RECORD OF PROCEEDINGS; MINUTES OF THE VILLAGE OF LEWISBURG, OHIO, REGULAR COUNCIL MEETING AT 7:00 P.M., JULY 18, 2024, AT THE LEWISBURG COMMUNITY CENTER. The regular meeting of the Village of Lewisburg, Ohio Council was called to order at 7:00 P.M. by Mayor Dennis Roberts. ROLL CALL: Eliza Wagoner, Clerk of Council. PRESENT: Mayor Dennis Roberts, Council Members Marla Colville-Brown, Barb Foster, Mary Nelson, Lori Pheanis, Jackie Sewert, and Ted Thies. Also present were Municipal Manager Jeff Sewert, Fire & EMS Chief B.J. Sewert, Police Chief Rick McGee, Fiscal Officer Susan Laux, and Law Director Steve Hobbs. Motion to approve the minutes of the July 03, 2024, regular Village Council Meeting. First by Lori Pheanis. Second by Mary Nelson. Roll Call Vote: 7 Yes 0 No. Motion approved. Motion to approve the check disbursement report. First by Barb Foster. Second by Jackie Sewert. Roll Call Vote: 7 Yes 0 No. Motion approved. Motion to approve the purchase order report. First by Mary Nelson. Second by Lori Pheanis. Roll Call Vote: 7 Yes 0 No. Motion approved. CITIZENS: None. MAYOR: None. LEGAL: 1ST READING (Read by Steve Hobbs): A RESOLUTION AUTHORIZING ALL ACTIONS NECESSARY TO PERMIT OR DENY ADULT USE CANNABIS OPERATORS FROM DISPENSING ADULT USE MARIJUANA IN THE VILLAGE OF LEWISBURG PURSUANT TO SECTION 3780.25 OF THE OHIO REVISED CODE AND DIRECTING THE PREBLE COUNTY BOARD OF ELECTIONS TO SUBMIT A BALLOT QUESTION TO THE ELECTORS. Motion to waive the three-reading rule. First by Ted Thies. Second by Jackie Sewert. Roll Call Vote: 7 Yes 0 No. Motion approved. Motion to adopt Resolution No. 2024-11: A RESOLUTION AUTHORIZING ALL ACTIONS NECESSARY TO PERMIT OR DENY ADULT USE CANNABIS OPERATORS FROM DISPENSING ADULT USE MARIJUANA IN THE VILLAGE OF LEWISBURG PURSUANT TO SECTION 3780.25 OF THE OHIO REVISED CODE AND DIRECTING THE PREBLE COUNTY BOARD OF ELECTIONS TO SUBMIT A BALLOT QUESTION TO THE ELECTORS. Motion to adopt Ordinance No. 2024-09: ORDINANCE REPEALING AN ORDINANCE IMPOSING A MORATORIUM OF NINE MONTHS ON ADULT USE CANNIBIS OPERATORS WITHIN THE VILLAGE OF LEWISBURG AND DECLARING AN EMERGENCY. First by Ted Thies. Second by Mary Nelson. Roll Call Vote: 5 Yes 2 No (Lori Pheanis and Dennis Roberts). Motion approved. Motion to approve the ballot language of the proposed tax levy renewal as sent by the Preble County Board of Elections. First by Lori Pheanis. Second by Ted Thies. Roll Call Vote: 7 Yes 0 No. Motion approved. MUNICIPAL MANAGER: Chief McGee and Fiscal Officer Laux discussed the need for a 4th full- time police officer, 12-hour schedule, and where the funds would come from. Motion to authorize to advertise for a 4th full-time police officer position. First by Mary Nelson. Second by Barb Foster. Roll Call Vote: 7 Yes 0 No. Motion approved. Chief Sewert shared that they still haven’t found someone to fill the full-time Fire/EMS position. Fiscal Officer Laux shared what the salary would look like if the hourly rate for the position was changed from $20.00 to $22.50. Motion to re-advertise for this position and prepare a change to the salary ordinance changing the salary for this position to $22.50. First by Marla Colville-Brown. Second by Ted Thies. Roll Call Vote: 7 Yes 0 No. Motion approved. Manager Sewert shared that Daniel Douglas is leaving his position as the south plant wastewater operator. Manager Sewert along with Gary Wagner will be coving the mandatory requirements for this position until a replacement is found. Motion to schedule a Ways and Means Committee Meeting on Tuesday, July 23, 2024, at 5:30 P.M., at the Village Offices. First by Lori Pheanis. Second by Barb Foster. Roll Call Vote: 7 Yes 0 No. Motion approved. Manager Sewert gave updates on Cumberland Street House, ARPA money, downtown crosswalks, and electric aggregation with Palmer Energy. Motion to authorize the bidding for work on the South Wastewater Treatment Plant. First by Mary Nelson. Second by Lori Pheanis. Roll Call Vote: 7 Yes 0 No. Motion approved. Motion to recommend Wagner Paving to the county for the CBDG grant project on the Western Avenue Improvements Project. First by Ted Thies. Second by Barb Foster. Roll Call Vote: 7 Yes 0 No. Motion approved. 2 SAFETY: None. POLICE: None. LIBRARY: Barb Foster shared recent and upcoming news/events from the Library. PARK: Ted Thies shared that 2 trees need to be removed at the park, the Park Board would like to hold fish fries at the community center during lent to raise funds, and the Park Board still needs another member.
