BOARD OF PUBLIC WORKS AND SAFETY MINUTES August 22, 2023 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, August 22, 2023 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Amy Moulton, Eric Rody and Ron Shriner Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Moulton moved for approval of the minutes from the August 15, 2023 regular meeting. Mrs. Murray seconded. Passed. NEW BUSINESS Parks Department Contract with Kaldahl Heritage Classic Construction Jon Miner, Parks Department, presented to the Board and recommended approval of a Contract with Kaldahl Heritage Classic Construction in the amount of $2,580.00. The project is for exterior painting on the Armstrong Park batting cage posts. Mr. Shriner moved for approval. Mr. Rody seconded. Passed. Mrs. Moulton moved for approval. Mrs. Murray seconded. Passed. Board of Public Works and Safety August 22, 2023 Page 2 Lafayette Renew Permission to Advertise-2023 Sanitary Sewer Rehabilitation Project Brad Talley, Renew Superintendent, presented to the Board and recommended approval of a Permission to Advertise for the 2023 Sanitary Sewer Rehabilitation Project. The publications are set to run on August 25 & September 1, 2023 with the bid opening set for September 19, 2023. Mr. Talley gave a brief description of the project. Discussion ensued. Mr. Rody moved for approval. Mrs. Moulton seconded. Passed. CLAIMS Jeremy Diehl, Controller, presented for Board approval of Claims in the amount of $284,551.24. President Henriott asked if there were any further questions and there were none. Mrs. Murray moved for approval. Mr. Rody seconded. Passed. MISCELLANEOUS Special Event Request-Hands on Transportation Dee Bishop, Event Representative, presented to the Board and recommended approval of a Special Event Request for Hands on Transportation that will be held on September 16, 2023 from 8:00am-2:00pm on Cincinnati Street between 3rd & 4th Streets and 4th Street between Cincinnati & Wall Streets. Mayor Roswarski noted his concern with closing off 4th Street without adequate signage and rerouting options. Ms. Bishop stated that she will make a plan with the City for those provisions. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Special Event Request-MDA Fill the Boot Chris Conklin, Lafayette Fire Department and MDA Representative, presented to the Board and recommended approval of a Special Event Request for MDA Fill the Boot to be held on September 1-3, 2023 from 8:00am- 5:00pm located at all Lafayette Fire Stations. Mrs. Murray moved for approval. Mr. Rody seconded. Passed. President Henriott stated that the meeting will reconvene at 9:15 a.m. for the Animal Appeal Hearing. Time: 9:10 a.m. Animal Control Appeal-Lizbeth Pacheco (Tabled 8/15/2023) President Henriott reconvened the meeting at 9:15 a.m. Ms. Chosnek gave a brief description of the procedure for this hearing. Ms. Chosnek stated that the Board has received copies of incident reports by Animal Control Officer (ACO)’s and the Appeal Letter from Lizbeth Pacheco for Yogi the beagle. Animal Control Officer (ACO) Aaron Gravely stated that he was called on July 29, 2023 for two dogs running at large. At that time Yogi was ceased and taken to Almost Home Humane Society(AHHS). One dog was a wirehaired terrier and the other was a beagle. The neighbors have complained numerous times that the two dogs are out running all the time. ACO Gravely stated that he looked back at the records for these two dogs and discovered that the beagle, Yogi, has a Nuisance Animal Agreement (NAA) issued in January 2023 for Running at Large and Habitual Offender. ACO Gravely stated that the Yogi has not bitten any dog or person, just continues Board of Public Works and Safety August 22, 2023 Page 3 to get loose and run at large. ACO Gravely stated that since the NAA was issued on Yogi in 1/2023, he has not been neutered as of 7/2023. ACO Gravely stated that they are both nice dogs, they just get out of the yard and run at large. Both animals are owned by Ms. Pacheco. Lizbeth Pacheco, 324 S. 27th Street, Lafayette Indiana, stated that Yogi escaped the yard because there was a storm a few days before and damaged the fence. Ms. Pacheco stated that she and the two dogs live with her parents temporarily at the S. 27th address at the time of Yogi getting ceased by the ACO’s. Ms. Pacheco explained that she has been diagnosed with some health problems that require her parents to help with the care of the dogs during that time. Ms. Pacheco explained to the Board her situation with school, health issues, personal issues and living arrangements all while taking care of Yogi as best as she can. Ms. Pacheco stated that she will be putting Yogi in obedience training and has an appointment made to get him neutered at Blair Animal Hospital, if returned to her. Discussion ensued regarding the wellness plan for Yogi at Blair Animal Hospital. Ms. Pacheco stated that both dogs are indoor and outdoor dogs but mostly stay inside. Ms. Chosnek asked about the current condition of the damaged fence. Ms. Pacheco stated that the fence has been repaired and the family is considering an invisible fence option as well. President Henriott spoke about this being a repeating issue with Yogi and the complaints/concerns of the neighbors. Mr. Shriner stated that the ordinances are put in place due to the needs of the concerns of the citizens and the impacts of animals running at large and potentially getting hit by vehicles. ACO Josh Klumpe confirmed that Yogi is under a Nuisance Animal Agreement and not a Dangerous Animal Agreement. Mrs. Murray stated that she appreciates Ms. Pacheco’s responsibility is taking ownership of lack of care that she can provide for Yogi at this time and thanked Ms. Pacheco for paying for her Ordinance Violations Fees timely, providing pet insurance, up-to-date vaccines; and making an appointment for neutering. Mrs. Moulton stated that she is concerned with the current health conditions, school requirements for Ms. Pacheco along with the hyperactivity of Yogi and how this situation doesn’t seem that it will get better. Ms. Pacheco explained all the things she is doing and taking to help with her health situation. ACO Klumpe asked if Ms. Pacheco has been home any the times that the dogs have run loose. Ms. Pacheco confirmed that she has never been home during any of those time. ACO Klumpe explained to the Board that the problem is not with Ms. Pacheco, it is with Ms. Pacheco’s parents and their lack of responsibility with helping with Yogi. ACO Klumpe stated that when the parents are in charge the dogs get out. ACO Klumpe suggested that Ms. Pacheco figure out a different situation where Yogi will be better able to stay in the yard etc. Ms. Pacheco stated that a few days before the storm damaged that fence and Yogi was ceased, she moved out into her own apartment with her friend. She has saved up enough money to have Yogi come live with her at the apartment and pay the pet fee and added monthly rent for the pet. Ms. Pacheco stated that if Yogi is returned, he would not be going back with her parents, he would be living with her at the apartment. Ms. Pacheco stated that he would be going to obedience school, and she would follow through with her appointment to get him neutered. Ms. Pacheco confirmed that Yogi would be taken care of properly at the apartment by her and her roommate. President Henriott is concerned with Yogi barking and howling in the apartment and creating unwanted noise for the neighbors. Discussion ensued regarding the calming effects of Yogi after the neutering. Mrs. Murray moved to approve the appeal and return the animal. Mr. Rody seconded. ACO Klumpe suggested that Yogi is not to go back to live at the parent’s house and Ms. Pacheco has a set number of days to get Yogi neutered. Mrs. Murray stated that Ms. Pacheco needs to contact the ACO’s and let them know when the neutering appointment is set for. Mr. Rody stated that 30 days/end of September is plenty of time for the neutering to take place. Ms. Pacheco agreed with the set of terms. Mrs. Murray moved to approve the appeal with the amended terms agreed upon. Mr. Rody seconded. Passed by voice vote 3 to 2.
