CALL TO ORDER Mayor Sheehy called the meeting to order at 6:00 p.m. 2. INVOCATION: Pastor Andrew Cave, Lamb of God Lutheran Church Pastor Andrew Cave with Lamb of God Lutheran Church gave the invocation. 3. PLEDGE OF ALLEGIANCE: Havasu Community Health Foundation Food Bank The Havasu Community Health Foundation Food Bank led in the Pledge of Allegiance. 4. ROLL CALL Present: 7- Mayor Cal Sheehy, Vice Mayor David Lane, Councilmember Jeni Coke, Councilmember Gordon Groat, Councilmember Michele Lin, Councilmember Donna McCoy and Councilmember Jim Dolan 5. CALL TO THE PUBLIC Ms. Holly Dove, resident, addressed the Council and extended an invitation to attend a breakfast meet and greet with Mark Kelly, United States Senate candidate, at the Quality Inn on September 20, 2019, at 8:00 a.m. Ms. Dove said he will be speaking about his vision for America and would like to hear from Lake Havasu City residents. She said Mr. Kelly would be continuing to Bullhead City and the City of Kingman later that day, and added that the Democratic Association of Lake Havasu is sponsoring Mr. Kelly’s visit. Ms. Betty Smith, resident, addressed the Council and said she resides in the Malibu community located on the island. Ms. Smith spoke concerning the transfer of ownership of the Grand Island Park to the residents on the island. She said approximately four years ago residents in the community felt the need to have gates installed at the entrances to their community. Ms. Smith said residents were told that due to the need for public access to the park, the City would not allow the gates to be closed during city park hours. She said this did not sit well with the president of the Home Owners Association (HOA) and the committee, and the City Manager and/or the Mayor at that time had a solution, which Lake Havasu City Page 1 Printed on 9/26/2019 City Council Minutes - Final September 10, 2019 was for the City to gift the park to the residents within the community. She said this left the residents in a state of disbelief. Ms. Smith said to date there has been no resolution on the status of the park and added that there are many residents within the community who are unhappy with the park proposal that was presented at an HOA meeting on September 6, 2019. She said the proposal included a pool near the current bathroom facilities and numerous walls. She said after speaking with the Parks and Recreation Department, she learned that the City has no plans of releasing the park and said the residents would like clarification on whether the City is transferring ownership of Grand Island Park to the residents on the island. 6. He stated that they use a variety of different engagements from a list that the Convention and Visitors Bureau has collected over the years, as well as incentives for new consumers to complete the survey. There was discussion regarding the increase in visitors and activity from other countries. 8. PUBLIC HEARINGS Lake Havasu City Page 3 Printed on 9/26/2019 City Council Minutes - Final September 10, 2019 8.1 ID 19-2134 Class “B” Bingo License Application, Veterans of Foreign Wars (VFW) Post 9401, 266 London Bridge Road (Kelly Williams) Ms. Williams advised that Mr. Dennis Dickey has applied for a Class “B” Bingo License for Veterans of Foreign Wars (VFW) Post 9401, located at 266 London Bridge Road, to conduct bingo games once a week on Fridays at 9:00 a.m. She noted that all fees have been paid, and no objections were received. Vice Mayor Lane asked if the games will be open to the public, to which Mr. Dennis Dickey, Quartermaster for VFW Post 9401, said at this time the games will be held for VFW members only but noted that they may be open to the public in the future. He said the purpose is to assist their veterans by giving them something to do, and while it is primarily for the veterans, they have an open door with the American Legion as well. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Dolan moved to recommend that the Arizona Department of Revenue approve a Class “B” Bingo License for the Veterans of Foreign Wars (VFW) Post 9401, seconded by Councilmember Groat, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Lane, Councilmember Coke, Councilmember Groat, Councilmember Lin, Councilmember McCoy and Councilmember Dolan 8.2 ID 19-2120 Series #10 Beer and Wine Store Liquor License, Kmart, 1870 McCulloch Boulevard/Wickenheisser (Kelly Williams) Ms. Williams advised that Mr. Ronald Albert Wickenheisser has applied for a Series #10 Beer and Wine Store Liquor License for Kmart, located at 1870 McCulloch Boulevard. Councilmember McCoy moved to recommend that the Arizona Department of Liquor Licenses & Control approve a Series #10 beer and wine store liquor license for Kmart, 1870 McCulloch Boulevard., seconded by Councilmember Coke, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Lane, Councilmember Coke, Councilmember