BOARD OF PUBLIC WORKS AND SAFETY MINUTES February 12, 2019 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, February 12, 2019 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Ron Shriner, Norm Childress and Amy Moulton. Absent: Cindy Murray Ed Chosnek, City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Moulton moved for approval of the minutes from the February 5, 2019 regular meeting. Mr. Childress seconded. Passed. BID OPENING Sodium Hypochlorite, Sodium Bisulfite, Phosphorus Chemicals and Hydrochloric Acid This being the time set to open bids for the Sodium Hypochlorite, Sodium Bisulfite, Phosphorus Chemicals and Hydrochloric Acid, and the following bids were received and opened: Rowell Chemical Hinsdale, Illinois Sodium Hypochlorite: $.849 per gallon Sodium Bisulfite: $1.70 per gallon JCI Jones Chemicals, Inc Sarasota, Florida Sodium Hypochlorite: $.75 per gallon Alexander Chemical Peru, Illinois Sodium Hypochlorite (4,500 gallon): $.7963 per gallon Sodium Hypochlorite (3,500 gallon): $.8440 per gallon Hydrochloric Acid: $198.62 per drum (4 drum minimum) Sodium Bisulfite: $1.5492 per gallon Brenntag Mid-South Indianapolis, Indiana Sodium Aluminate: $2.56 per gallon Ferric Chloride: $1.167 per gallon Hydrochloric Acid: $118.00 per drum Sodium Bisulfite (4,000 gallons): $1.239 per gallon Board of Public Works and Safety February 12, 2019 Page 2 Sodium Bisulfite (2,500 gallons): $1.397 per gallon Sodium Hypochlorite: $.833 per gallon Mrs. Moulton moved to take the bids under advisement for further review. Mr. Shriner seconded. Passed. NEW BUSINESS Engineering Recommendation for Award- Lafayette Fire Station #5 HVAC Project (re-bid) Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of a Recommendation for Award for the Lafayette Fire Station #5 HVAC Project (re-bid) with RenCon Services Inc. in the amount of $294,956.00. Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed. Contract- Lafayette Fire Station #5 HVAC Project (re-bid) Mr. Grenard presented to the Board and recommended approval of a Recommendation for Award for the Lafayette Fire Station #5 HVAC Project (re-bid) with RenCon Services Inc. for the base bid in the amount of $294,956.00. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Notice to Proceed- Lafayette Fire Station #5 HVAC Project (re-bid) Mr. Grenard presented to the Board and recommended approval of a Notice to Proceed for the Lafayette Fire Station #5 HVAC Project (re-bid) to start today. The completion of the project should be towards the end of summer 2019. Mrs. Moulton moved for approval. Mr. Childress seconded. Passed. Change Order #4-Sagamore Parkway Phase III Mr. Grenard presented to the Board and recommended approval of Change Order #1 for Sagamore Parkway Phase III with Milestone Contractors in the amount of $9,133.05 which brings the revised contract amount to $12,825,424.57. This change order includes various adjustments to scope and changes in conditions that were encountered during construction. Mr. Childress moved for approval. Mr. Shriner seconded. Passed. Mrs. Moulton abstained. Parks Department Change Order #1-Tropicanoe Cove Expansion (JR Kelly) Jon Miner, Parks Department, presented to the Board and recommended approval of Change Order #1 for the Tropicanoe Cove Expansion with JR Kelly. The change order is in the amount of $36,616.00 which brings the revised contract amount to $3,855,616.00. The change order includes additional foundation work for the slide foundation. Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed. Board of Public Works and Safety February 12, 2019 Page 3 Water Works Agreement with Butler, Fairman & Seufert for County Road 430 South Water Tower Kerry Smith, Water Works Superintendent, presented to the Board and recommended approval of an Agreement with Butler, Fairman & Seufert for the County Road 430 South Water Tower. The contract is in the amount not-to-exceed $390,102.00 and includes construction inspection. The final design of this project is to be complete in November 2019 with bidding to be in December 2019 along with a substantial completion by spring of 2021. Mr. Childress moved for approval. Mr. Shriner seconded. Passed. Mrs. Moulton abstained. Mayor Roswarski answered questions from the Board. CLAIMS Tim Clary, Controller, presented for Board approval, Claims in the amount of $679,151.55. President Henriott asked if there were any further questions and there were none. Mrs. Moulton moved for approval. Mr. Childress seconded. Passed. MISCELLANEOUS Special Event Request-Parker Graduation Party President Henriott presented to the Board and recommended approval of a Special Event Request for the Parker Graduation Party to be held on June 29, 2019 from 4:00pm-10:00pm in the Big 4 Depot Community Room. