APPROVED VILLAGE OF LAKE ZURICH COMMITTEE OF THE WHOLE JANUARY 28, 2008 The meeting was called to order at 7:46 p.m. ROLL CALL: Present – President pro tem McAvoy, Trustees Branding, Callahan, Johnson, Poynton, and Taylor. Excused – Mayor Tolomei. Also present –Administrator Vitas, Village Attorney Browne, Finance Director Zochowski, Police Chief Urry, Fire Chief Mastandrea, Park and Recreation Director Perkins, Public Works Director/Engineer Heyden, and Building and Zoning Director Peterson. APPROVAL OF JANUARY 14, 2008 MINUTES: MOTION made by Trustee Taylor, seconded by Trustee Poynton, to approve the minutes of the January 14, 2008 Committee of the Whole as submitted. Voice vote, all in favor. MOTION CARRIED. RESOLUTION ENDORSING THE METROPOLITAN MAYORS CAUCUS GREENEST REGION COMPACT Recording Secretary McKay read the proposed resolution endorsing the Metropolitan Mayors Caucus Greenest Region Compact. MOTION was made by Trustee Taylor, seconded by Trustee Branding, to recommend the Board of Trustees approve the proposed resolution endorsing the Metropolitan Mayors Caucus Greenest Region Compact as read. AYES: 6 Trustees Branding, Callahan, Johnson, McAvoy, Poynton, and Taylor NAYS: 0 MOTION CARRIED MIONSKE POND STORMWATER COMPLAINCE UPDATE Public Works Director/Engineer Heyden prepared an information packet with a memorandum dated January 24, 2008, entitled Mionske Pond Storm Water Compliance Update. Staff is requesting Board direction on issues related to the Mionske Pond water quality issues including acceptance or denial of the $119,000 offer by the Illinois Department of Transportation (IDOT), approval to seek engineering consultant services to perform a hydraulic study of the storm sewer system between Mionske Pond and the lake of Lake Zurich, and direction on the final resolution to the Mionske Pond water quality issue on whether to dredge and restore the pond or develop a storm water bypass alternative. The Village must be in compliance with the NPDES General Permit and notify the USEPA of such before April 30, 2008 or request and receive an extension or they will be in violation of the USEPA order. Committee of the Whole Minutes, January 28, 2 Public Works Director/Engineer Heyden summarized the information in his memorandum and packet including a brief history, current status, future action, and staff recommendation and request for direction. He reviewed in detail Exhibit A, the Proposed Storm Water Sewer Improvement, and listed what may be contributing to the problems and presented possible solutions. In summary, Public Works Director/Engineer Heyden said he needed the hydraulic study of the storm sewer system to make accurate determinations. He estimates the study will cost between $40-70,000 based upon a proposal from Christopher B. Burke Engineering, Ltd. He requested the proposal from Burke because they have a reputation for being the best in drainage issues. A question and answer period followed. Public Works Director/Engineer Heyden further addressed the condition of Mionske Pond prior to the Route 22 bypass construction work performed by IDOT, the problems that occurred, and its current status. He addressed the level of the lake currently and historically, and reviewed the drainage system. Rich Sustich, 217 Sandy Point Lane, LZPOA president, recapped the unfortunate events related to Mionske Pond and said there have been improvements. He recommended a new technique to vacuum the pond into semi-permeable bags which will dewater the pond. He met with a contractor who visited the pond and estimated it will cost $30-40,000 to clean it up. Mr. Sustich disagreed with the information presented on the historical water level of the lake and said it was 843’ in the past per USGA map rather than 842 as Public Works Director/Engineer Heyden stated. He said the level was 844.54 and 843.68 in 1990 as measured by Assistant Village Engineer Lebbos and measured at 843.53 at the outlet structure. He provided background information about meetings held where the lake level was agreed upon by the LZPOA and the Village. Mr. Sustich said someone moved the stop logs and the water was higher than what had been agreed to. He asked that the Village meet with LZPOA and involve them in their discussions on Mionske Pond and the lake and asked that they be aggressive in dealing with IDOT regarding funds for solutions. Public Works Director/Engineer Heyden said a bathometric study in 1971 showed the lake level to be 841.91, and the new box culvert installed by IDOT is at 841.8 feet. Although he thought the bag dewatering proposal had merit, he said several acres to place the bags would be needed because there is 1500 cubic yards of sediment that needs to be removed. He was concerned the contractor was not aware of the full scope of the work. Discussion followed. Staff was directed to prepare requests for proposals so they could proceed on the hydraulic study, contact vendors regarding the dewatering bags, and to prepare a report with their recommendations when information became available. Public Works Director/ Engineer Heyden was asked to request proposals for the hydraulic study with responses back by Monday or as soon as possible. Administrator Vitas confirmed that staff will also follow up with negotiations with IDOT, will explore water quality grants, request an extension from the US EPA, and meet with LZPOA. Committee of the Whole Minutes, January 28, 3 OTHER BUSINESS: There will be a hearing at 10 a.m. on January 31, 2008, at the downtown Chicago Thompson Center on the proposed acquisition of the Elgin, Joliet, and Eastern Railway Company by Canadian National. Trustee McAvoy asked the public to contact him if they thought a petition campaign opposing the acquisition was a viable option.
