MINUTES OF THE LAFAYETTE COMMON COUNCIL MAY 2, 2022 REGULAR MEETING (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session Monday, May 2, 2022 at 6:00 pm. President Brown called the meeting to order at 6:00 pm. The Pledge of Allegiance was given to the flag of our Country. Present: Klinker, Nargi, Snyder, Reynolds, Hession Weiss, Weast-Williamson, Downing and Brown Absent: Ahlersmeyer City Clerk Cindy Murray and City Attorney Jacque Chosnek were present. Councilman Klinker moved to recess for a public hearing on Ordinance 2022-09 (An Ordinance to Vacate Easements in the City of Lafayette, Indiana Legal Description-J-S-D Lots III, IV and Remaining Un-platted Land). Councilman Snyder seconded. No public comment was heard. Councilman Klinker moved to reconvene, Councilwoman Weast-Williamson seconded. Motion passed by unanimous voice vote. Councilwoman Hession Weiss moved to approve the minutes of the April 4, 2022 and April 19, 2022 council meetings, Councilman Snyder seconded. Motion passed by unanimous voice vote. Councilwoman Hession Weiss moved for passage, Councilman Reynolds seconded. Jacque Chosnek, City Attorney spoke regarding changes to several definitions in the ordinance including loading zones, abandoned vehicles, yard parking, allowed parking signage, citations for exceeded time parking and multiple other changes. Ordinance 2022-11 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-12 (An Ordinance Adding New Chapter 8.09-Temporary Dumpster and Portable Storage Device Within Public Right-of-Way) by title only on first reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Ordinance 2022-13 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-14 (An to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from R1 to R1B-2334 Powderhouse Lane and Walker Court, Tippecanoe Land Holdings, Inc. C/O Habitat for Humanity) by title only on first and final reading. Councilwoman Hession Weiss moved for passage, Councilman Reynolds seconded. Kevin Riley, attorney for the petitioner spoke regarding the ordinance. Ordinance 2022-14 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2022-15 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from NB to GB-1827 Schuyler Avenue, Amy Gaeta, Petitioner) by title only on first and final reading. Councilman Reynolds moved for passage, Councilwoman Nargi seconded. Amy Gaeta, petitioner, spoke to council regarding the plan to rent the space to an auto repair shop. Councilman Klinker asked if the neighborhood association had spoken regarding the rezone. Ms. Gaeta noted no citizens spoke at the Area Plan Meeting. Councilman Reynolds noted the Area Plan Commission was opposed to the rezone due to the lot size, it would be a non-conforming use. Councilman Reynolds also noted GB zoning would open the property to possible use not fitting for a neighborhood setting. General council discussion ensued. Ordinance 2022-15 failed 0-7 on a roll call vote on first and final reading. The Clerk read Ordinance 2022-16 (An to Amend the Zoning Ordinance of Tippecanoe County, Indiana, -UZO Amendment #103-A. Self-Storage Warehouses in Urbanized Areas) by title only on first and final reading. Councilman Reynolds moved for passage, Councilwoman Nargi seconded. Dennis Carson, Economic Development Director spoke regarding the need for changes to the current zoning. Jacque Chosnek, city attorney noted the ordinance language needs to include the following Section 1: Change UZO Section 3-2 Permitted Use Table by adding the following footnote to SIC 4225 “Self-storage Warehouse Business”: Footnote 72: Proposed self-storage warehouse businesses located in a zone where they are permitted by right, but on property within an urbanized, sewered area as shown on Appendix A, shall be required to obtain a special exception. Councilman Klinker moved to amend Ordinance 2022-16 with the Amended Ordinance 2022-16 Councilman Reynolds seconded. Amendment passed 7-0 on a roll call vote. Councilwoman Hession Weiss moved for passage of Ordinance 2022-16 (An Amended Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, - UZO Amendment #103-A. Self-Storage Warehouses in Urbanized Areas) Councilman Downing seconded. Amended Ordinance 2022-16 passed 7-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution 2022-10 (A Resolution Approving the First Amendment to the Agreement Between the City of Lafayette and Lafayette Arman Lodge #49, Fraternal Order of Police) by title only on first and final reading. Councilwoman Hession Weiss moved for passage, Councilwoman Weast-Williamson seconded. Scott Galloway, Police Chief spoke regarding the resolution. Chief Galloway noted this resolution is to allow newly hired and officers previously hired with years of experience with another Law Enforcement Agency to be given PTO based time that previously accrued. Resolution passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2022-11 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement-Fairfield Manufacturing Company, Inc.-Personal Property) by title only on first and final reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Dennis Carson, Economic Development Director spoke in support and introduced Chris Mixis, Director, Domestic Tax and C&I for Fairfield Manufacturing. Mr. Mixis spoke regarding planned expansion with approximately 50 new fulltime employees. Mayor Roswarski spoke in support of the resolution. Resolution 2022-11 passed 7-0 on a roll call vote on first and final reading. Councilwoman Hession Weiss moved to set a public hearing on Resolution 2022-11 for Monday, June 6, 2022 @ 6:02 PM, Councilman Klinker seconded. Motion passed by unanimous voice vote. The Clerk read Resolution 2022-12 (A Resolution To Approve the City of Lafayette Community Development Block Grant and the Lafayette Housing Consortium Home Program Annual Action Plan for 2022) by title only on first and final reading. Councilman Klinker moved for passage, Councilwoman Nargi seconded. Michelle Reynolds, Director, Lafayette Housing Authority spoke regarding the resolution. Miscellaneous or New Business: Margy Deverall, Bike Lafayette Member, updated the council on Bike month activities and several street updates for safer biking. Reports by the Council: Councilman Klinker recognized Brad Talley, Superintendent, Lafayette Renew for his recent 2022 Hoosier Resilience Hero Award. There was no Public Comment.
