BOARD OF PUBLIC WORKS AND SAFETY MINUTES June 19, 2018 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, June 19, 2018 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Norm Childress and Ron Shriner Absent: Dawn Ross Jacque Chosnek, 1st Deputy City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Murray moved for approval of the minutes from the June 12, 2018 regular meeting. Mr. Childress seconded. Passed. NEW BUSINESS Engineering Permission to Adverise-2018 Curb and Ramp Replacement Project-S. 4th Street Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of a Permission to Advertise the 2018 Curb and Ramp Replacement Project for S. 4th Street between Romig Street and Montifiore Street. Mr. Shriner moved for approval. Mr. Childress seconded. Passed. Economic Development Permanent Supportive Housing Rental Assistance Contract Adam Murphy, Economic Development, presented to the Board and recommended approval of a Permanent Supportive Housing Rental Assistance Contract with the Indiana Housing and Community Development Authority. Mr. Murphy stated that the contract will provide continuance of rental assistance for 28 persons who are certified as chronically homeless with a co-existing disability, such as mental illness, substance abuse and/or HIV/AIDS. The contract sets aside $229,152.00 in rental assistance for the next year with additional administrative funding of $12,172.00. Mrs. Murray moved for approval. Mr. Childress seconded. Passed. Purchasing Declaration of Worthless Property-Human Resources Dave Payne, Purchasing Manager, presented to the Board and recommended approval of a Declaration of Worthless Property for the Human Resources Department that includes a Kyocera FS-1035 Multi- function printer/copier/fax Serial Number NN2607188 Machine ID 42418. The item no longer functions properly and will be recycled. Mr. Shriner moved for approval. Mrs. Murray seconded. President Henriott asked if there were any further questions and there were none. Mr. Childress moved for approval. Mrs. Murray seconded. Passed. MISCELLANEOUS Special Event Request-Stars and Stripes Celebration President Henriott presented to the Board and recommended approval of Special Event Request for the Stars and Stripes Celebration to be held on July 4, 2018 from 12:00pm-12:00am at Riehle Plaza and downtown Lafayette. Mr. Childress moved for approval. Mr. Shriner seconded. Passed. Special Event Request-Community Car Show President Henriott presented to the Board and recommended approval of Special Event Request for the Community Car Show to be held on August 11, 2018 from 12:00pm-8:00pm on the 600 block of S. 11th Street in the Wallace Triangle. Mr. Childress moved for approval. Mrs. Murray seconded. Passed. Special Event Request-Boiler Bridge Bash Kelli Cornelius, Greater Lafayette Commerce, presented to the Board and recommended approval of Special Event Request for the Boiler Bridge Bash to be held on August 16, 2018 from 4:00pm-12:00am at Riehle Plaza and downtown Lafayette. Mrs. Murray moved for approval. Mr. Childress seconded. Passed. Banner Request-Ouibache Music Festival President Henriott presented to the Board and recommended approval of a Banner Request for the Ouibache Music Festival. The banner will be hung of Main Street from September 11-30, 2018. Mr. Shriner moved for approval. Mrs. Murray seconded. Passed. DEPARTMENT UPDATE Traffic Improvement President Henriott stated that this update be postponed until next week. Time: 9:08 a.m. President Henriott stated that the Board will reconvene in five (5) minutes for the Animal Control Appeal Hearing. BOARD OF PUBLIC WORKS AND SAFETY ANIMAL APPEAL MINUTES June 19, 2018 Appeal Hearing: Board of Public Works and Safety June 19, 2018 Page 3 The Board of Public Works and Safety met on Tuesday, June 19, 2018 at 9:15 a.m. in the Common Council Chambers. Members present were: Cindy Murray, Ron Shriner and Norm Childress. Absent: Gary Henriott and Dawn Ross Jacque Chosnek, 1st Deputy City Attorney, was also present. Mrs. Murray called the meeting to order. Animal Control Appeal for Brandy Combs Jacque Chosnek stated that Stone is owned by Brandy Combs. The original incident was October 4, 2015 where Officer Meluch was dispatched for a dog running loose and aggressive. When Officer Meluch reached the seen the dog was barking at the officer but was about 2 (two) feet away. At one point in time while the officer was collecting information the dog lunged and bit the officer on the right arm. That resulted in a Dangerous Animal Agreement (DAA) signed on October 13, 2015. Mrs. Chosnek stated that the agreement states that the animal must be kept enclosed or secured and restrained. It provides that the dog will be impounded for future violation of the DAA. Mrs. Chosnek stated that the current incident that resulted in the impoundment of Stone occurred on June 5, 2018. Animal Control Officer (ACO) Manuel was dispatched to the Village Pantry on 9th Street around 11:30am. ACO Manuel spoke with Ivan Gonvalez who advised that he was skateboarding down 9th Street when he noticed the dog Stone chasing him. The dog first went to the skateboard but then jumped up and bit Ivan on the arm. Mrs. Chosnek stated that Ivan did have on 2 (two) long sleeved shirts which could be why the bite do not break the skin. A juvenile did come and get Stone and took him back inside the residence. ACO had a couple of attempts to contact the owner of Stone which they eventually made contact with the owner and made arrangements to pick up Stone to be impounded. The next day Stone was picked up and impounded at the Almost Home Humane Society (AHHS) and Ms. Combs timely filed her appeal of Stone’s impoundment. The Board has been given a copy of her appeal and incident reports. ACO Manuel stated that everything that Mrs. Chosnek stated was accurate. Officer Lucas was the ACO that picked Stone up and delivered him to AHHS. Officer Lucas was able, with the help of the owner, to transport Stone to AHHS without incident. ACO Manuel stated that the last time she spoke with the staff at AHHS, they are still unable to handle the dog yet. He is being very protective of his kennel. Mrs. Murray asked if the dog was registered with the City of Lafayette. Ms. Combs stated he was not registered but his shots are up-to-date and is altered. Ms. Combs stated that her daughter let Stone out of the house and off his leash into the side yard which is fenced in but there are areas that he can get out. Ms. Combs is having maintenance come over to repair the areas for Stone. Stone is put on a muzzle before going outside the house. Ms. Combs stated that Stone is not aggressive in her home. The next door neighbor (unidentified) spoke saying that Stone is a protective dog but has never seen him bite anyone since he moved in last year, he just barks at people. Mr. Shriner stated that the Board and the ACOs concern going forward is if they didn’t take an action with this dog, the next time it happens questions would arise as to why they didn’t do anything about this the first time. The next time could be an attack on another person. Mr. Childress asked if the ACO was certain that Stone was the dog that bit Ivan on the skateboard. ACO Manuel confirmed that was correct. Discussion ensued regarding when Stone was altered and what the next step would be for Stone. Mr. Childress moved to deny the appeal and not return the dog to Ms. Combs. Mr. Shriner seconded.
