MINUTES OF THE LAFAYETTE COMMON COUNCIL April 5, 2021 REGULAR MEETING (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session Monday, April 5, 2021 at 6:00 pm. President Weast-Williamson called the meeting to order at 6:00 pm. The Pledge of Allegiance was given to the flag of our Country. Present: Nargi, Reynolds, Campbell, Brown, Ahlersmeyer, Downing and Weast-Williamson Absent: Heide and Klinker City Clerk Cindy Murray and City Attorney Jacque Chosnek were present. Jacque Chosnek was sworn in as the new City Attorney. Mayor Roswarski thanked Ed Chosnek for his years as the City Attorney and praised all that the city has been able to accomplish with his assistance. Mr. Chosnek will continue to serve as the city’s Deputy Attorney. Mayor Roswarski presented a certificate of appreciation to Dennis Ray Smith of Rea Magnet for his life saving efforts during a crisis with a coworker. Councilman Campbell moved to recess for a public hearing on Ordinance 2021-13 (An Ordinance to Vacate a Portion of the Public Right-of-way in the City of Lafayette, Indiana-Colfax Street) and Resolution No. 2021-05 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement-Mulhaupts, Inc.,- Personal Property. Councilman Brown seconded. No public comment was heard. Councilman Campbell moved to approve the minutes of the March 1, 2021 council meeting, Councilwoman Brown seconded. Motion passed by unanimous voice vote. The Clerk read Ordinance 2021-09 (An Ordinance Amending the Lafayette Municipal Code Pertaining to Sewer Service and Wastewater Control in the City of Lafayette by Amending Sections of Chapter 6.01, 6.03, and 6.04) by title only on second and final reading. Councilman Downing moved for passage, Councilwoman Ahlersmeyer seconded. Brian Beeler, Lafayette Renew spoke regarding the ordinance. Ordinance No. 2021-09 passed 6-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2021-10 (An Ordinance Adopting a New Chapter to the Lafayette Municipal Code Chapter 4.17 Parklets/Streateries) by title only on second and final reading. Ordinance No. 2021-10 passed 6-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2021-12 (Ordinance Authorizing the City of Lafayette Indiana, to Issue its Taxable Economic Development Revenue and Refunding Revenue Bonds and Approving and Authorizing Other Actions in Respect Thereto) by title only on second and final reading. Councilman Brown moved for passage, Councilman Downing seconded. Mayor Roswarski spoke in support of the project. Ordinance No 2021-12 passed 6-0 on a roll call vote on second and final reading. Mr. Munden also noted the petitioner will be paying the city $2,160.00 the assessed value of the property. Ordinance No 2021-13 passed 6-0 on a roll call vote on second and final reading. Ordinance No. 2021-18 passed 6-0 on a roll call vote on first reading. The Clerk read Ordinance No. 2021-19 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from GB & I3 to PDRS-Concord Partners South, LLC, Petitioner-Southwest Corner of the Intersection of Maple Point Drive and Sagamore Parkway) by title only on first and final reading. Councilman Downing moved for passage, Councilwoman Ahlersmeyer seconded. Tyler Ochs, attorney for the petitioner spoke regarding the planned use of the PD. Ordinance No. 2021-19 passed 6-0 on a roll call vote on first and final reading. The Clerk read Ordinance No. 2021-20 (2021 Sewage Revenue Bond Ordinance-An Ordinance authorizing the acquisition, construction, installation and equipping by the City of Lafayette, Indiana of certain improvements and extensions to the sewage works of the City; authorizing the issuance and sale of sewage works revenue bonds for such purpose; providing for the collection, segregation and distribution of the revenues of the sewage works and the safeguarding of the interests of the owners of said sewage works revenue bonds; other matters connected therewith; and repealing ordinances inconsistent herewith) by title only on first reading. Councilwoman Nargi moved for passage, Councilman Reynolds seconded. Collin Cochran, Bond Council spoke regarding the bonding process. Mayor Roswarski thanked Brad Talley, Superintendent Lafayette Renew and his team for their works on the CSO and other projects. Because of their efforts this bond will not require a rate increase. Ordinance No. 2021-20 passed 6-0 on a roll call vote on first reading. Resolutions: The Clerk read Resolution No. 2021-07 (A Resolution Confirming the Designation of Certain Real Estate as and Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement- Mulhaupts, Inc.-Personal Property) by title only on first and final reading. Councilman Campbell moved for passage, Councilman Brown seconded. Dennis Carson, Director Economic Development spoke regarding the project. Resolution No. 2021-07 passed 6-0 on a roll call vote on first and final reading. The Clerk read Resolution No. 2021-08 (A Resolution Authorizing the Collection of Entrepreneur and Enterprise District Participation Fees) by title only on first and final reading. Resolution No. 2021-08 passed 6-0 on a roll call vote on first and final reading. The Clerk read Resolution No. 2021-11 (A Resolution of the Lafayette Common Council Approving Amendments to Taxpayer Agreements) by title only on first and final reading.
