Constitution Week Proclamation Mayor Garrett read into the record the Proclamation from the Daughters of the Revolution designating the week of September 17th through September 23rd as Constitution Week. B. Eldorado Place Special Assessment District from 11 Mile to Meadowbrook Way Council was presented with a resolution to approve plans and an estimated cost for the paving of Eldorado Place and directed the Treasurer to make a Special Assessment Roll. Projected cost is $132,000 to $180,000 with a life span of 10 years. Anne Sousanis – House in the Woods comments. 9. Action Requests - For Consideration / Approval A. OHM Water Loss Investigation Phase II Proposal Mayor Pro Tem Kantor moved to approve the proposal for professional services with OHM to move into the second phase of the water loss investigation and authorize the City Administrator to sign the proposal in the amount, not to exceed $10,000, for OHM and $1,700 to SW Controls. Motion seconded by Councilmember Kenez. Pending approval work could begin within the next two to four weeks. Yes: Kenez, Miller, Garrett, Jennings, Kantor No: None Motion carried. B. Planning Commission Appointments Council was presented with 3 appointments for the Planning Commission for consideration. Councilmember Jennings moved to appoint Alicia Brown, Mark Dizik, and Les Stansbery to serve on the Lathrup Village Planning Commission, with terms ending on August 31, 2025. Motion seconded by Mayor Pro Tem Kantor. Yes: Miller, Garrett, Jennings, Kantor, Kenez No: None Motion carried. C. Ethics Ordinance – Schedule the first reading for October 17, 2022 Mayor Pro Tem Kantor moved to accept the Ethics Ordinance as written with changes and schedule the first reading for October 17, 2022. Changes proposed: the removal of Section 4-5 G. related to criminal investigations, addition of the word Document to the Council Rules and Procedures Document statement in Section 4-3H, and adding a sentence in Section 4.5 C to read, “turn any investigation over to the City Attorney if a complaint is against the City Administrator”. Motion seconded by Councilmember Jennings. Mayor Pro Tem Kantor moved to adopt the Council Rules and Procedures Document as written in the current packet with the addition of the statement Council shall make every effort to ask clarifying questions of staff prior to public meetings. Motion seconded by Councilmember Jennings. Yes: Kantor, Kenez, Garrett, Jennings No: Miller Motion carried. D. Eldorado SAD Mayor Pro Tem Kantor moved to approve the Special Assessment District and direct the Treasurer to prepare the tax roll and schedule a Public Hearing for October 17, 2022. Motion seconded by Councilmember Jennings. Councilmember Miller stated that she’s sympathetic yet concerned that there is just not enough funds to complete the project. Yes: Kenez, Garrett, Jennings, Kantor No: Miller Motion carried. 10. City Administrator Report Starting in October City Hall will remain open for lunch. Absentee ballots are being mailed out. 2 police cruisers have been delivered, with a plan is the sell the old cruisers. The Code Enforcement position is still open. Lead and Copper project; 239 excavations have been completed. Oakland County Road Commission has approved the process to install Hawk signals on Southfield Road. Lathrup has secured a $4,000 the DTE tree grant. 11. City Attorney Report None 12. Reports of Boards, Commissions, and Committees Planning Commission voted to update the ordinance for generators. A Public Hearing is scheduled for October 18, 2022, to discuss. Also, the Commission approved language for Impervious surface area standards. There will be a public hearing to discuss that as well. There is an Infrastructure Committee meeting on Thursday September 29th at 6:00 pm. 13. House in the Woods Property Jon Ruud gave a brief report on where the sale of the property stands to date. Mayor Pro Tem Kantor offered a compromise to the Councilmembers that voted no on the previous offer. There is a property at the Southwest corner of Lathrup Blvd and 11 Mile that is vacant, the Treasurer is in discussion with to the property owner about donating the property to the city. Mayor Pro Teem proposed to put $10,000 - $15,000 from the sell of the House in the Wood’s property towards the purchase of that property to turn it into a park. If that land is not available, then the $10,000 -$15,000 to fund the other parks around town. Mayor Pro Tem Kantor moved to amend the agenda to move the House in the Woods to Action Item E. and to return to Action Items. Motion seconded by Councilmember Jennings. Yes: Miller, Garrett, Kantor, Jennings, Kenez No: No Motion carried. Mayor Pro Tem Kantor moved to accept the offer for $150,000 for the sale of the House in the Woods property. Motion seconded by Councilmember Jennings. Yes: Kantor, Jennings No: Kenez, Miller, Garrett Motion denied. Councilmember Miller moved to accept the $155,00 offer for the sale of the House in the Woods property. Motion seconded by Councilmember Kenez. Yes: Miller, Garrett, Kenez No: Kantor, Jennings Motion denied. 14. Public Comment (speakers are limited to 3 minutes) Robert Bares - His submitted FOIA Roger Lynn - Would like to see Council make a decision regarding the sale of the House in the Woods property Lauren Bares – Thanked Council for diligence Dalton Barksdale – Disappointed at the SAD vote Peter Stephan – Thanked the volunteers for debris clean up, maintaining the old trees and as getting the tree grant. Mayor and Council Comments Mayor Garrett stated that Council should stay in this meeting until there is a resolution. Addressed the Eldorado Street neighbors and thanked them for getting together to help make the city a better place. Councilmember Jennings moved to revisit Item 9 E. on the agenda the House in the Woods vote. Motion seconded by Councilmember Miller. Yes: Garrett, Kantor, Jennings, Kenez, Miller No: No Motion carried. Councilmember Miller moved to accept the $155,000 offer from Mr. Ferguson. Motion seconded by Councilmember Jennings. Mayor Pro Tem Kantor stated that although he is sympathetic to Mr. Ferguson, he believes this is just not the right decision for the entire City. Yes: Jennings, Kenez, Miller, Garrett No: Kantor Motion carried. Continued Council Comments Councilmember Miller addressed Mr. Barksdale concerns. She also stated Mr. Ruud is Mr. Ferguson’s realtor, and was not involved. The Women’s Club wants to hold their Holiday Lunch in the Community Room and it will cost $600 that doesn’t seem fair because of their previous contributions. Council needs to enact a weight limit for trucks, they are going through damaging roads and trees, and cutting through the side streets. Councilmember Miller mentioned she has not received the information from the FOIA request. Mayor Pro Tem Kantor addressed Mr. Stephens concerns about the commercial property owners cleaning up their trash. He also stated that he would be willing to sit down with any resident and discuss the history of the road work. Adjourn Motion to adjourn.
