BOARD OF PUBLIC WORKS AND SAFETY MINUTES June 18, 2024 Regular Session: The Board of Public Works and Safety met in regular session on Tuesday, June 18, 2024 at 9:00 a.m. in the Common Council Chambers. Members present were: Cindy Murray, Ron Shriner, Eric Rody and Amy Moulton. Absent: Gary Henriott Jacque Chosnek, City Attorney, was also present. Cindy Murray called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. MINUTES Mrs. Moulton moved for approval of the minutes from the June 11, 2024 regular meeting. Mr. Rody seconded. Passed. BIDS UNDER ADVISEMENT McCaw Park Improvements Phase 2-Trails and Pickleball Courts Mrs. Murray stated that this item will remain under advisement. Proposal: GMAX Price for Service Area 11B Project (Build, Operate, Transfer) Mrs. Murray stated that this item will remain under advisement. NEW BUSINESS Engineering Contract- Quote: Saw Mill Run Subdivision Concrete Project Jeromy Grenard, Public Works Director, presented to the Board and recommended approval of a Contract for the Saw Mill Run Subdivision Concrete Project with Promised Land Construction and Landscaping in the amount of $77,426.00. Mr. Grenard went over the details of the project and answered questions from the Board. Mr. Rody moved for approval. Mr. Shriner seconded. Passed. Notice to Proceed- Quote: Saw Mill Run Subdivision Concrete Project Mr. Grenard presented to the Board and recommended approval of a Notice to Proceed for the Saw Mill Run Subdivision Concrete. The project is scheduled to start today. Mr. Shriner moved for approval. Mr. Rody seconded. Passed. Board of Public Works and Safety June 18, 2024 Page 2 Lafayette Housing Authority Amendment #1-Agreement between City of Lafayette and Tippecanoe Senior Services for the Senior Home Assistance Repair Program (SHARP) 2023 Valerie Oakley, Project Manager, presented to the Board and recommended approval of Amendment #1-Agreement between City of Lafayette and Tippecanoe Senior Services for the Senior Home Assistance Repair Program (SHARP) 2023. The original agreement ended on June 30, 2023 and this amendment extends the ending date for reimbursement of eligible agency operating costs to August 31, 2024. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Conflict of Interest Disclosure-Habitat for Humanity for Greater Lafayette (Sarah McGlothin, 214 Ellsworth) Mrs. Oakley presented to the Board and read into the record the following Disclosure Statement: CONFLICT OF INTEREST DISCLOSURE PURSUANT TO 24 CFR § 92.356 Pursuant to the requirements of 24 CFR 92.356, the following real or perceived conflict of interest is disclosed: 1. Habitat for Humanity of Greater Lafayette (Habitat) provides newly constructed, energy-efficient homes to low- and moderate-income households. 2. The Habitat program utilizes HOME Investment Partnership (HOME) funding for some of their builds. 3. Habitat will receive up to $52,500 of HOME funding for construction materials and related construction costs at 214 Ellsworth. 4. Sarah McGlothlin is the head of household of the partner family selected in December 2022 to work toward the purchase of a home. She was matched with 214 Ellsworth in 2023 and is expected to receive HOME down payment assistance in the form of equity in the property at the time of purchase. 5. Ms. McGlothlin began providing cleaning services at a Habitat-owned facility in November 2023 and receives a small amount of income from those services. 6. The Lafayette Housing Authority became aware of the real or perceived conflict of interest on May 29, 2024, and will submit this disclosure and request for an exception to HUD. 7. The McGlothlin household is an eligible household in the income range intended to be served with HOME funding and will not receive more HOME assistance than is necessary to purchase the home. 8. Ms. McGlothlin has not been otherwise employed by Habitat or involved in a decision-making capacity related to the homebuyer program at Habitat. 9. Ms. McGlothlin has not been employed by the Lafayette Housing Authority or otherwise involved in a decision-making position related to the HOME program. 10. Ms. McGlothlin received no special consideration over other partner families in the selection of 214 Ellsworth or receipt of the HOME assistance provided to the property. 11. 24 CFR 92.356 requires the public disclosure of this real or perceived conflict of interest. Mrs. Oakley stated that no action is required from the Board. Board of Public Works and Safety June 18, 2024 Page 3 Legal Counsel Resolution 05-2024 A Resolution Authorizing the Transfers of Certain Property Owned by the City of West Lafayette, Indiana to the City of Lafayette, Indiana Ms. Chosnek presented to the Board and recommended approval of Resolution 05-2024 A Resolution Authorizing the Transfers of Certain Property Owned by the City of West Lafayette, Indiana to the City of Lafayette, Indiana. This resolution will move the title of the trailer from the City of West Lafayette to the City of Lafayette. This trailer has been in the possession of the Lafayette Fire Department for nearly 20 years. Ms. Chosnek stated that the City of West Lafayette has approved a resolution authorizing transferring the title to the City of Lafayette. Mr. Shriner moved for approval. Mr. Rody seconded. Passed. Water Works Supplemental Agreement #3-Co. Rd. 430 South Water Tower (Wea Ridge Water Tower) with Butler, Fairman, and Seufert Steve Moore, Water Works Superintendent, presented to the Board and recommended approval of Supplemental Agreement #3 for Co. Rd 430 South Water Tower (Wea Ridge Water Tower) with Butler, Fairman, and Seufert. Mr. Moore stated that this supplement extends the contract to September 1, 2024 and adds $21,000.00 to the original contract. Mr. Shriner moved for approval. Mr. Rody seconded. Passed. CLAIMS Jeremy Diehl, Controller, presented for Board approval of Claims in the amount of $5,998,191.03. Mrs. Murray asked if there were any further questions and there were none. Mr. Diehl stated that he would send the Board the current remaining outstanding balance for the Wea Ridge Water Tower Project. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. MISCELLANEOUS Special Event Request-Ankit Foundation Candlelight Tribute for Mental Health Awareness Pushpa Toppo, Event Representative, presented to the Board and recommended approval of a Special Event Request for Ankit Foundation Candlelight Tribute for Mental Health Awareness to be held on July 27th, 2024 from 4:00pm-10:00pm at Riehle Plaza, John T. Myers Bridge and the Big 4 Depot. Mrs. Moulton moved for approval. Mr. Shriner seconded. Passed. Special Event Request-Beer Across the Wabash Ken McCammon, Event Representative, presented to the Board and recommended approval of a Special Event Request for Beers Across the Wabash to be held on August 24th, 2024 from 8:00am-8:00pm on the John T. Myers Bridge. Mr. Cammon stated that this is a fundraiser for Food Finders Food Bank. Mr. Shriner moved for approval. Mrs. Moulton seconded. Passed. Board of Public Works and Safety June 18, 2024 Page 4 Special Event Request-Downtown Blues and Jazz Festival Mr. McCammon presented to the Board and recommended approval of a Special Event Request for the Downtown Blues and Jazz Festival to be held on July 20th, 2024 from 1:00pm-1:00am located on 5th Street from Columbia Street to Main Street. Mr. Rody moved for approval. Mrs. Moulton seconded. Passed Special Event Request-Destination Downtown Mrs. Murray presented to the Board and recommended approval of a Special Event Request for Destination Downtown to be held on June 28th, 2024 from 3:30pm-9:30pm on Main Street between 4th Street and 9th Street.