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Time: 9:17 a.m. President Henriott stated that the Board will reconvene in five (5) minutes for the Animal Control Appeal Hearing. BOARD OF PUBLIC WORKS AND SAFETY ANIMAL APPEAL MINUTES February 12, 2019 Appeal Hearing: The Board of Public Works and Safety met on Tuesday, February 12, 2019 at 9:25 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Ron Shriner, Amy Moulton and Norm Childress. Absent: Cindy Murray Ed Chosnek, City Attorney, was also present. President Henriott called the meeting to order. Animal Control Appeal Hearing-William Jackson President Henriott stated that the petitioner, William Jackson, was not present for the hearing. Mr. Chosnek noted that the petition, Mr. Jackson, was given written notice as well as telephonic communication that the appealing hearing would take place at 9:15am this date in the Council Chambers. The time is now 9:25am and Mr. Jackson has not appeared. Mr. Chosnek asked the ACO that was involved in the ceasing of this animal to give a summary of what they found. Board of Public Works and Safety February 12, 2019 Page 4 Jenna Manuel, ACO, stated that she was called to 607 Jefferson Street and met with the property manager. The property manager believed that the property was abandoned and obtained an emergency court order to have Animal Control enter the home to remove all animals. ACO Manuel believed at the time that there could be two dogs in the home. ACOs have a history at this address with animals running loose, 2 pit bulls. The property manager was not certain if anyone was in the home at the present time of entering the home but she knew there were dogs inside the home the day before. ACO Manuel entered the home and saw one large mixed breed King Corso along with several piles of feces, trash, and clutter and in disarray. ACO Manuel then contacted ACO Klumpe and LPD to assist with securing the home. Once they entered the home, there was no one home but the one dog. There was a 5 gallon bucket of dog food but no evidence of water for the dog. ACO Manuel stated that Animal Control has never seen this dog before at this address even though Animal Control has been called to this address prior to this visit. Animal Control was able to secure and removed the dog from the home and it was taken to Almost Home Humane Society. The evidence in the home suggests that the dog has been the home for quite some time by himself. ACO Manuel left a notice of removal on the door for Mr. Jackson at the time. ACO Manuel stated that someone called Animal Control later on to talk about the citation and removal. ACO Manuel stated that she finally made contact with Mr. Jackson on that Monday where Mr. Jackson stated that he had been gone for two weeks and the dog was supposed to be looked after by a friend. ACO Manuel stated that with the current conditions clearly no one was taking care of this dog. ACO Manuel stated that the dog was aggressive toward them and was very thin at the time. ACO Manuel stated that when they were investigating this case Animal Control realized that they have dealt with Mr. Jackson in 2015 on Union Street where he had three, if not four, pit bull type dogs in the home. Animal Control was called to the home on Union from a complaint about the dogs not having adequate food, water and shelter. ACO Manuel stated that over the next five months several of the dogs were removed by Animal Control, each time the dogs removed had been brutally attacked by the other dogs living in the home. Mr. Chosnek provided the Board with pictures of one of the dogs that was removed in 2015 where the dog had open wounds and had to have surgery at Purdue Veterinary School. Mr. Chosnek stated that the pictures show the responsibility or lack of responsibility as an animal owner, Mr. Jackson. Mr. Shriner moved to deny the appeal of Mr. Jackson. Mrs. Moulton seconded. Appeal denied. Discussion ensued.
