MINUTES OF THE LAFAYETTE COMMON COUNCIL October 6, 2014 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday October 6, 2014 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Meyer called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Reynolds, Campbell, Brown, Ahlersmeyer, Weast-Williamson, Downing and Meyer. City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. Councilman Campbell moved to recess for a public hearing on Ordinance 2014-20 (An Ordinance for Additional Appropriation of Local Roads & Streets Fund 2014) Councilman Klinker seconded. No public comment was heard. Councilman Campbell moved to reconvene; Councilman Klinker seconded the motion and passed by unanimous voice vote. Councilman Campbell moved to approve the minutes of the September 8, 2014 Council Meeting, Councilwoman Weast-Williamson seconded. The motion passed by unanimous voice votes. There are no Claims, Petitions or Communications The Clerk stated the following reports are available in the City Clerk’s Office: Water Works Department Monthly-August Water Pollution Control Department Monthly-August Police Department Monthly-August Ordinances for Second Reading The Clerk read Ordinance 2014-20 (An Ordinance for An Additional Appropriation of Local Roads & Streets Fund 2014) by title only on second and final reading. Councilman Brown for passage, Councilwoman Ahlersmeyer seconded. Mike Jones, Controller spoke regarding the ordinance. Ordinance 2014-20 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2014-21 (An Ordinance to Amend Ordinance 2013-36 An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana for the Year 2014, Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on second and final reading. Councilman Campbell moved for passage, Councilman Reynolds seconded. Jenny Leshney, City engineer and Claudine Laufman, Parks superintendent spoke regarding the changes in their departments which reflects the change in the ordinance. Lloyd Wells 3717 Rawlings Dr. inquired about the job responsibilities of the engineering positions. Ordinance 2014-21 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading The Clerk read Ordinance 2014-22 (an Ordinance Fixing the Salaries of the Elected Officials of the City of Lafayette, Indiana for the Year 2015) by title only on first reading. Councilman Heide moved for passage, Councilman Downing seconded. Mayor Roswarski gave a brief overview of all of the salary ordinances, which includes a 2% raise for all employees. Councilman Klinker questioned if this would cover any increases for employee health premium increases. The Mayor responded he believed it would. Perry Barbee, 3700 Redbud spoke in opposition to the raises for elected officials. Ordinance 2014-22 passed 7-1 on a roll call vote on first reading. Ayes: Klinker, Heide, Reynolds, Campbell, Ahlersmeyer, Weast-Williamson and Downing. Nays: Brown The Clerk read Ordinance 2014-23 (an Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana, for the Year 2015, Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on first reading. Councilman Campbell moved for passage, Councilman Reynolds seconded. Earl Stanton 1013 Elizabeth Street questioned if the city considered giving larger pay increases for the police and fire departments. The Mayor stated a few years ago those departments were all re-evaluated and given salary increases. Ordinance 2014-23 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2014-24 (an Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments of the City of Lafayette, Indiana for the Year 2015) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Ordinance 2014-24 passed 7-0-1, Councilwoman Weast- Williamson abstained on a roll call vote on first reading. Ayes: Klinker, Heide, Reynolds, Campbell, Brown, Ahlersmeyer, and Downing. Abstention: Weast-Williamson The Clerk read Ordinance 2014-25 (2015 Budget Ordinance, An Ordinance Appropriating Money for the Purpose of Defraying the Expenses of Several Departments of the City Government of the City of Lafayette, Indiana for the Fiscal Year Beginning January 1, 2015 and Ending December 31, 2015, Including the Outstanding Claims and Obligations and Fixing a Time When the Same Shall Take Effect) by title only on first reading. Councilman Klinker moved for passage, Councilman Heide seconded. Mayor Roswarski explained the zero based budgeting process and gave the following budget increase of approximately 4.6% he stated would probably change after the final review of insurance numbers have been established. Ordinance 2014-25 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2014-26 (2015 GLPTC Budget, An Ordinance Appropriating Money for the Greater Lafayette Public Transportation Corporation as Required Pursuant to Indiana Code 6-1.1-17-20) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilwoman Ahlersmeyer seconded. Mike Jones, controller explained why the council has to review the Citybus budget. John Metzinger, City bus stated their proposed budget is an increase of 4% for 2015. President Meyer requested Citybus considers expanding service to the hospital areas. Earl Stanton, 1013 Elizabeth questioned if the late night bus service would be continuing. Mr. Metzinger assured him