MINUTES OF THE LAFAYETTE COMMON COUNCIL May 3, 2021 REGULAR MEETING (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session Monday, May 3, 2021 at 6:00 pm. President Weast-Williamson called the meeting to order at 6:00 pm. The Pledge of Allegiance was given to the flag of our Country. Present: Heide, Nargi, Reynolds, Brown, Downing and Weast-Williamson Absent: Klinker, Campbell and Ahlersmeyer City Clerk Cindy Murray and City Attorney Jacque Chosnek were present. Councilman Reynolds moved to recess for a public hearing on Ordinance 2021-14 (An Ordinance to Vacate a Portion of the Public Right-of-way in the City of Lafayette, Indiana) and Resolution No. 2021- 10 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement-Whitenack & Brothers, LLC.,-Real Estate. Councilwoman Nargi seconded. No public comment was heard. Councilman Reynolds moved to reconvene the meeting, Councilman Brown seconded. Motion passed by unanimous voice vote. Councilman Downing moved to approve the minutes of the April 5, 2021 council meeting, Councilman Brown seconded. Motion passed by unanimous voice vote. The Clerk read Ordinance No. 2021-15 (An Amendment to Ordinance No. 2010-11 Establishing A Local Perrin/518 Perrin Avenue Historic District in the City of Lafayette, Indiana) by title only on second and final reading. Councilman Downing moved for passage, Councilman Brown seconded. John Collier, Economic Development spoke regarding the ordinance. Ordinance No. 2021-15 passed 5-0 on a roll call vote on second and final reading. The Clerk read Ordinance No. 2021-16 (An Amendment to Ordinance No. 2010-11 Establishing A Local Centennial/Wells-TAF Historic District in the City of Lafayette, Indiana) by title only on second and final reading. Ordinance No. 2021-17 passed 5-0 on a roll call vote on second and final reading. The Clerk read Ordinance No. 2021-18 (An Amendment to Ordinance No. 2010-11 Establishing A Local Jefferson/Brown Street Methodist Historic District in the City of Lafayette, Indiana) by title only on second and final reading. Councilwoman Nargi moved for passage, Councilman Reynolds seconded. John Collier, Economic Development spoke regarding the ordinance. Ordinance No. 2021-18 passed 5-0 on a roll call vote on second and final reading. The Clerk read Ordinance No. 2021-20 (2021 Sewage Revenue Bond Ordinance-An Ordinance authorizing the acquisition, construction, installation and equipping by the City of Lafayette, Indiana of certain improvements and extensions to the sewage works of the City; authorizing the issuance and sale of sewage works revenue bonds for such purpose; providing for the collection, segregation and distribution of the revenues of the sewage works and the safeguarding of the interests of the owners of said sewage works revenue bonds; other matters connected therewith; and repealing ordinances inconsistent herewith) by title only on second and final reading. Councilman Reynolds moved for passage, Councilwoman Nargi seconded. Brad Talley, Superintendent Lafayette Renew, gave a brief explanation of the projects and funds saved. Mayor Roswarski thanked Brad Talley, Superintendent Lafayette Renew and his team for their work on the projects and because of their efforts this bond will not require a rate increase. Ordinance No. 2021-20 passed 5-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance No. 2021-21 (An Ordinance For Appropriation of Local Option Highway User Tax Funds (County Wheel Tax Fund #2490)) by title only on first reading. Councilman Downing moved for passage, Councilman Brown seconded. Mayor Roswarski spoke regarding the ordinance and the anticipated road repairs. Ordinance No. 2021-21 passed 5-0 on a roll call vote on first reading Councilman Brown moved to set a public hearing for Ordinance No. 2021-21 on Monday, June 7, 2021 @ 6:01 PM, Councilwoman Nargi seconded. Motion passed by unanimous voice vote. The Clerk read Ordinance No. 2021-22 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate From R1 to PDRS-Northwest Corner of the Intersection of McCarty Lane and Veterans Memorial Parkway East (Precedent Flats Planned Development) Domo Development Company, Petitioner) by title only on first and final reading. Councilman Reynolds moved for passage, Councilwoman Nargi seconded. Dan Teder, attorney for the petitioner spoke regarding the proposed project. Ordinance No. 2021-22 passed 5-0 on a roll call vote on first and final reading. The Clerk read Ordinance No. 2021-23 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate From PDMX to PDMX- 619 N. 9th Street, Jeffersonian Planned Development-Lafayette Neighborhood Housing Services Inc., Petitioner) by title only on first and final reading. Councilman Brown moved for passage, Councilman Downing seconded. Kevin Riley, attorney for the petitioner spoke regarding the project. Ordinance No. 2021-22 passed 5-0 on a roll call vote on first and final reading. The Clerk read Ordinance No. 2021-24 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from I3 to GB- 2653 Duncan Road-IBuild Properties, LLC, Petitioner) by title only on first and final reading. Ordinance No. 2021-24 passed 5-0 on a roll call vote on first and final reading. The Clerk read Ordinance No. 2021-25 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate From FP, R3, I3, R2, R1, A, NB and GB to FP, GB, R1, NB, A and R3-Tippecanoe County Area Plan Commission, Petitioner) by title only on first and final reading. Cindy Murray, City Clerk noted a letter had been received from Tyler Ochs, attorney for Foxfire Apartments regarding this ordinance. Ordinance No. 2021-25 passed 5-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution No. 2021-12 (A Resolution Approving A Deduction for Tax Abatement in an Economic Revitalization Area (ERA) Real Estate-Lifesong Properties, LLC) by title only on first and final reading. Councilman Reynolds moved for passage, Councilman Brown seconded. Dennis Carson, Director Economic Development spoke regarding the project. Cary Gutwein, Copper moon Coffee updated council on the planned expansion of the company. Resolution No. 2021-12 passed 5-0 on a roll call vote on first and final reading. The Clerk read Resolution No. 2021-13 (A Resolution Approving A Deduction for Tax Abatement in an Economic Revitalization Area (ERA) Real Estate-Lifesong Brands, Inc. DBA Copper Moon Coffee LLC- Personal Property) by title only on first and final reading. Councilman Downing moved for passage, Councilman Brown seconded. Dennis Carson, Director Economic Development spoke regarding the project. Resolution No. 2021-13 passed 5-0 on a roll call vote on first and final reading. The Clerk read Resolution No. 2021-14 (A Resolution Confirming the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approval of an Application for Property Tax Abatement- Whitenack & Brothers, LLC-Real Estate) by title only on first and final reading.
