MINUTES OF THE LAFAYETTE COMMON COUNCIL JUNE 6, 2022 REGULAR MEETING (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session Monday, June 6, 2022 at 6:00 pm. President Brown called the meeting to order at 6:00 pm. The Pledge of Allegiance was given to the flag of our Country. Present: Klinker, Nargi, Snyder, Reynolds, Hession Weiss, Ahlersmeyer, Weast-Williamson, Downing and Brown City Clerk Cindy Murray and City Attorney Jacque Chosnek were present. Councilwoman Hession Weiss moved to recess for a public hearing on Ordinance 2022-13 (An Ordinance for Additional Appropriation and for Transfer of Appropriations Between Major Budget Classifications in the Police Continuing Fund (Fund #2320)) and Resolution No. 2022-11 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement- Fairfield Manufacturing Company, Inc.-Personal Property) Councilman Klinker seconded. No public comment was heard. Councilman Klinker moved to reconvene, Councilwoman Nargi seconded. Motion passed by unanimous voice vote. Councilwoman Hession Weiss moved to approve the minutes of the May 2, 2022 council meetings, Councilman Snyder seconded. Motion passed by unanimous voice vote. There were no Disposal of Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Fleet Maintenance Department Monthly-March and April Renew Department Monthly-March and April Water Works Department Monthly-March and April Ordinances for Second Reading: The Clerk read Ordinance 2022-11 (An Ordinance to Amend Certain Sections of Chapter 7.06-Stopping, Standing and Parking) by title only on second and final reading. Councilwoman Hession Weiss moved for passage, Councilman Reynolds seconded. Jacque Chosnek, City Attorney spoke regarding changes to several definitions in the ordinance including loading zones, abandoned vehicles, yard parking, allowed parking signage, citations for exceeded time parking and multiple other changes. Ordinance 2022-11 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2022-12 (An Ordinance Adding New Chapter 8.09-Temporary Dumpster and Portable Storage Device Within Public Right-of-Way) by title only on second and final reading. Councilwoman Hession Weiss moved for passage, Councilwoman Weast-Williamson seconded. Jacque Chosnek, City attorney spoke regarding the ordinance. Ordinance 2022-12 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2022-13 (An Ordinance for Additional Appropriation and for Transfer of Appropriation Between Major Budget Classifications in the Police Continuing Education Fund (Fund#2320)) by title only on second and final reading. Scott Galloway, Police Chief noted the funds are used to purchase helmets and bulletproof vests that need updated every five years. Ordinance 2022-13 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance 2022-17 (An Ordinance Amending Chapter 1.02 of the Lafayette Municipal Code Pertaining to Ordinance Violation Bureau) by title only on first reading. Councilwoman Hession Weiss moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski explained this ordinance change will allow the Parking Operations Downtown Security Officer the ability to write citations for ordinance violations in the downtown area. Ordinance 2022-17 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-18 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from I3 to GB-3488 Thru 3524 Brady Lane, BET Rentals, LLC) by title only on first and final reading. Councilwoman Nargi moved for passage, Councilman Snyder seconded. Kevin Riley, attorney for the petitioner spoke regarding the ordinance. Ordinance 2022-18 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2022-19 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from NBU to R1U, 707 Wabash Avenue, Jasmine Jones, Petitioner) by title only on first and final reading. Councilwoman Hession Weiss moved for passage, Councilwoman Weast-Williamson seconded. Jim Olds, attorney for the petitioner spoke regarding the ordinance. Ordinance 2022-19 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2022-20 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, UZO Amendment #104) by title only on first and final reading. Councilwoman Nargi moved for passage, Councilman Snyder seconded. Jacque Chosnek, City Attorney noted this amendment was to add the “haven homes” to the ordinance. Ordinance 2022-20 passed 8-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution 2022-13 (A Resolution Confirming the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement-Fairfield Manufacturing Company, Inc.-Personal Property) by title only on first and final reading. Councilwoman Hession Weiss moved for passage, Councilman Snyder seconded. Mayor Roswarski spoke in support of the resolution. Resolution 2022-13 passed 8-0 on a roll call vote on first and final reading. The Clerk read Resolution 2022-14 (A Resolution Declaring Racism As A Public Health Crisis in the City of Lafayette, Indiana) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Reynolds seconded. Steven Smith, Chair of the Lafayette Human Relations Commission spoke about the need for this resolution and thanked the council for their support. Other members of the LHRC and the Tippecanoe Health Department were in attendance to support the resolution. Mayor Roswarski spoke in support of the resolution and affirmed the city’s commitment to working for changes. Resolution 2022-14 passed 8-0 on a roll call vote on first and final reading. The Clerk read Resolution 2022-15 (A Resolution of the City of Lafayette, Indiana, Approving the Issuance of Bonds and, If Necessary Bond Anticipation Notes of the City of Lafayette Redevelopment District) by title only on first and final reading. Councilwoman Nargi moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski spoke about the plan for the city’s Public Works Campus. The Mayor also noted the city utilizing cash on hand to keep bond at preferred borrowing level. Greg Balsano, Baker Tilly gave a short presentation of the process noting the amount financed would be $16,000,000 with the amount not to exceed $18,000,000. The closing date on the bonds will be July 12, 2022 with an estimated interest rate of 3.335% for 17 years. Councilman Klinker inquired what the planned use was for the old Street Department site after the new campus is completed. Mayor Roswarski noted the city plans to create an environmentally friendly Urban Park for the increased population that will be living downtown. Resolution 2022-15 passed 8-0 on a roll call vote on first and final reading. The Clerk read Resolution 2022-16 (A Resolution of The Lafayette Common Council Annual Tax Abatement Compliance) by title only on first and final reading. Councilwoman Hession Weiss moved for passage, Councilman Reynolds seconded. Dennis Carson, Economic Development Director noted all businesses had been reviewed by the Redevelopment Commission and found to be in substantial compliance.
