COUNCIL MINUTES November 7, 2022 The City Council of the City of Knoxville, Iowa convened in regular session Monday, November 7, 2022 at 6:15 p.m. at the Knoxville Municipal Building Council Chambers. Mayor Hatch presided and the following Council Members were present: Megan Suhr, John Gotta, Dylan Morse, Dawn Rankin, and Jyl DeJong. Staffs present were City Manager, Heather Ussery; City Clerk, Jodie Wyman; Fire Chief, Cal Wyman; Police Chief, Aaron Fuller; Economic Development Directors, Glenn Lyons and Marilyn Arber; Library Director, Roslin Thompson; and CSO Meredith Clark. Motion by Gotta, seconded by Rankin to approve consent agenda; all ayes. 1. Approve City Council Minutes from October 17, 2022 2. Accept Library Board Meeting Minutes from October 18, 2022 3. Accept Housing Board Meeting Minutes from September 19, 2022 4. Approve Class E Liquor License for Marvin Washington, Dba Bottoms Up 5. Approve Term Renewal of Mike Cox on Planning and Zoning Commission 6. Approve Planning and Zoning Commission Application from Sander Stotland 7. Set a Public Hearing for November 21, 2022, at 6:15 p.m. to approve a rezoning application for 1506 and 1510 E. Marion Street from C-2, General Commercial, to M-1. Service Commercial/Limited Industrial District 8. Accept August 2022 SRO Report 9. Accept September 2022 SRO Report Mayor Hatch announced now was the time and place for a public hearing to approve the proposed plans, specifications, form of contract and estimate of cost for the VA District – Phase 1 Improvements Project. The hearing was opened at 6:17 p.m., filing of affidavit of publication was on October 28, 2022. Two bids were received from credible contractors. There were no written or oral comments or objections. Motion by DeJong, seconded by Gotta to close the hearing at 6:21 p.m.; all ayes. Motion by Morse; seconded by Rankin to approve a resolution approving preliminary plans, specifications, form of contract and estimate of cost for the VA District – Phase 1 Improvements Project. The motion passed all ayes. Motion by Morse; seconded by Rankin to approve a resolution approving contract, bonds, and certificate of insurance from Elder Corporation in the amount of $3,029,100 for the VA District – Phase 1 Improvements Project. The motion passed on a roll call vote. Motion by Morse, seconded by DeJong to direct staff to move forward with the design of the Main Street Improvement Project Concept with the inclusion of the green spaces. The motion passed all ayes. Motion by Morse, seconded by Gotta to direct staff to add the agricultural acreage located at 1221 E. Pleasant as an additional deer population management zone within the city limits. The motion passed all ayes. Chuck Galeazzi of Helping Hands Organization addressed Council regarding feedback on the newly implemented inspection program. No action was taken by Council. Motion by Suhr, seconded by Gotta to move forward with the Library Board’s proposal regarding the Dixie Gebhardt House. The motion passed on a roll call vote as follows: Morse, nay; Rankin, aye; DeJong, aye; Suhr, aye; and Gotta, aye.  Motion by Morse, seconded by DeJong to authorize staff to apply for an Iowa Nuisance and Abandoned Building Remediation Loan on behalf of Marion County; all ayes. Motion by Suhr, seconded by Rankin to approve partial payment of the municipal grant associated with the IEDA Downtown Housing Project. The motion passed all ayes. Motion by DeJong, seconded by Rankin to approve the second consideration and adopt an ordinance amending the Code of Ordinances of the City of Knoxville, Iowa, 2009, by amending provisions pertaining to vacant building permit and inspections, with a six-month implementation grace period. The motion passed on a roll call vote as follows: Suhr, nay; Gotta, aye; Morse, aye; Rankin, aye; and DeJong, aye. Motion by Suhr, seconded by Rankin to approve the second consideration and adopt an ordinance amending the Code of Ordinances of the City of Knoxville, Iowa, 2009, by amending Chapter 6 regarding the use of golf carts and utility trail vehicles on city streets, adding language to 6.6.7 No person under 42” may ride on a golf cart or UTV. The motion passed all ayes. Hearing to discuss board member absences. Board member has missed more than the three allowed consecutive Planning and Zoning meetings and was sent a letter stating their options with no response. The board member did not attend the council meeting therefore it is an automatic resignation.
