CITY OF LATHRUP VILLAGE CITY CONCIL MEETING MINUTES AUGUST 17, 2020 MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF LATHRUP VILLAGE HELD ON MONDAY, AUGUST 17, 2020 HELD REMOTELY VIA-ZOOM. The meeting was called to order at 7:03 p.m. by Mayor Garrett and Roll Call was taken. Present: Mayor Mykale Garrett and Mayor Pro Tem Bruce Kantor Council members Ian Ferguson, Donna Stallings Also Present: City Administrator, Dr. Sheryl L. Mitchell, Assist. City Administrator/Treasurer, Pamela Bratschi, City Attorney, Scott Baker, Police Chief, Scott McKee, Community and Economic Development Manager, Susie Stec, Government Operations, Kelda London and City Clerk, Yvette Talley Others Present: Cori Dahl, Recreation Intern, Meaghan Cuneo and Matthew Wojciechowski of Giffels Webster MAYOR INVITED ALL PRESENT TO JOIN IN THE PLEDGE OF ALLEGIANCE CO-20-127 CALL TO ORDER AND ROLL CALL Roll call was taken. Motion by Council member Stallings, seconded by Council member Ferguson to excuse Council member Saleem Siddiqi from this meeting. Yes: Ferguson, Garrett, Kantor, Stallings No: None Motion carried. CO-20-128 APPROVAL OF AGENDA Motion by Council member Stallings, seconded by Mayor Pro Tem Kantor to approve the Agenda and to remove the presentation of State Representative Kyra Harris Bolden. CONSENT AGENDA CO-20-129 Approval of Minutes – July 27, 2020 Study Session Motion by Mayor Pro Tem Kantor, seconded by Council member Stallings to approve the minutes for July 27, 2020 Study Session. CO-20-131 Approval of Minutes – August 3, 2020 – Study Session Meeting Motion Mayor Pro Tem Kantor, seconded by Council member Stallings to approve the minutes for August 3, 2020 Study Session Meeting with a correction. CO-20-132 APPROVAL OF DISBURSEMENT REPORTS AND YEAR END INVESTMENT REPORT Motion by Council member Stallings seconded by Mayor Pro Tem Kantor to approve the Monthly Disbursements for the month of July 2020 as: June Disbursements w/Salary Included FUND 101 GENERAL FUND $374,526.27 FUND 102 MAJOR ROADS $ 6,411.99 FUND 203 LOCAL ROADS $ 6,411.99 FUND 258 CAPITAL FUND $ - FUND 494 DOWNTOWN DEV AUTH $ 5,712.89 FUND 592 WATER & SEW. $ 56,409.27 $449,472.41 CO-20-133 CONSIDERATION OF A MOTION TO ACCEPT DEPARTMENTAL REPORTS Motion by Mayor Pro Tem Kantor, seconded by Council member Stallings to approve the Departmental Reports. CITY OF LATHRUP VILLAGE CITY CONCIL MEETING MINUTES AUGUST 17, 2020 CO-20-134 PRESENTATION NONE CO-20-135 PUBLIC COMMENT FOR ITEMS ON THE AGENDA NONE CO-20-136 PUBLIC HEARINGS – Recreation Master Plan Mayor Garrett opened the public hearing. Meaghan Cuneo and Matthew Wojciechowski of Giffels Webster gave an overview and answered specific questions. CO-20-137 ACTION REQUESTS - FOR CONSIDERATION/APPROVAL A. Consideration of A Resolution to Adopt the Recreation Master Plan 2021-2025 for the City of Lathrup Village Dr. Sheryl Mitchell gave an overview and answered specific questions. Motion by Mayor Pro Tem Kantor, seconded by Council member Ferguson to Adopt the Recreation Master Plan 2021-2025 for the City of Lathrup Village. Ayes: Ferguson, Garrett, Kantor, Stallings No: None Motion carried. B. Consideration of A Resolution to Adopt the Transportation Alternatives Program (TAP) Grant Award Motion by Council member Ferguson, seconded by Mayor Pro Tem Kantor accepting transportation alternatives program (TAP) grant award for the City of Lathrup Village wayfinding network project and authorize Mayor Garrett and City Clerk Talley to sign the negotiated contract. Ayes: Ferguson, Garrett, Kantor, Stallings No: None Motion carried. C. Resolution Approving Traffic Control Order Dr. Sheryl Mitchell gave an overview and answered specific questions. Contributing to the problem are the navigation systems such as Google, Waze, Map Quest and Apple Maps which are directing people to take Sunnybrook as an alternative route. Chief McKee as issued a Traffic Control Order requesting the installation of a No Thru Traffic sign there. Consideration to Approve the Oakland County Animal Shelter Services And Disposal Interlocal Agreement Dr. Sheryl Mitchell gave an overview and answered specific questions. Motion by Mayor Pro Tem Kantor, seconded by Council member Ferguson to Approve the Animal Shelter Services and Disposal Interlocal Agreement with Oakland County and authorize the Mayor and Clerk to sign the agreement. Consideration to Approve the Sanitary Retention Tank Emergency Repair Dr. Sheryl Mitchell gave an overview and answered specific questions. Motion by Mayor Pro Tem Kantor, seconded by Council member Ferguson to approve Sanitary