Kelsey Road - Elaine Warren; Interested in Being Annexed into the Village. 6. OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD ON NON-AGENDA ITEMS 7. CONSENT AGENDA Move to approve by omnibus vote items on the consent agenda. Illinois law permits municipalities to adopt by one single unanimous roll-call vote of the Board of Trustees and the Village President a group of designated ordinances, orders, resolutions, or motions placed together for voting purposes in a single group. Following the motion’s second, a brief discussion may be held about any designated item. If lengthier discussion or debate is needed, any Trustee or the Village President may request any item to be removed from the motion and those items will be considered during the regular course of the meeting as they appear on the agenda. All matters listed under Consent Agenda are considered to be routine by the Village Board and will be enacted by one motion in the form listed above. There will be no further discussion of these items. If discussion is desired, that item will be removed from Page 1 of 5 Consent Agenda and will be considered separately. A. CONSIDERATION OF AN ORDINANCE AMENDING THE VILLAGE OF LAKE BARRINGTON VILLAGE CODE; RE: TITLE 6, "PUBLIC WAYS AND PUBLIC PROPERTY": SECTION 6-3-11, "OWNER TO MAINTAIN PARKWAYS AND DITCH: CUTTING OF WEEDS AND GRASSES IN ADJACENT RIGHTS-OF- WAY"; TITLE 7, "BUILDING REGULATIONS": SECTION 7-3-8, "PROPERTY MAINTENANCE CODE ADOPTED"; AND TITLE 11, "TREES AND PLANTS": SECTION 11-3A-1, "WEEDS DECLARED A NUISANCE; HEIGHT RESTRICTION". Summary: This evening, an updated Ordinance is being presented regarding public ways and public property. The suggested changes include requiring the property owner to maintain the adjacent right-of-way between their property and the curb, or between the property and the edge of the street where there is no curb free from all weeds. The weeds may not be in height in excess of six inches. Recommended Action: Motion to approve Ordinance No. 2024-O-13, An Ordinance Amending the Village of Lake Barrington Village Code; Title 6, "Public Ways and Public Property": Section 6- 3-11, "Owner to Maintain Parkways and Ditch: Cutting of Weeds and Grasses in Adjacent Rights-of-Way", Title 7, "Building Regulations": Section 7-3-8, "Property Maintenance Code Adopted"; and Title 11, "Trees and Plants": Section 11-3A-1, "Weeds Declared a Nuisance; Height Restriction". B. PEPPER PARK FEST. Summary: The Barrington Area Chamber of Commerce (BACC) and the merchants in Pepper Park are working together on the 2nd Annual Pepper Park Fest that will be held on Saturday, September 21, 2024 from 11:00 a.m. to 3:00 p.m. New this year will be the centralization of the vendors to better facilitate the overall walkability of the event. Activities for the day include music, a food vendor, vendor booths and activities for the kids. Recommended Action: Motion to approve the Temporary Use - Special Event for Pepper Park Fest on Saturday, September 21, 2024. C. CONSIDERATION OF A RESOLUTION REGARDING CASH BOND FORFEITURES. Summary: Cash bonds may be forfeited to the Village if they have been unclaimed for two years. Notification was sent to the bond holders after two or more years of the Village holding onto their bonds. The bonds included in the Resolution have remained unclaimed after 30 days written notice was attempted via certified mail. Recommended Action: Motion to approve Resolution No. 2024-R-07, a Resolution for the Forfeiture of Cash Bond Deposit. D. CONSIDERATION OF AN ORDINANCE AMENDING THE LAKE BARRINGTON VILLAGE CODE; RE: SECTION 2-3-2, "DEFINITIONS", OF CHAPTER 3, "LIQUOR CONTROL AND TOBACCO REGULATIONS", OF TITLE