that service is not in danger of being discontinued. Ordinance 2014-26 passed 8-0 on a roll call vote on first reading. Councilman Downing moved for a Special Council Meeting on the above salary and budget ordinances 2014-22 through 2014-26 for second and final reading on Monday October 27, 2014 at 5:00 pm, Councilwoman Weast-Williamson seconded. The motion passed by unanimous voice vote. The Clerk read Ordinance 2014-27 (An Ordinance Re-codifying Title 10-Animals and Making Changes to Address Appeal Procedures, Repeat Offenders and Free-Roaming and Feral Cat Population in the City of Lafayette) by title only on first reading. Councilman Campbell moved for passage, Councilman Reynolds seconded. Mayor Roswarski spoke regarding the changes Ed Chosnek, attorney explained the changes and why they were needed. Lt Scott McCoy explained how this would assist the animal control officers and pet owners in resolving issues more quickly. Josh Klumpe spoke about the nuisance/dangerous animal agreement. Ordinance 2014-27 passed 8-0 on a roll call vote on first reading. Councilwoman Ahlersmeyer requested a meeting of the Public Health, Welfare and Safety committee on Monday October 20, 2014 at 6:00 pm in the Council Chamber to allow further discussion and public input on Ordinance 2014-27. The Clerk read Ordinance 2014-28 (An Ordinance to Amend Section 3.05.020 and Section 3.05.040 of the Lafayette Municipal Code Pertaining to Open Burning) by title only on first reading. Councilman Klinker moved for passage, Councilman Heide seconded. Richard Doyle, Fire Chief stated this ordinance is to allow the Fire Department to extinguish open burning fire as deemed necessary. Ordinance 2014-28 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2014-29 (An Amendment to Ordinance No. 2010-04 Inclusion of Certain Property in the Local Centennial Historic District in the City of Lafayette, Indiana) by title only on first reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Daniel Walker, Economic Development spoke regarding the ordinance. Michael Hunt, 602 North 5th Street spoke in support of the Ordinance. Ordinance 2014-29 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2014-30 (An Amendment to Ordinance No. 2010-11 Establishing a Local Walnut Street Historic District in the City of Lafayette, Indiana) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Daniel Walker, Economic Development spoke regarding the ordinance. Ordinance 2014-30 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2014-31 (An Amendment to Ordinance No. 2010-11 Establishing a Local Lower Lincoln Historic District in the City of Lafayette, Indiana) by title only on first reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Daniel Walker, Economic Development spoke regarding the ordinance. Ordinance 2014-31 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2014-32 (An Amendment to Ordinance No. 2010-11 Establishing a Local Hart Historic District in the City of Lafayette, Indiana) by title only on first reading. Councilman Klinker moved for passage, Councilman Heide seconded. Daniel Walker, Economic Development spoke regarding the ordinance. Ordinance 2014-32 passed 8-0 on a roll call vote on first reading. Resolutions Resolution 2014-11 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application by Tate and Lyle Ingredients Americas, LLC for Property Tax Abatement-Tate and Lyle Ingredients Americas, LLC Phase I) by title only on first and final reading. Councilman Campbell moved for passage, Councilman Reynolds seconded. Mayor Roswarski spoke in support of the abatement. Chris Olsen, Tate & Lyle spoke regarding the planned expansion which would retain the current employment of 214 jobs and add 8 jobs with Phase 2. Resolution 2014-11 passed 8-0 on a roll call vote on first and final reading. Councilman Campbell moved to set a public hearing for Monday November 3, 2014 at 7:01 PM, Councilman Klinker seconded. The motion passed by unanimous voice vote. Resolution 2014-12 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application by James Investments LLC DBA Lafayette Auto Supply for Property Tax Abatement-James Investments LLC DBA Lafayette Auto Supply) by title only on first and final reading. Councilman Reynolds moved for passage, Councilwoman Weast- Williamson seconded. Mayor Roswarski spoke in support of the abatement. Ron Klinker, Lafayette Auto Supply explained their planned expansion to a new location at 1501 Kepner Dr. Resolution 2014-12 passed 8-0 on a roll call vote on first and final reading. Councilman Campbell moved to set a public hearing for Monday November 3, 2014 at 7:02 PM, Councilman Klinker seconded. The motion passed by unanimous voice vote. There were no Reports of Standing Committees. There were no Reports of Special Committees. There was no Report by the Mayor: Miscellaneous or New Business: President Meyer stated there would be a 2015 Budget workshop on Monday October 20th at 5:00pm in the Council Chamber There were no Reports by Council. Public Comment: Earl Stanton, 1013 Elizabeth St asked about Duke Energy substations. The Mayor responded we do not have any knowledge of that. Councilman Campbell moved to adjourn, Councilman Heide seconded.
