eCity01 CITY OUNCIL MEETING TUESDAY, NOVEMBER 15, 2022 HELD IN-PERSON & REMOTELY 1cc 6:00 P.M. WORKSHOP DISCUSSION City officials who physically attended the workshop: Mayor Kaminskas, Mayor Pro Tern Folyer, Councilmembers Sahlberg, Dunne, Spencer, Van Orman, Cargill and Kurtz, Mark McAvoy, City Administrator, Lisa Key, Planning & Engineering Director, Kelsey Hardy, City Clerk, Darin Morgan, Police Lieutenant and Todd Henderson, IT Technician. City officials who remotely attended the workshop via Zoom: David Goehner, Communications Specialist, Jen Camp, Operations & Maintenance Director, David Williams, City Engineer, Kyle Dixon, Finance Director, Amy Mullerleile, Senior Planner, Jandy Humble, Library Director, Chris Johnston, Golf Pro, Zach Sherman, Derek Kosanke, Streets Lead, and Damon Simmons, Police Chief. 2022 Annual Comprehensive Plan and Development Code Amendments: Lisa Key, Director of Planning and Engineering presented an overview of the proposed amendments and reviewed the timeline of next steps in the process. Questions asked and answered. Mayor Kaminskas closed the workshop at 6:43 p.m. to allow a break before the regular session. REGULAR CITY COUNCIL MEETING SESSION INVOCATION: Given by Councilmember Dunne. PLEDGE OF ALLEGIANCE: Led by Mayor Kaminskas, City Council and City Staff. CALL TO ORDER: Mayor Kaminskas called the meeting to order at 7:01 p.m. ROLL CALL: City officials who physically attended the meeting: Mayor Kaminskas, Mayor Pro Tern Folyer, Councilmembers Sahlberg, Dunne, Spencer, Van Orman, Cargill and Kurtz, Mark McAvoy, City Administrator, Kelsey Hardy, City Clerk, Darin Morgan, Police Lieutenant and Todd Henderson, IT Technician. AGENDA APPROVAL: Mayor Pro Tern Folyer moved to approve the agenda as presented. Councilmember Van Orman seconded, which carried unanimously. CITIZEN COMMENTS: Mark Saba spoke regarding Winter Glow. ANNOUNCEMENTS I PROCLAMATIONS I SPECIAL PRESENTATIONS: No items at this time. REPORTS & INQUIRIES: City Council Meeting Minutes November 15, 2022 Page 1 of 4 City Council: Councilmember Cargill spoke regarding tie flag at Western State CAT. Councilmember Spencer spoke regarding Winter Glow and followed up on the Library Ordinance discussion. Councilmember Dunne reported on the ribbon cutting for the General Store. Mayor: Mayor Kaminskas reported on the General Store grand opening, Light Up Liberty Lake initiative, GSI Economic Forum, Valley Chamber Annual Update, and upcoming December meetings. Lastly, the mayor spoke regarding the follow up to the Library Ordinance discussion. City Administrator: Mark McAvoy, City Administrator reviewed upcoming events and reminders, and set the table for staff to provide updates. Mayor Kaminskas noted an upcoming fundraising event at the HUB. Kyle Dixon, Finance Director provided an update on the State Audit Exit Conference. Derek Kosanke, Streets Lead provided a snow removal update. David Williams, City Engineer provided an update on road projects. Lastly, Mark provided an update on the Legacy Church lease and the camping ordinance. Questions asked and answered throughout. Parks & Arts Commission: No report at this time. Salary Commission: Kyle Dixon, Finance Director, provided an update on today’s salary commission meeting and public hearing. Questions asked and answered. Liberty Lake Sewer & Water District: Kottayam Natarajan, Jr. provided an update regarding the leaf drop program, district information, upcoming rate increases, back flow prevention, leaf cleaning site cleanup, Harvard road lift station site cleanup, and fencing limitations for security and safety. WORKSHOP DISCUSSIONS: 2023 Proposed Budget: Mayor Kaminskas and council reviewed the proposed budget page by page beginning on page 97. Questions asked and answered. GENERAL BUSINESS Consent Agenda Mayor Pro Tem Folyer moved to approve the consent agenda as amended, item 1 OA was to approve the November 1st, 2022 city council meeting minutes, item lOB was to approve the November 15, 2022 vouchers and October payroll, benefits and quarterlies in the amount of $1,285,715.74. CouncilmemberSahlberg seconded, which carried unanimously. Action Items: Mayor Pro Tem Folyer moved to confirm the Mayor’s appointment of Kimball Bighorse as an adjunct member on the Planning Commission, with a term expiring on December 31, 2024. Councilmember Kurtz seconded, which carried unanimously. Mayor Pro Tern Folyer moved to approve the lease agreement with Bentgrass Public House, LLC at Trailhead Golf Course and authorize the mayor to execute the agreement. Councilmember Kurtz seconded, which carried unanimously. Mayor Pro Tern Folyer moved to approve the changes to the 2023 Proposed Budget as described in the agenda bill. Councilmember Kurtz seconded. Council then decided to approve each item on the agenda bill individually. Councilmember Dunne moved to approve item one on agenda bill 11 C. Councilmember Kurtz seconded, which carried unanimously. Mayor Pro Tern Folyer moved to approve item two on agenda bill 11 C. Councilmember Dunne seconded, which carried unanimously. Unanimous. Councilmember Spencer moved to approve item number four. Councilmember Sahlberg seconded, which carried unanimously. Councilmember Dunne moved to approve item number five. Councilmember Van Orman seconded, which carried unanimously. Councilmember Cargill moved to add the following language on page 25 of the budget, “It will be the goal of the City to set fees and user charges for each enterprise fund, such as the Golf Course, at a level that fully supports the total direct and indirect cost of the activity. The proposed rates shall also take into account debt service coverage commitments made by the City for the particular enterprise fund.” Councilmember Van Orman, which carried unanimously. COUNCIL COMMENTS: Mayor Pro Tem Folyer inquired about the status of the water tank for Consolidated Irrigation. Lisa Key, Director of Planning & Engineering provided an update. PUBLIC HEARINGS I APPEALS: No items at this time. RESOLUTIONS: No items at this time. ORDINANCES: 1st Read Ordinance No 290: The city clerk read, by title only, Ordinance No. 290, “An - Ordinance of the City of Liberty Lake, Washington, Adopting the 2023-2028 Capital Facilities Plan.” Mayor Kaminskas invited questions and comments. No comments were heard at this time. 1st Read Ordinance No 96B: The city clerk read, by title only, Ordinance No. 96B, “An - Ordinance of the City of Liberty Lake, Washington, Amending Ordinance No. 96A, Amending Solicitor and Peddler License Regulations for the City of Liberty Lake.” Mayor Kaminskas invited questions and comments. Brief discussion ensued with an amendment proposed to include in the second read. 1St Read Ordinance No 291: The city clerk read, by title only, Ordinance No. 291, “An - Ordinance of the City of Liberty Lake, Washington, Adopting a Budget for the Period January 1, 2023 through December 31, 2023, Appropriating Funds and Establishing Salary Schedules for Established Positions”. Mayor Kaminskas invited questions and comments. No comments were heard at this time. 2nd Read Ordinance No 289: The city clerk read, by title only, Ordinance No. 289, “An - Ordinance of the City of Liberty Lake, Washington, Levying the Regular Property Taxes for the City of Liberty Lake, Washington in Spokane County for the Year Commencing January 1, 2023 to Provide Revenue for the Provision of City Services as Set Forth in the City Budget”. Councilmember Cargill moved to approve Ordinance No. 289. Councilmember Spencer seconded. Mayor Kaminskas invited public comment. No comments were heard at this time. Mayor Kaminskas invited council discussion. No discussion at this time. The mayor then called for the vote which carried unanimously. EMERGENCY ORDINANCES: No items at this time. INTRODUCTION OF UPCOMING AGENDA ITEMS: The Mayor and council reviewed upcoming workshops. CITIZEN COMMENTS: No comments at this time. EXECUTIVE SESSION: At 8:56 p.m. Mayor Kaminskas announced an executive session until 9:30 p.m. per RCW42.30.110(1)(i) regarding potential litigation. At 9:30 p.m., Mayor Kaminskas announced an additional ten minutes of executive session until 9:40 p.m. City Council Meeting Minutes November 15, 2022 Page 3 of 4 ADJOURNMENT: The mayor and council reconvened from executive sessin at 9:42 p.m. and with there being no further business, the meeting adjourned at 9:42 p.m. These minutes were approved December 6, 2022.
