COUNCIL MINUTES October 18, 2021 The City Council of the City of Knoxville, Iowa convened in regular session Monday, October 18, 2021 at 6:15p.m. at the Knoxville Municipal Building. Mayor Hatch presided and the following Council Members were present: Megan Suhr, John Gotta, Dylan Morse and Jyl DeJong. Staffs present were City Manager Heather Ussery, City Clerk Tricia Kincaid, Police Chief Aaron Fuller and Fire Chief Cal Wyman. Motion by Gotta; seconded by Morse to approve the consent agenda as follows, all ayes. 1. Approve City Council Meeting Minutes of October 4, 2021 2. Accept Recreation Center Commission Meeting Minutes of July 12, 2021 3. Accept Water Board Meeting Minutes of September 14, 2021 4. Approve Resolution accepting work and approving final cost for the 2020 Roche Street Culvert Replacement Project Mayor Hatch announced now was the time and place for a public hearing regarding a rezoning request at 1510 W Pleasant St. The hearing was opened at 6:16 p.m., filing of affidavit of publication was on 10/11/21. This request is for zoning to be changed from a C-2 to a R-2. The property owner is wanting to construct two homes. There were no written or oral comments or objections. Motion by Suhr, seconded by DeJong to close the hearing at 6:18 p.m.; all ayes. Motion by DeJong, seconded by Morse to approve first consideration waive second and third consideration to adopt an ordinance amending the zoning code of ordinances of the City of Knoxville, Iowa, 2009; all ayes. Motion by Morse, seconded by Suhr to approve second consideration, waive third consideration to adopt an ordinance amending the code of ordinances of the City of Knoxville, Iowa, 2009 by adding a new chapter in title one (1) establishing the Community and Economic Development Position; all ayes. Motion by Suhr, seconded by Gotta to approve first consideration to adopt an ordinance amending the code of ordinances of the City of Knoxville, Iowa, 2009 by adding a new chapter in title eight (8) establishing a commercial property minimum maintenance code. This pertains to weeds, debris, fences, parking areas, exterior surfaces. It is not any type of inspection process and will not have to be registered with the city; all ayes. Motion by Morse, seconded by DeJong to approve first consideration to adopt an ordinance amending the code of ordinances of the City of Knoxville, Iowa, 2009 by adding a new chapter in title eight (8) establishing a vacant building permit and inspection process. This pertains to vacant buildings that are in commercial, industrial and mixed-use areas. When the building becomes vacant the city is notified and has that information on file; all ayes. Motion by Suhr, seconded by Gotta to approve first consideration to adopt an ordinance amending the code of ordinances of the City of Knoxville, Iowa by amending provisions pertaining to the fire prevention code. Fire Chief Wyman explained this is adding a fire safety operational permit for anyone who operates a commercial business. It excludes home businesses or those that require a state inspection; all ayes. Motion by Morse, seconded by DeJong to approve first consideration to adopt an ordinance amending the code of ordinances of the City of Knoxville, Iowa by repealing title 8, chapter 9, section 6, paragraph C, subparagraph 7 pertaining to fire water containers. This will take out s section requiring two water containers at each exit point of fireworks display; all ayes.  Motion by Suhr, seconded by Gotta to approve first consideration, waive second and third consideration to adopt an ordinance amending the code of ordinances of the City of Knoxville, Iowa by amending provisions pertaining to the salary of the mayor; all ayes. Motion by DeJong, seconded by Gotta to approve first consideration to adopt an ordinance amending the code of ordinances of the City of Knoxville, Iowa by amending provisions pertaining to the compensation of the council; all ayes. Motion by Suhr, seconded by Gotta to authorize the approval of possibly moving forward with a new ambulance 937. Fire Chief Cal Wyman explained there is an issue with ambulance 937. They have checked into cost of repairs and feel it would make better sense to purchase a new ambulance. It would be at least a year before it would be obtained; all ayes. Motion by Gotta, seconded by Morse to approve Heather Ussery as City appointment for the joint committee per 28E Agreement; all ayes.