Groat, Councilmember Lin, Councilmember McCoy and Councilmember Dolan Lake Havasu City Page 4 Printed on 9/26/2019 City Council Minutes - Final September 10, 2019 8.3 ID 19-2127 Introduce Ordinance No. 19-1221 Amending City Code Section 10.12.170, Commercial Vehicles on Residential Streets, Regarding Public Service and Public Safety Emergency Vehicles (Kelly Garry) City Attorney Kelly Garry addressed the Council and advised that a new state law went into effect that prohibits the City from restricting certain motor vehicles from being parked on a street including public service and public safety vehicles of a certain size. Ms. Garry said the statute contains additional specifications requiring the City Code to be amended allowing for these types of vehicles to be parked if they meet the statute. She noted that staff recommends introduction of this ordinance. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Coke moved to introduce Ordinance No. 19-1221 amending City Code Section 10.12.170, Commercial Vehicles on Residential Streets, seconded by Vice Mayor Lane, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Lane, Councilmember Coke, Councilmember Groat, Councilmember Lin, Councilmember McCoy and Councilmember Dolan 8.4 ID 19-2133 Adopt Ordinance No. 19-1220 Amending City Code Section 2.12.090, Elections - Scheduling, Regarding Primary Election Date (Kelly Williams) Ms. Williams advised that during the recent legislative session, Senate Bill (SB) 1154 passed into law moving the primary election date as one of the four consolidated election dates from the tenth Tuesday prior to the general election to the first Tuesday in August. She added that the bill also changes the candidate nomination filing period from 90-120 days to 120-150 days prior to the election. Ms. Williams said the new fall primary election date is August 4, 2020, and the general effective date of this bill was August 27, 2019. She noted that this ordinance was introduced at the last council meeting. Mayor Sheehy stated that with this change residents will see campaign signs up earlier and for longer, and noted that the general election date will remain the same. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember McCoy moved to adopt Ordinance No. 19-1220 amending City Code Section 2.12.090, Elections – Scheduling, seconded by Councilmember Dolan, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Lane, Councilmember Coke, Councilmember Groat, Councilmember Lin, Councilmember McCoy and Councilmember Dolan Lake Havasu City Page 5 Printed on 9/26/2019 City Council Minutes - Final September 10, 2019 8.5 ID 19-2125 Approve Sole Source Purchases of Wastewater Treatment Plant Parts from Schreiber, LLC (Mike Slettebo) Utility Supervisor Mike Slettebo addressed the Council and advised that this item is to approve a sole source purchase over $50,000 with Schreiber, LLC, the original manufacturers of the Island Treatment Plant (ITP) and the Mulberry Treatment Plant (MTP). Mr. Slettebo spoke about the rehabilitation on the MTP aeriation basin that was performed last year. He said the major expense is the diffusers, which are at the bottom of the basin, and add air and dissolved oxygen to the aeration basins. He noted that the MTP is a 1.6 million gallon basin, and the ITP is a 3.6 million gallon basin with a double bridge. Mr. Slettebo said the amount budgeted is $172,000, with $130,000 being used to replace the diffusers. He explained that basin parts typically wear out quickly due to continuous movement and rotation, and noted that the lifespan of the diffusers is approximately 24 to 30 months. Mr. Slettebo spoke about the damaged diffuser rack at the ITP and the repaired aeration basin. He explained that good aeration has good air saturation with small, fine bubbles versus large bubbles. Mayor Sheehy clarified that this is an approved expense in the current budget; however, in accordance with City Code, the Council must approve purchases over $50,000 with one vendor. Councilmember Groat asked about the negative impacts operationally without proper aeration, to which Mr. Slettebo explained that if there is a higher chemical demand and the equipment cannot produce enough air, it upsets the process and creates additional costs to the City. He said the fiscal impact is huge and can include additional electricity costs, staff time, and waste. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Vice Mayor Lane moved to approve the Sole Source aggregate of purchases exceeding $50,000 for FY 2019-20 for Wastewater Treatment Plant parts from Schreiber, LLC, seconded by Councilmember Groat, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Lane, Councilmember Coke, Councilmember Groat, Councilmember Lin, Councilmember McCoy and Councilmember Dolan Lake Havasu City Page 6 Printed on 9/26/2019 City Council Minutes - Final September 10, 2019 9.
