MINUTES OF THE LAFAYETTE COMMON COUNCIL OCTOBER 7, 2019 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday, October 7, 2019 at 6:30 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 6:30pm. The Pledge of Allegiance was given to the flag of our Country. Present: Heide, Klinker, Nargi, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell City Clerk Cindy Murray and City Attorney Ed Chosnek were present Councilman Heide moved to recess for a public hearing, Councilman Klinker seconded. The Clerk read Ordinance 2019-23 (An Ordinance Vacating A Portion of an Easement in Twyckenham Commercial Subdivision) and no public comment was heard. The Clerk read Resolution 2019-15 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement-ASW Real Estate LLC, Real Estate) and no public comment was heard. The Clerk read Resolution 2019-18 (Resolution to Cast the Votes of the Lafayette Common Council in Favor of Tippecanoe County Income Tax Council Ordinance to Add Public Safety to Add Public Safety Allocation Rate to Local Income Tax Rate) and Kirk Freeman, Hedgewood Dr., spoke in opposition of the Resolution, no other public comment was heard. Councilman Klinker moved to reconvene the regular meeting, Councilwoman Nargi seconded. Motion passed by unanimous voice vote. Councilman Brown moved to approve the minutes of the September 3, 2019 council meeting. Councilwoman Weast Williamson seconded. Motion passed by unanimous voice vote. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Dan Teder, Attorney for the petitioner spoke regarding the ordinance. Ordinance 2019-22 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2019-23 (An Ordinance Vacating A Portion of an Easement in Twyckenham Commercial Subdivision) by title only on second and final reading. Councilwoman Nargi moved for passage, Councilman Reynolds seconded. Sara Wyatt, Attorney for the petitioner spoke regarding the ordinance. Ordinance 2019-23 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2019-26 (An Ordinance Adding New Section 13.01.180 “Building Permit Conflict of Interest” to the Lafayette Municipal Code) by title only on second and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Brown seconded. Ed Chosnek, City Attorney spoke regarding the Ordinance. Ordinance 2019-26 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance 2019-27 (2020 GLPTC Budget-An Ordinance Appropriating Money For the Greater Lafayette Public Transportation Corporation as Required Pursuant to Indiana Code 6-1.1-17-20) by title only on first reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Marty Sennett, General Manager CityBus spoke regarding the Ordinance 2019-27 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2019-28 (2020 Budget Ordinance-An Ordinance Appropriating Money for the Purpose of Defraying the Expenses of Several Departments of the City Government of the City of Lafayette, Indiana For the Fiscal Year Beginning January 1, 2020 and Ending December 31, 2020, Including the Outstanding Claims and Obligations and Fixing A Time When the Same Shall Take Effect) by title only on first reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Mayor Roswarski spoke regarding the budget process. Tim Clary, Controller spoke regarding the changes to the 2020 budget including a 3% raise for the Civilian and Appointed Officers and 3.2% for Police and Fire. Ordinance 2019-28 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2019-29 (An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana, for the Year 2020, Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Mayor Roswarski spoke regarding the Ordinance. Ordinance 2019-29 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2019-30 (An Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments of the City of Lafayette, Indiana for the Year 2020) by title only on first reading. Councilman Downing moved for passage, Councilman Heide seconded. Ordinance 2019-30 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2019-31(An Ordinance Fixing the Salaries of the Elected Officials of the City of Lafayette, Indiana for the Year 2020) by title only on first reading. Councilman Heide moved for passage, Councilman Klinker seconded. Mayor Roswarski spoke regarding the Ordinance. Ordinance 2019-31 passed 7-1 on a roll call vote as follows on first reading. Ayes: Heide, Klinker, Nargi, Reynolds, Ahlersmeyer, Weast-Williamson and Downing Nays: Brown Resolutions: Resolution 2019-16 (A Resolution Confirming the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement-ASW Real Estate LLC, Real Estate) by title only on first and final reading. Resolution 2019-17 (A Resolution Approving A Deduction for Tax Abatement in an Economic Revitalization Area (ERA)-Engineering and Industrial Services LLC-Personal Property) by title only on first and final reading. Councilman Reynolds moved for passage, Councilman Heide seconded. Dennis Carson, Economic Development Director spoke regarding the Resolution. Resolution 2019-17 passed 8-0 on a roll call vote on first and final reading. Resolution 2019-18 (Resolution to Cast the Votes of the Lafayette Common Council in Favor of Tippecanoe County Income Tax Council Ordinance to Add Public Safety Allocation Rate to Local Income Tax Rate) by title only on first and final reading. The Clerk stated she had received a letter of support from the following agencies: Patrick Flannelly, Lafayette Police Chief, Troy Harris, West Lafayette Police Chief, Bob Goldsmith, Tippecanoe County Sheriff, Patrick Harrington, Tippecanoe County Prosecutor and Jason Huber, Executive Director, Community Corrections. Councilwoman Nargi moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski thanked the Tippecanoe County Council Members in attendance for their support. Mayor Roswarski spoke regarding the importance of this Resolution. Richard Doyle, Fire Chief gave a brief presentation of the expenses associated with the Fire Department and their need for training and equipment. Patrick Flannelly, Police Chief spoke in support of the Resolution. Susan Schechter, 1001 Ferry Street supported the Resolution. 2019-18 passed 8-0 on a roll call vote on first and final reading. No Reports of Standing Committees. No Reports of Special Committees. No Report by the Mayor. No Miscellaneous or New Business Report by the Council: Councilman Reynolds encouraged everyone to attend the Annual Lafayette Fire Safety Show at Sunnyside School. There was no Public Comment. Councilman Heide moved to adjourn, Councilman Klinker seconded. Meeting was adjourned at 7:40 PM.