Retention Tank Emergency Repair. Ayes: Ferguson, Garrett, Kantor, Stallings No: None Motion carried. F. Consideration of Second Reading And Adoption – An Ordinance To Amend Chapter 46, Miscellaneous Offenses, Provisions, Forfeitures And Penalties, Amending Article III, Offenses Against The Person, Sec. 46-81 Use And Sale of Fireworks And 46-82, Permit For Use And Sale of Fireworks Scott Baker gave an overview and answered specific questions. Motion by Council member Stallings, seconded by Mayor Pro Tem Kantor to Adopt An Ordinance To Amend Chapter 46, Miscellaneous Offenses, Provisions, Forfeitures And Penalties, Amending Article III, Offenses Against The Person, Sec. 46-81 Use And Sale of Fireworks And 46-82, Permit For Use And Sale of Fireworks. Ayes: Ferguson, Garrett, Kantor, Stallings No: None Motion carried. CITY OF LATHRUP VILLAGE CITY CONCIL MEETING MINUTES AUGUST 17, 2020 G. Consideration of the Second Reading And Adoption To Amend Chapter 18, Businesses, Adding Article VI, Marijuana Establishments, Sec. 18.281 Marijuana Establishments Prohibited, To Prohibit Marijuana Establishments Within the Boundaries of the City Pursuant To The Michigan Regulation And Taxation of Marihuana Act And To Provide Penalties For Violation Of This Ordinance Scott Baker gave an overview and answered specific questions. This will extend the sunset provision for an additional 12 months. Based on the findings of the marijuana sub-committee, the city has directed the City Attorney, City Planner and staff to prepare ordinances for different types and numbers of marijuana facilities within the city of Lathrup Village. Motion by Council member Stallings, seconded by Mayor Pro Tem Kantor to approve the Second Reading and Adoption of the Ordinance To Chapter 18, Businesses, Adding Article VI, Marijuana Establishments, Sec. 18.281 Marijuana Establishments Prohibited To Prohibit Marijuana Establishments Within the Boundaries of the City Pursuant To The Michigan Regulation And Taxation of Marihuana Act And To Provide Penalties For Violation Of This Ordinance. CO-20-138 CITY ADMINISTRATOR REPORT Dr. Mitchell reported: Due to the Labor Day Holiday - Next Study Session meeting will be September 14 and the City Council meeting will be September 28. Electronic copy of Your Town magazine is available and the hard copies are being mailed. Building upgrades taking place are – Community room kitchen cabinets/counter top which was included in the capital improvements plan, City Hall lobby is being painted, installation of ceiling tiles and LED lighting. Santa Barbara & Roseland watermain project is scheduled to begin soon, completed by October and notices have been mailed to residents. Congratulations to our Team member of the month -Officer Charles Becker. Congratulations to Dr. Mitchell she received the 2020 Community Builder award from the Michigan Municipal League. November 3 is General election day – be sure to complete and return your absentee voter applications to receive a ballot. Plante Moran is conducting City audit. Police department has started 3- month trial period working 12- hour shifts that will end early October. Police officer’s Business Agent has sent notification they are ready to start negotiations for Police and Command officer’s contracts. Public hearing recreation master plan was approved by City Council today. Anticipating that registration for parks will resume starting in September depending on the Orders received from the Governor and health department. We have two new interns Meaghan Menifee and Jordan Williams. Planning Commission meeting for August has been cancelled. Cori Dahl who was a Recreation department intern, is now on a paid internship working with the Downtown Development Authority and Recreation. Loving Lathrup Village had a good response of 12 applicants that will be reviewed by the DDA committee which provides opportunity for grant funding $500-$1500 for local businesses. Council member Ian Ferguson Southfield School Board update – there has been no response regarding the information requested from them. After the online learning is active, he will request another update. Council member Donna Stallings reported on SEMCOG – Webinar August 26 – Monitoring Development Trends for Communities throughout Southeast Michigan. Register for Parks finder. There have been several complaints regarding trash cans out in the open along with other trash in front yards. Council member Ferguson No update for marijuana committee. Brick wall installation(alley) - asked Code Enforcement to have bricks removed from the homeowner’s property.
