MINUTES OF THE LAFAYETTE COMMON COUNCIL June 5, 2017 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on June 5, 2017 at 6:30 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Nargi called the meeting to order at 6:30pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Campbell, Reynolds, Brown, Weast-Williamson, Downing and Nargi Absent: Ahlersmeyer City Clerk Cindy Murray and City Attorney Ed Chosnek were present. Councilman Campbell moved to recess for a public hearing on Resolution 2017-08 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA)- Lafayette Bank & Trust as Trustee for Edith Flannigan Trust) , Councilman Reynolds seconded. No public comment was heard. Councilman Campbell moved to reconvene the regular meeting, Councilman Reynolds seconded. Motion passed by unanimous voice vote. Councilman Campbell moved to approve the minutes of the May 1, 2017 Council Meeting, Councilman Reynolds seconded. Motion passed on a unanimous voice vote. Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Fleet Maintenance Department Monthly-April Water Pollution Control Department Monthly-April Water Works Department Monthly-April Police Department-April Ordinances for Second Reading: The Clerk read Ordinance 2017-21 (An Ordinance Creating A Lafayette Bicycle and Pedestrian Citizen Advisory Committee) by title only on second and final reading. Councilman Brown moved for passage, Councilwoman Weast-Williamson seconded. Margy Deverall, Economic Development spoke regarding the Ordinance. Ordinance 2017-21 passed 7-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance 2017-22 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from GB to R3-2921 Beck Lane, Zachary Cavanaugh, Petitioner) by title only on first and final reading. Councilman Heide moved for passage, Councilman Klinker seconded. Zachary Cavanaugh, Petitioner spoke regarding the Ordinance. Ordinance 2017-22 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2017-23 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from NBU to CB-201,205 and 207 South 4th Street- Brownstone Development, LLC, Petitioner) by title only on first and final reading. Councilman Reynolds moved for passage, Councilman Campbell seconded. Mayor Roswarski spoke in support of the Ordinance. Chris Shelmon, Gutwein Law spoke regarding the planned use for the property. Susan Shecter, 1001 Ferry St questioned if historic preservation requirements would be followed for this project. Ed Chosnek, City Attorney responded that the plan would have to be approved by Area Plan Commission prior start of to any project, this Ordinance is for rezoning of the area only. Discussion ensued with Council members. Ordinance 2017-23 passed 6-1on a roll call vote as follows on first and final reading. Yay: Heide, Klinker, Reynolds, Brown Weast-Williamson, Downing Nays: Campbell The Clerk read Ordinance 2017-24 (An Ordinance to Amend The Subdivision Ordinance of Tippecanoe County, Indiana-USO Amendment #10) by title only on first and final reading. Councilman Downing moved for passage, Councilman Brown seconded. Ed Chosnek, City Attorney spoke regarding the Ordinance. Ordinance 2017-24 passed 7-0 on a roll call vote on first and final reading. Resolutions The Clerk read Resolution 2017-12 (A Resolution Declaring The Designation of Certain Real Estate As An Economic Revitalization Area (ERA)-Approving the Application for Property Tax Abatement-Castle Coch I, LLC, Real Estate) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Reynolds seconded. Mayor Roswarski spoke in support of the Ordinance. Mark Castell, Marketing Manager spoke regarding the planned expansion. Resolution 2017-12 passed 7-0 on a roll call vote on first and final reading. Councilman Campbell moved to set a public hearing for Resolution 2017-12 on Monday, July 10, 2017 at 6:31 PM, Councilman Brown seconded. Motion passed by unanimous voice vote The Clerk read Resolution 2017-13 (A Resolution Confirming the Designation of Certain Real Estate as an Economic Revitalization Area (ERA)-Lafayette Bank & Trust as Trustee for Edith Flannigan) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Mayor Roswarski spoke regarding the Resolution. Susan Shecter, 1001 Ferry Street spoke regarding the Resolution. Resolution 2017-13 passed 7-0 on a roll call vote on first and final reading. There were Reports of Standing Committees There were no Reports of Special Committees. Miscellaneous or New Business: Tim Clary, Deputy Controller updated Council on Investment Policy Update and Results-1st Quarter 2017. President Nargi stated the Council will need to review the companies as listed on the Memo from the Redevelopment Commission and then vote on them in groups by voice vote. John Collier, Assistant Director Economic Development Department stated all companies have been reviewed and found to be in substantial compliance and recommended them for approval. The Lafayette City Council found the following business and industries to be in substantial compliance by individual unanimous voice vote. Alcoa/Arconic 2012 Real Estate Alcoa/Arconic 2012 Personal Property Councilman Campbell moved to find Alcoa/Arconic in substantial compliance, Councilwoman Weast-Williamson seconded. Councilman Campbell moved to remove Resolution 2017-09 for consideration, Councilman Reynolds seconded. Motion passed by unanimous voice vote. Councilman Brown moved Resolution 2017-09 be withdrawn at the request of the petitioner, Councilwoman Weast Williamson seconded. Motion passed by unanimous voice vote. Councilman Campbell moved to adjourn, Councilman Klinker seconded.
