Jamie Lancia- Lancia Homes, Dan Diggons, Brian Lietch - ENSC, Brad Griffith, Gary Gatman- NCEDE, Pam Lash, Deborah Thorton, and Terry Longsworth. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited by all in attendance. MINUTES/ MEETING Minutes from the September I, 2020 Common Council meeting were presented for review. Council Member Steven Clouse made a motion to approve with a second from Council Member Jim Dazey. The motion passed 5 ayes - 0 nays. PETITIONS OR COMMENTS Pam Lash- I 00 I Moyer Street, approached the Council and informed them about a prayer event that is taking place on Saturday September 26, 2020 at the downtown Community Center in Kendallville from 1:00 P.M. to 3:00 P.M. Ms. Lash encouraged Council to come and request prayer for our Country. Social distancing guidelines will be followed at this event. MAYOR The August Humane Society report was presented for review. The August Aviation minutes were presented for review. Mayor, SuzAnne Handshoe, announced that the upcoming curb side clean up days will take place Saturday September 19th and September 26th Mitchell Street and north will take place on the 19th and south of Mitchell Street would take place on the 26th. Mayor Handshoe also announced that the Kendallville Public Library is holding a drop off for a variety of electronics on Thursday September 17th and Saturday September 19th that is open to the community. Jim Dazey made a motion to approve Kendallville's Trick or Treating to take place on Saturday October 31, 2020 from 5 :00 P.M. to 7:00 P.M. with a second from Council Member Steven Clouse. The motion passed 5 ayes – 0 nays. CITY ATTORNEY Resolution # 1068- Annexation of Real Estate on South Sherman Street Council Member Jim Dazey requested the reading of Resolution #1068 in its entirety. Attorney Doug Atz read Resolution #1068 in its entirety. Council Member Jim Dazey made a motion to approve with a second from Council Member Regan Ford. Council Member Steven Clouse mentioned that since the petition has been filed the title has been changed from East Noble School Corporation to Springmill Woods Development LLC. Attorney Doug Atz stated that at the time the petition was filed that ENSC was the owner. Council Member Steven Clouse mentioned that the Resolution stated that a crosswalk across Sherman would be established between the City and the Petitioner within three years of annexation and wanted clarification on who is helping take on responsibility of maintaining the crosswalk, and who the Petitioner is or should be. Brian Lietch- ENSC, said that East Noble School Corporation would work with the City and share expenses to establish a pedestrian/school crosswalk across Sherman Street to enable children to get to the elementary school or bus stop. As to the issue of who is petitioning for the annexation, as ENSC was the owner and therefore the Petitioner when the petition for annexation was originally filed, but that after the petition was filed, the land for annexation was transferred to Springmill Woods Development, LLC, in order to be clear who is requesting the annexation, Jamie Lancia of Springmill Woods Development LLC verbally requested that it be shown on the record that Springmill Woods Development LLC is joining the petition for annexation with ENSC, and is consenting to and petitioning the City to have the property it now owns be annexed to the City of Kendallville. The motion passed 5 ayes - 0 nays. POLICE The August Police Report was presented for review. OLD BUSINESS Special Ordinance #1569/ 2021 Budget- 2nd Reading Council Member Jim Dazey requested the reading of Special Ordinance# 1569 in its entirety. Attorney Doug Atz read Special Ordinance# 1569 in its entirety. Council Member Jim Dazey made a motion to approve with a second from Council Member Amy Ballard. The motion passed 2 ayes - 0 nays. General Ordinance #1224/Amend #665 One Way Streets- 2nd Reading Council Member Jim Dazey requested the reading of General Ordiance #1224 in its entirety. Attorney Doug Atz read General Ordinance #1224 in its entirety. Council Member Jim Dazey made a motion to approve with a second from Council Member Corey Boese. The motion passed 5 ayes - 0 nays. Attorney Doug Atz read General Ordinance #1225 in title only. Council Member Jim Dazey made a motion to approve with a second from Council Member Regan Ford. The motion passed 5 ayes - 0 nays. ALLOWENCE OF BILLS AND CLAIMS Council Member Jim Dazey presented bills and claim numbers 66569 through 66691 for $885,958.52 for approval. Council Member Jim Dazey made a motion to approve the bills and claims with a second by Council Member Amy Ballard. The motion passed 5 ayes-0 nays.
