TIPPECANOE COUNTY LOCAL ENVIRONMENTAL RESPONSE FINANCING BOARD April 28, 2020 The Tippecanoe County Local Environmental Response Financing Board met on April 28, 2020 at 1:30 p.m. in the City Council Chambers of Lafayette City Hall. Present were: David Byers, Tony Roswarski, John Dennis and Zach Beasley. Absent: Kevin Underwood and Lon Heide Tony Benton, Attorney from Stuart & Branigin, was also present. MINUTES Mr. Roswarski moved to approve the minutes of the January 28, 2020 meeting as submitted. Mr. Beasley seconded. Motion carried. READING AND SIGNING OF CLAIMS The following Claims (all with attached documentation) were presented to the Board for payment:  A claim from Keramida Environmental for consulting services in the amount of $17,010.05. Mr. Dennis moved for approval. Mr. Beasley seconded. Motion carried.  A claim from Keramida Environmental for consulting services in the amount of $13,160.81. Mr. Dennis moved for approval. Mr. Beasley seconded. Motion carried  A claim from Keramida Environmental for consulting services in the amount of $43,400.86. Mr. Dennis moved for approval. Mr. Beasley seconded. Motion carried  A claim from Stuart & Branigin for services provided in the amount of $510.00. Mr. Dennis moved for approval. Mr. Beasley seconded. Motion carried  A claim from Stuart & Branigin for services provided in the amount of $2,070.00. Mr. Dennis moved for approval. Mr. Beasley seconded. Motion carried  A claim from Stuart & Branigin for services provided in the amount of $2,035.00. Mr. Dennis moved for approval. Mr. Beasley seconded. Motion carried  A claim from Waste Management for services provided in the amount of $11,516.42. Mr. Dennis moved for approval. Mr. Beasley seconded. Motion carried OLD BUSINESS There was none. NEW BUSINESS Resolution 2020-1 Mr. Benton stated that Resolution 2020-1 is the first step/stage in reusing the landfill with a new walk trail. Mr. Benton stated that Tippecanoe County Parks & Recreation Department (Parks Department) T.E.R.F. Board April 28, 2020 Page 2 wants to put the trail at the landfill site. Portions of the trail will be placed on the TERF Board property. Under the terms of the consent decree with EPA/IDEM, they have control and oversight for the time it takes to put the remedy in and 30 years of O&M. Mr. Benton stated that the TERF Board is about 20 some years in. Mr. Benton stated that Resolution 2020-01 is designed to assist the Parks Department in applying for grant money to build the trail. It is a resolution of approval and support. The resolution is also a delegation of authority from the TERF Board to the President and Secretary for an easement. Allen Nail, Tippecanoe County Parks Department, stated that the trail would encompass two (2) parcels of land totaling 500 lineal feet by 50 feet deep that was purchased from Fairfield Builders Supply. Mr. Nail stated that purposed trail would be 8 foot with a 2 foot shoulder on each side. Mr. Nail stated that VS Engineering has completed their preliminary design in terms of a purposed route/cross section. Final drawings of the trail will need to be complete prior to an easement being granted. Mr. Nail stated that the trail will be 1.6 miles long and travels all the way around the site. Discussion ensued. Mr. Roswarski moved to approve Resolution 2020-01. Mr. Dennis seconded. Motion Carried. REPORTS Keramida Vicki Keramida stated that everything is fine with the landfill. Keramida did replace the well that needed replaced back in February along with redeveloping a leachate well. Mrs. Keramida stated that there have been no methane exceedances and working well. Mrs. Keramida state that there was a storm that impacted the electrical system onsite and currently working with an electrician to fix that. Keramida met with EPA and IDEM along with Mr. Benton on February 20, 2020. Mrs. Keramida described that meeting as very confrontational between the EPA and IDEM regarding the delisting of the landfill. Mrs. Keramida stated that they have had 2 EPA approved 5-year reviews but now the new project manager, Frank Lagunas, is questioning everything that has been done in the past. Mrs. Keramida stated that Mr. Lagunas was unable to find any documents in the EPA files of the TERF Board landfill site that have been submitted for the last 30 years. IDEM offered to give him a copy of all those documents, he just had to ask. Keramida resent everything to the EPA from the past 30 years. After the meeting Keramida sent EPA the final response to their letter with all the information that they requested about the data etc. Now the EPA is questioning the background wells onsite. Mrs. Keramida stated that the background wells have been approved forever and is in the records from EPA guidelines. Mrs. Keramida stated that Mr. Lagunas feels very confident to delist everything but the groundwater. Mrs. Keramida told Mr. Lagunas that the groundwater is critical in the delisting and there is no reason for its exclusion. Mrs. Keramida recommended to the Board that they go through the delisting process to include the groundwater. Mrs. Keramida talked to the EPA about the purposed trail around the site, they are ok with the trail as long as they can see the drawings and design of the trail. Discussion ensued regarding the remedy and groundwater. PUBLIC COMMENT There was none. ADJOURN With no further business to come before the Board, Mr. Dennis moved to adjourn. Mr. Roswarski seconded.
