MINUTES VILLAGE OF LOS LUNAS THURSDAY, DECEMBER 3, 2015 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, December 3, 2015 in regular session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Mayor Charles Griego, Councilwoman Paulette Sanchez-Montoya, Councilwoman Amanda Perea, Councilman Gerard Saiz and Councilman Gino Romero. Mayor: Charles Griego Mayor Pro Tem: Gerard Saiz Council: Amanda Perea Paulette Sanchez-Montoya Gino Romero Also present were: Gregory D. Martin, Debra Sanchez, Jim Rickey, Sandy Schauer, Robert Anderson, Deborah Fox, and Mark Rizzo. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required:  CALL MEETING TO ORDER.  PLEDGE OF ALLEGIANCE.  APPROVAL OF AGENDA.  PUBLIC INPUT FORUM. 1. ORDINANCE 276-2015-1 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OR A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. 2. EL CERRO DE LOS LUNAS PRESERVE DESIGN REVIEW COMMITTEE. 3. VALENCIA COUNTY OLDER AMERICANS ADVISORY COUNCIL. 4. REVISE COMMUNITY SERVICES DIRECTOR JOB DESCRIPTION. 5. TRAVEL: IN-STATE / OUT-OF-STATE. 6. APPROVAL OF MINUTES: A) Minutes of November 19, 2015 7. ADJOURNMENT.  CALL MEETING TO ORDER. At 6:00 PM, Mayor Charles Griego brought the meeting to order and welcomed the audience.  PLEDGE OF ALLEGIANCE. Mayor Griego asked the daughters of Mr. Jason Duran to lead the Mayor, Council and audience in the Pledge of Allegiance.  APPROVAL OF AGENDA. Mayor Griego asked Council if there were any changes to the agenda - Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve agenda MOVED: Councilman Saiz SECONDED: Councilwoman Sanchez-Montoya CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilwoman Perea – yes; Councilman Saiz – yes; Councilwoman Sanchez-Montoya – yes) FOR AND 0 AGAINST.  PUBLIC INPUT FORUM. Mayor Griego asked the audience if there was anyone who wanted to talk to the Council that did not have an item on the Council agenda. Ms. Linda Montano from First Choice Community Clinic and Ms. Michelle Moore of United Blood Services presented the Los Lunas Fire Department with a plaque for winners of the Battle of the Badges Blood Drive held in August. The Fire Department beat the Los Lunas Police Department once again. 1. ORDINANCE 276-2015-1 – AN ORDINANCE PROVIDING FOR TH CHANGE IN ZONING OF A DESIGNATED AAREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. Mayor Griego asked for a motion to adjourn from regular session and reconvene in a public hearing. APPROVAL: Motion to approve MOVED: Councilwoman Perea SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilwoman Perea – yes; Councilman Saiz – yes; Councilwoman Sanchez-Montoya – yes) FOR AND 0 AGAINST. Mayor Griego asked for a motion from Council. APPROVAL: Motion to adopt findings of Planning & Zoning and approve zone change MOVED: Councilman Saiz SECONDED: Councilwoman Perea CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilwoman Perea – yes; Councilman Saiz – yes; Councilwoman Sanchez-Montoya – yes) FOR AND 0 AGAINST. 2. EL CERRO DE LOS LUNAS PRESERVE DESIGN REVIEW COMMITTEE. Mr. Michael Jaramillo presented item two. There has been interest from several individuals to allow or permit new recreational uses within the El Cerro de Los Lunas Preserve. A Design Review Committee is being formed of three individuals and we are looking for an appointment of one “resident at large” by the Mayor with the advice and consent of the Village of Los Lunas Council. There have been requests for overnight camping at the preserve. Councilwoman Perea asked Mr. Jaramillo for his professional opinion if people should be allowed to camp overnight. Mr. Jaramillo replied that he was against it for the reason of camp fires getting out of control. Councilman Saiz suggested Mr. Peter Fernandez sit on the committee since he lives in the area. Mayor Griego asked Council if they had any suggestions to nominate or if any of them were interested in the committee – there was reply. Mayor Griego asked that this item be tabled until the next Council meeting. Mayor Griego asked for a recommendation from Council. APPROVAL: Motion to table agenda item until December 17, 2015 MOVED: Councilman Saiz SECONDED: Councilwoman Perea CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilwoman Perea – yes; Councilman Saiz – yes; Councilwoman Sanchez-Montoya – yes) FOR AND 0 AGAINST. 3. VALENCIA COUNTY OLDER AMERICANS ADVISORY COUNCIL. Mr. Michael Jaramillo presented item three. The Valencia County Older Americans Advisory Council is requesting the appointment of an elected official or Village Personnel for the 2016 calendar year. Mr. Jason Duran was nominated. Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve Jason Duran as appointment to Advisory Council MOVED: Councilman Romero SECONDED: Councilwoman Perea CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilwoman Perea – yes; Councilman Saiz – yes; Councilwoman Sanchez-Montoya – yes) FOR AND 0 AGAINST. 4. REVISE COMMUNITY SERVICES DIRECTOR JOB DESCRIPTION. Ms. Christine Nardi presented item four. Ms. Nardi is requesting approval to revise the current Community Services Director Job description. The revision will be to remove the Street Division which was reassigned to the Public Works Director position. Mayor Griego asked Council if there were any questions – there were none. MINUTES. Mayor Griego asked if there were corrections or additions to the council minutes of November 19, 2015 – there were none. MARTIN, VILLAGE ADMINISTRATOR CHARLES GRIEGO, MAYOR MINUTES VILLAGE OF LOS LUNAS THURSDAY, DECEMBER 3, 2015 PUBLIC HEARING (Commenced at 6:08P.M.) 1. ORDINANCE 276-2015-1 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. Ms. Christina Ainsworth presented item one. Property is located in the subdivision of the lands of Joe Gonzales for the purpose of allowing a medical clinic. The property is currently zoned R-1, would like to zone to C-1. The Planning and Zoning Commission heard this item (November 18, 2015) and recommended approval of zone change from R-1 to C-1. Mayor Griego asked the audience if there was anyone who wanted to speak for or against the item – there was no comment from anyone. Everyone in the area of property was notified per Christina Ainsworth. Mayor Griego asked to close the public hearing and Council would go back in to open meeting. The Village of Los Lunas Council is pleased to have residents of the community take time to attend Village Council Meetings. Attendance and participation is encouraged. Individuals wishing to be heard during Public Hearing proceedings are encouraged to be prepared and will be limited to three (3) minutes in order to allow everyone the opportunity to be heard. PUBLIC COMMENTS ARE EXPECTED TO BE CONSTRUCTIVE AND DEVOID OF CHARACTER ASSASSINATION. