City Council Regular Meeting Draft Minutes Monday, November 28, 2022, at 7:30 PM 27400 Southfield Road, Lathrup Village, Michigan 48076 1. Call to Order by Mayor Garrett at 7:30 pm 2. Roll Call Present: Mayor Mykale Garrett Council members: Mayor Pro Tem Kantor, Councilmember Jennings, Councilmember Kenez, Councilmember Miller Also Present: City Administrator, Susan Montenegro, City Treasurer, Pamela Bratschi, DDA/CED Director Susan Stec, City Attorney, Scott Baker, City Clerk, Kelda London 3. Pledge of Allegiance 4. Approval of Agenda Motion by Councilmember Mayor Pro Tem Kantor to accept and file the audit for PY ending June 30, 2022. Motion seconded by Councilmember Miller. Yes: Jennings, Kantor, Kenez, Miller, Garrett No: None Motion carried 5. Presentations The Auditors from the firm Plante Moran gave a brief overview of and answered questions relating to the audit process and explained expenditures and revenue. Motion to accept and file the Fiscal Year 2021/2022 Audit as presented by Plante Moran. A. Annual Audit Report for Fiscal Year Ending 6/30/2022 6. Zoning Board of Appeals Variance application - 26727 Southfield Road 27400 Southfield Rd | Southfield, MI 48076 | 248.557.2600 | www.lathrupvillage.org Motion by Mayor Pro Tem Kantor to adjourn the City Council Meeting and convene as the Zoning Board of Appeals, motion seconded by Councilmember Jennings. Mayor Garrett called to order the Zoning Board of Appeals meeting at 8:23 pm. Roll Call Present: Zoning Board of Appeals Chair: Mykale Garrett Zoning Board of Appeals members: Kantor, Jennings, Kenez, Miller City Attorney Baker explained that the city has received a variance application for the sign at 26727 Southfield Road LV Petro LLC. The applicant needs to submit additional information for the ZBA to act on this request. There were no public comments on this issue currently. Board member Kantor moved to close the public hearing and reconvene this matter on December 19, 2022. Motion seconded by Board member Miller. Yes: Kenez, Miller, Garrett, Jennings, Kantor No: None Motion carried. Board member Miller moved to adjourn the Zoning Board of Appeals meeting, motion seconded by Board member Jennings. Zoning Board of Appeals meeting adjourned at 8:27 pm. Mayor Pro Tem Kantor moved to reopen the City Council meeting, seconded by Councilmember Jennings. Yes: Miller, Garrett, Jennings, Kantor, Kenez No: None Motion carried 7. Public Comment for Items on the Agenda (speakers are limited to 3 minutes) No public comments 8. Consent Agenda All items listed under “Consent Agenda” are considered to be routine and non-controversial by the City Council and will be approved by one motion. There will be no separate discussion. If a discussion is desired, that item(s) will be removed from the consent agenda and discussed separately immediately after consent agenda approval in its normal sequence on the regular agenda. A. September 2022 Southfield Fire Department Report Motion by Mayor Pro Tem Kantor to approve the consent agenda minus item A. Approval of Minutes and Item C. October 2022 Disbursement Report. Motion seconded by Councilmember Kenez. Yes: Miller, Garrett, Jennings, Kantor, Kenez No: None Motion carried. Councilmember questioned some of the actions in the minutes Councilmember Miller also questioned if there has been a discission on the billing back third parties for City Consultants time. City Attorney Baker suggested that Council investigate whether to act, but at this point there is no cost reimbursement. Mayor Garrett pointed out in the minutes of the October 17, 2022, meeting there needs to be a correction in the spelling, the correct spelling is Keenan. Mayor Pro Tem Kantor moved to approve the meeting minutes as corrected, motion seconded by Councilmember Miller. Yes: Garrett, Jennings, Kantor, Kenez, Miller No: None Motion carried. Motion by Councilmember Miller to approve the October 2022 Disbursement Report, motion seconded by Kenez. Ethics Ordinance - 2nd Reading 10. Action Requests - For Consideration / Approval A. Amendment of Code of Ordinances - Ethics Ordinance Attorney Baker stated that he has not received any additions or corrections from the first reading. Motion by Councilmember Mayor Pro Tem Kantor to approve the 2nd reading of the Ethics Ordinance. Motion seconded by Councilmember Jennings. Yes: Kantor, Kenez, Garrett, Jennings No: Miller Motion carried B. Interlocal Agreement with Oakland County for Designated Assessor Motion by Councilmember Miller to approve the revised Interlocal Agreement for Oakland County to Approve the Designated Assessor for the period January 1, 2023, through December 31, 2027, and authorize the Mayor and Clerk to sign the Interlocal Agreement where applicable. Motion seconded by Councilmember Kenez. Yes: Kenez, Miller, Garrett, Jennings, Kantor No: None Motion carried 11. City Administrator Report A. City Administrator Report Administrator Montenegro provided updates on upcoming council meeting dates and Holiday office hours. There has been an offer extended for the Code Enforcement position. There will also be RFP going out shortly one for the technology component for the Automatic Meter Read System. City Officials met with the Southfield Fire Department regarding water pressure. There will be more meetings on this issue and Administrator Montenegro will keep Council up to date. 12. Mayor and Council Comments Mayor Garrett the requested the form for the Administrator performance evaluation. Your Town Mayor requested an updated assess management plan. Mayor Pro Tem requested an update for the gun buyback program. It was done in October in conjunction with Southfield Police Department and the funds will be reimbursed from a grant. Miller pointed out that the Council packets are often over 300 pages and should be delivered to Council on the Thursday before the Monday meeting. Kenez questioned the cannabis ordinance update. Each person wishing to address the City Council shall be afforded one opportunity of up to three (3) minutes duration during the first and last occasion for citizen comments and one opportunity of up to three (3) minutes duration during each public hearing. Any person who violates this section shall be directed by the Mayor to be orderly andsilent. If a person addressing the Council refuses to become silent when so directed, such person may be deemed by the Mayor to have committed a "breach of the peace" by disrupting and impeding the orderly conduct of the public meeting of the City Council and may be ordered by the Mayor to leave the meeting.
