BOARD OF PUBLIC WORKS AND SAFETY MINUTES April 30, 2024 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, April 30, 2024 at 9:00 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Cindy Murray, Eric Rody and Ron Shriner. Absent: Amy Moulton Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Murray moved for approval of the minutes from the April 23, 2024 regular meeting. Mr. Rody seconded. Passed. BIDS UNDER ADVISEMENT Water Service Line Potholing Project President Henriott stated that this item will remain under advisement. NEW BUSINESS Engineering Contract-Romig Street Concrete Project Mr. Grenard presented to the Board and recommended approval of a Contract for the Romig Street Concrete Project with Dixon Construction in the amount of $23,583.00. Mr. Grenard went over the details of the project. Mr. Shriner moved for approval. Mrs. Murray seconded. Passed. Notice to Proceed- Romig Street Concrete Project Mr. Grenard presented to the Board and recommended approval of a Notice to Proceed for the Romig Street Concrete Project that is set to start today. Mr. Rody moved for approval. Mr. Shriner seconded. Passed. Permission to Advertise-2024 Micro-Surface Project Mr. Grenard presented to the Board and recommended approval of a Permission to Advertise for the 2024 Micro Surface Project. The publications are set to run on May 3 and May 10, 2024 with the bid opening on May 21, 2024. Mr. Grenard gave the Board a brief description of the details of the project. Discussion ensued. Passed. Board of Public Works and Safety April 30, 2024 Page 2 Economic Development Historic Demolition Permit-635 N. 4th Street (House and Garage) John Collier, Economic Development, presented to the Board and recommended approval of a Historic Demolition Permit for 635 N. 4th Street House and Garage. Mr. Collier stated that Dann Keiser, Lafayette Historic Preservation Officer, determined that the loss of the house would adversely affect the historic character of the historic district. Mr. Collier stated that Mr. Keiser recommends that the 60-day waiting period be upheld. Mrs. Murray moved to uphold the 60-day waiting period. Mr. Rody seconded. Passed. Police Department Lafayette Police Contract with Find8 Performance Marketing Scott Galloway, Police Chief, presented to the Board and recommended approval of the Lafayette Police Contract with Find8 Performance Marketing. The contract/proposal is in the amount of $12,300.00 for 6 months and includes the marketing strategy and campaign, keywords searches, reporting, and optimization. Chief Galloway answered questions from the Board. Discussion ensued. Mr. Rody moved for approval. Mr. Shriner seconded. Passed. Lafayette Police Contract with Star City Broadcasting (2024 Recruitment Proposal) Chief Galloway presented to the Board and recommended approval of the Lafayette Police Contract with Star City Broadcasting for 2024 Recruitment Proposal. The contract/proposal is in the amount of $12,000.00 for 6 months and includes target demographics, a free radio show, on-air discussion on recruitment, and community events. Chief Galloway answered questions from the Board. Discussion ensued. Mr. Shriner moved for approval. Mrs. Murray seconded. Passed. Lafayette Police Implementation with Meta Marketing Chief Galloway presented to the Board the Lafayette Police Implementation with Meta Marketing for informational purposes only. Meta targeting will put LPD’s ads in front of the ideal candidate based on interest, traits, engagement, and location on Facebook and Instagram. Meta does not provide a contract to advertisers. Instead, every time an ad is uploaded, a card is required for submission. Ads will be paid for weekly and per ad. Time: 9:16 a.m. Animal Control Appeal Hearing-Torro Regnier BOARD OF PUBLIC WORKS AND SAFETY ANIMAL APPEAL MINUTES April 30, 2024 Appeal Hearing: The Board of Public Works and Safety met on Tuesday, April 30, 2024 at 9:25 a.m. in the Common Council Chambers. Members present were: Gary Henriott, Ron Shriner, Cindy Murray, and Eric Rody. Absent: Amy Moulton Jacque Chosnek, City Attorney, was also present. President Henriott called the meeting to order. Animal Control Appeal Hearing-Torro Regnier Ms. Chosnek gave a brief description of the procedure for this hearing. Ms. Chosnek stated that the Board has received copies of incident reports by Animal Control Officer (ACO)’s. Ms. Chosnek stated that the owner of Torro is Truman and Gabriella Regnier. The animal appeal was filed by Mr. Regnier on April 18, 2024 via email to the Clerk’s Office. Animal Control Officer (ACO) Aaron Gravely stated that he responded to a call on May 5, 2023 near the address of 3611 Durantt Drive, Lafayette. ACO Gravley stated that the call was from a mom that her kid got bit while they were outside playing. The child fell to the ground and ran back to the house. As the child was running back to the house Torro ran towards the child and bit the child on the shoulder. The mother took the child to the hospital for treatment. ACO Gravely was unsure how Torro got loose from the house. ACO Gravely stated that went to the hospital to talk with the mom and get photos of the dog bite. The mother of the child told ACO Gravely where the dog lived. ACO Gravely then proceeded to 3611 Durantt Drive to speak to the owner of Torro. ACO Gravely spoke with Ms. Regnier and then issued the Dangerous Animal Agreement (DAA). Ms. Regnier signed the agreement and was given an explanation of the agreement. ACO Gravely went over the details of the agreement for the Board. ACO Spencer Hitchcock stated that he responded to a call on April 17, 2024 for Torro running at large and also bit two children. ACO Hitchcock went to the home of the children that were bit and spoke to the father. ACO Board of Public Works and Safety April 30, 2024 Page 5 Hitchcock took a few pictures of the bite wounds. The father pointed out where the dog lived which was 3611 Durantt Drive. ACO Hitchcock went to the home of Mr. Regnier and Torro where he issued a DAA. ACO Gravely informed ACO Hitchcock that a DAA was already issued on May 5, 2023. ACO Hitchcock stated that he was unaware that the Torro already had an active DAA and went back to the home of Mr. Regnier and seized Torro at that time on April 17, 2024. ACO Hitchcock stated that he returned to 3611 Durantt Drive to confirm if any steps were taken to secure the house and yard for Torro. ACO Hitchcock stated that the front storm door was still missing and nothing new to help secure Torro at that time. Truman Regnier, 3611 Durantt Drive, confirmed that Torro bit a child on May 5, 2023 and was issued a DAA. Mr. Regnier also confirmed that Torro was running at large and bit two children on April 17, 2024 where another DAA was issued and Torro was ultimately seized by the ACO’s. Mr. Regnier stated that he knows that Torro is a violent breed dog (German Shepard) and that he got loose from the home. Mr. Regnier stated that he has history with a few of the families in the neighborhood. Mr. Regnier stated that he has purchased invisible fencing and a solid muzzle for Torro. Torro is only getting loose through the front door, but Mr. Regnier stated that he has installed a Bow Wow Barrier on the front door which will help keep Torro from getting out. Mr. Regnier has plans to install an 8-foot privacy fence but doesn’t have the money for that right now. No storm door has been purchased yet due to money. Mr. Regnier again confirmed that Torro has bitten three children and running at large on two different occasions. President Henriott reiterated to Mr. Regnier that this is the Board of Works and Public Safety therefore has an obligated to the city to help protect the citizens from dogs like Torro through this process. Mr. Shriner stated that the reason the city has municipal codes is to help address these concerns. If the Board returns the dog to you and Torro bites another person then the city can be liable for that. Mrs. Murray moved to deny the appeal. Mr. Shriner seconded. Denied.