Page 2 of 5  2, "BUSINESS AND LICENSE REGULATIONS", PARAGRAPH J, "CLASS K LICENSE", OF SECTION 2-3-6, "CLASSIFICATION OF LICENSES", OF CHAPTER 3, "LIQUOR CONTROL AND TOBACCO REGULATIONS", OF TITLE 2, "BUSINESS AND LICENSE REGULATIONS", PARAGRAPH X, "ALCOHOLIC LIQUOR", OF SECTION 6-1-2, "GENERAL PROVISIONS", OF CHAPTER 1, "USE OF VILLAGE PROPERTIES AND FACILITIES", OF TITLE 6, "PUBLIC WAYS AND PUBLIC PROPERTY". Summary: The Village is updating the Class K Liquor License, which is a special temporary liquor license for a special event or special use where alcoholic liquor is consumed on the premises and which will be held for community celebration, memorial, hospitality, fundraising, and/or similar purposes. The Class K Liquor License may not exceed four days in duration, except as otherwise approved by the Village Presidents acting as the Local Liquor Control Commissioner. Recommended Action: Motion to approve Ordinance No. 2024-O-15, an Ordinance Amending the Lake Barrington Village Code Section 2-3-2, "Definitions", of Chapter 3, "Liquor Control and Tobacco Regulations", of Title 2, "Business and License Regulations", Paragraph J, "Classification of Licenses", of Chapter 3, "Liquor Control and Tobacco Regulations", of Title 2, "Business and License Regulations", Paragraph X, "Alcoholic Liquor", of Section 6-1-2, "General Provisions", of Chapter 1, "Use of Village Properties and Facilities", of Title 6, "Public Ways and Public Property". E. CONSIDERATION OF A CLASS K LIQUOR LICENSE FOR KRH UNLIMITED INC. FOR THE BARN STOMP AND BREWS EVENT ON OCTOBER 5, 2024. Summary: The Barn Stomp and Brews event is being held on Saturday, October 5, 2024 from 4:00 p.m. to 8:00 p.m. at Freier Farm. New this year will be Kelsey Road House (KRH) selling food as well as beer and wine. The event will not be BYOB as it has been in the past several years. KRH will need to obtain a Class K Special Temporary Liquor License from the Village as well as a Special Use Permit Liquor License through the State of Illinois. Recommended Action: Motion to approve the Class K Liquor License for KRH Unlimited, Inc. for the Barn Stomp and Brews event on October 5, 2024. F. BARN STOMP AND BREWS. Summary: The Open Space and Special Events Committee led by Trustee Perkins and staff have planned the 2024 Barn Stomp and Brews event, which will take place on Saturday, October 5, 2024 from 4:00 - 8:00 p.m. Activities for the day inlclude No Filter band playing from 4:30 - 7:30 p.m. Barrington Rotary Bingo, a bags tournament, face painting, a bonfire, petting zoo, s'more kits for the kids, KRH serving food, an ice cream truck, games and a visit from Axle, the K9 from Lake County Sheriff's Department. Recommended Action: Motion to approve the Temporary Use-Special Event Application for the the Barn Stomp and Brews event at Freier Farm on October 5, 2024. G. CONSIDERATION OF GRANTING A SPECIAL USE PERMIT TO PERMIT THE ESTABLISHMENT, MAINTENANCE, AND OPERATION OF AN ILLUMINATED DIGITAL GROUND SIGN WITH CHANGING OR MOVING DISPLAY AND GRANTING VARIATIONS FROM TITLE 8, "ZONING", FOR THE PROPERTY AT 28662 W. Summary: At the August Plan Commission Zoning Board of Appeals meeting, a Public Hearing was held in consideration for a Special Use Permit to allow the installation of an illuminated ground sign with a digital changing or moving display and a height variation for the ground sign. Recommended Action: Motion to approve Ordinance No. 2024-O-16, An Ordinance Granting a Special Use Permit to Permit the Establishment, Maintenance, and Operation of an Illuminated Digital Ground Sign with Changing or Moving Display and Granting Variations from Title 8, "Zoning", for the Property at 28662 W.
