MINUTES OF THE LAFAYETTE COMMON COUNCIL SEPTEMBER 3, 2019 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Tuesday, September 3, 2019 at 6:30 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 6:30pm. The Pledge of Allegiance was given to the flag of our Country by the Boy Scouts of America Troop 322. Present: Heide, Nargi, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell Absent: Klinker City Clerk Cindy Murray and City Attorney Ed Chosnek were present Councilman Downing moved to recess for a public hearing on Ordinance 2019-22 (An Ordinance Vacating A Public Alley and Utility Easement in the City of Lafayette, Indiana), Councilwoman Weast-Williamson seconded. No public comment was heard. Councilman Downing moved to reconvene the regular meeting, Councilman Brown seconded. Motion passed by unanimous voice vote. Councilman Reynolds moved to approve the minutes of the August 5, 2019 council meeting. Councilwoman Nargi seconded. Motion passed by unanimous voice vote. There were no Disposal of Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Water Works Department Monthly- July Renew Department Monthly- July Fleet Maintenance Monthly-July Lafayette Police Department 2018 Annual Report and Monthly July 2019 No Ordinances for Second Reading Ordinances for First Reading: The Clerk read Ordinance 2019-22 (An Ordinance Vacating A Public Alley and Utility Easement in the City of Lafayette, Indiana) by title only on first reading. Councilman Reynolds moved for passage, Councilwoman Nargi seconded. Dan Teder, Attorney for the petitioner spoke regarding the ordinance. Ordinance 2019-22 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2019-23 (An Ordinance Vacating A Portion of an Easement in Twyckenham Commercial Subdivision) by title only on first reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Joe Bumbleburg, Attorney for the petitioner spoke regarding the ordinance. Ordinance 2019-23 passed 7-0 on a roll call vote on first reading Councilman Reynolds moved to set at public hearing for Ordinance 2019-23 for October 7, 2019 at 6:31pm, Councilman Downing seconded. Motion passed by unanimous voice vote. The Clerk read Ordinance 2019-24 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from R1U to NBU-808 Wabash Avenue, Habitat for Humanity, Petitioner) by title only on first and final reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Dan Teder, Attorney for the petitioner spoke regarding the ordinance. Ordinance 2019-24 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2019-25 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from NB to R1U-2409 Kossuth Street-Alec Williams, Petitioner) by title only on first and final reading. Councilman Downing moved for passage, Councilwoman Nargi seconded. Alec Williams, petitioner spoke regarding the ordinance. Ordinance 2019-25 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2019-26 (An Ordinance Adding New Section 13.01.180 “Building Permit Conflict of Interest” to the Lafayette Municipal Code) by title only on first reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Ed Chosnek, City Attorney spoke regarding the Ordinance. Ordinance 2019-26 passed 7-0 on a roll call vote on first reading. Resolutions: Resolution 2019-15 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement-ASW Real Estate LLC, Real Estate) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Andrew Wilcox, Owner ASW Real Estate and Industrial Engineering gave a brief presentation on the Company. Resolution 2019-15 passed 7-0 on a roll call vote on first and final reading. Councilman Brown moved to set at public hearing for Resolution 2019-15 for October 7, 2019 at 6:32pm, Councilwoman Weast-Williamson seconded. Motion passed by unanimous voice vote. No Reports of Standing Committees. No Reports of Special Committees. No Report by the Mayor. Report by the Council: Councilman Brown moved to set a public hearing for Proposed Local Income Tax Ordinance for October 7, 2019 at 6:33 PM, Councilwoman Ahlersmeyer seconded. Motion passed by unanimous voice vote. Councilwoman Ahlersmeyer moved to set a public hearing for The City of Lafayette 2020 Budget and GLPTC Budget for October 10th at 5:00 PM, Councilwoman Weast-Williamson seconded Motion passed by unanimous voice vote. No Miscellaneous or New Business. Public Comment: Kari Nuske, 3148 Eaglesway Dr. spoke regarding the need for a Rent Control Ordinance. Alma Gibson, 3122 Eaglesway Dr. spoke in support of a Rent Control Ordinance President Campbell requested a meeting of the Public Health, Welfare and Safety Committee to evaluate the need for Rent Control Ordinance. Councilman Heide moved to adjourn, Councilman Reynolds seconded. Meeting was adjourned at 7:12 PM.
