MINUTES OF THE LAFAYETTE COMMON COUNCIL OCTOBER 5, 2015 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday October 5, 2015 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Ahlersmeyer called the meeting to order. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Nargi, Reynolds, Campbell, Brown, Weast-Williamson, Downing and Ahlersmeyer. City Clerk Cindy Murray and City Attorney Ed Chosnek were present. Councilman Campbell moved to recess for a public hearing on Ordinance 2015-22 (An Ordinance to Vacate an Alley in the City of Lafayette) Councilman Brown seconded. No public comment was heard. Councilman Campbell moved to reconvene the regular meeting, Councilman Brown seconded. The motion passed by unanimous voice vote. Councilman Campbell moved to approve the minutes of the September 8, 2015 Council Meeting, Councilwoman Weast-Williamson seconded. The motion passed by unanimous voice vote. There are no Claims, Petitions or Communications The Clerk stated the following reports are available in the City Clerk’s Office: Fleet Maintenance Department Monthly-August Water Pollution Control Department Monthly-August Water Works Department Monthly-August Police Department Monthly-August Ordinances for Second Reading: The Clerk read Ordinance 2015-21 (An Amendment to Ordinance No 85-12, as Last Amended by Ordinance 2012-32. Concerning Charges for Sewerage Services) by title only on second and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Brad Talley Water Pollution Control Superintendents spoke regarding the rate for local manufacturing. Ordinance 2015-21 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2015-22 (Ordinance to Vacate an Alley in the City of Lafayette, Indiana) by title only on second and final reading. Councilwoman Nargi moved for passage, Councilman Reynolds seconded. Mayor Roswarski spoke in support of the project. Ed Chosnek City Attorney spoke regarding the Food Finders planned project. Ordinance 2015-22 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2015-23 (An Amendment to Ordinance No. 2010-11 Establishing A Local Historic Centennial Neighborhood Kemmer Historic District in the City of Lafayette, Indiana) by title only on second and final reading. Councilman Brown moved for passage, Councilwoman Weast- Williamson seconded. Elizabeth Mork gave a brief history on the property and the Kemmer History. Ordinance 2015-23 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance 2015-24 (2016 GLPTC Budget, An Ordinance Appropriating Money for The Greater Lafayette Public Transportation Corporation as Required Pursuant to Indiana Code 6-1.1-17-20) by title only on first reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Marty Sennett, Director of City Bus, spoke regarding the GLPTC budget. Ordinance 2015-24 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2015-25 (An Ordinance Fixing the Salaries of the Elected Officials of the City of Lafayette, Indiana for the Year 2016) by title only on first reading. Councilman Brown moved for passage, Councilman Downing seconded. Mayor Roswarski spoke regarding the next three Ordinances that pertain to the 2016 Budget. Perry Barbee, 3700 Redbud spoke in opposition for the increase of elected officials. Ordinance 2015-25 passed 7-1 on a roll call vote on first reading. Ayes: Heide, Klinker, Nargi, Reynolds, Campbell, Weast-Williamson and Downing Nay: Brown The Clerk read Ordinance 2015-26 (An Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments of the City of Lafayette, Indiana for the Year 2016) by title only on first reading. Councilman Klinker moved for passage, Councilman Heide seconded. Ordinance 2015-26 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2015-27 (An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana, for the Year 2016, Excluding the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Department.) by title only on first reading. Councilwoman moved for passage, Councilman Reynolds seconded. Ordinance 2015-27 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2015-28 (2016 Budget Ordinance, An Ordinance Appropriating Money for the Purpose of Defraying the Expenses of Several Departments of the City Government of the City of Lafayette, Indiana for the Fiscal Year Beginning January 1, 2016 and Ending December 31, 2016, Including the Outstanding Claims and Obligations and Fixing a time when the same Shall take Effect) by title only on first reading. Councilman Brown moved for passage, Councilwoman Weast-Williamson seconded. Mike Jones, Controller spoke regarding the budget which includes a 3% raise for all employees along with increased Health insurance rates. Mayor Roswarski spoke regarding the budget and how each of the departments have watched their budgets and been very good stewards of their finances. The biggest priority of this budget is Safety driven with more officers. Mayor Roswarski mentioned that there is still some amending to do to the budget which will take place in the next few weeks. Perry Barbee, 3700 Redbud complimented the employees and was concerned that we had enough officers. Mayor Roswarski addressed his questions. Duane Moffitt complimented the city on the recycling program and law officers on their work. Lloyd Wells, 3717 Rawlings Drive, complimented the city on creating new jobs and keeping the budget under control. Ordinance 2015-28 passed 8-0 on a roll call vote on first reading. Councilman Campbell moved to set a Special Council Meeting on Wednesday October 21, 2015 @5:00PM for second reading and final adoption of Ordinances 2015-24, 2015-25, 2015-26, 2015-27 and 2015-28 Councilman Brown seconded. The motion passed by unanimous voice vote. The Clerk read Ordinance 2015-29 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, To Rezone Certain Real Estate From MRU to NBU) Colonel 1916 LLC,-2800 Ferry Street by title only on first and final reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Jackson Bogan, 3312 Cedar Lane petitioner, spoke regarding the planned use of the location. Ordinance 2015-29 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2015-30 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana) UZO Amendment #85. Councilman Brown moved for passage, Councilman Campbell seconded. Ed Chosnek, Attorney stated this was to provide a bill board free zone of 2000 feet to the New Hoosier Heartland Corridor, the New US 231and the Scenic Byway on St Rd. 43. Ordinance 2015-30 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2015-31 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana) UZO Amendment #86 by title only on first and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Mr. Chosnek stated this was a parking change for West Lafayette only. Ordinance 2015-31 passed 8-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution 2015-19 (A Resolution Approving A Waiver of Noncompliance and Deduction for Tax Abatement In An Economic Revitalization Area (ERA) Subject to Final Public Hearing) Nanshan American Advanced Aluminum Technologies, LLC by title only on first and final reading. Councilman Downing moved for passage, Councilman Weast-Williamson seconded. Mayor Roswarski spoke in support of the Waiver. Jeff Stringer, General Manager for Nanshan spoke regarding the request. Resolution 2015-19 passed 8-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees. There were no Reports of Special Committees. There was no Report by the Mayor: There was no Miscellaneous or New Business. Reports by Council: Councilman Reynolds invited everyone to attend the Lafayette Fire Prevention Show at Jefferson High School on Wednesday October 7, 2015 at 7:00 PM Councilman Campbell congratulated Councilman Reynolds on his recent marriage. Public Comment: Bill Miller, 8143 Old St Rd 43 updated the council on the Stone Quarry in Americas Councilman Campbell moved to adjourn, Councilman Brown seconded.
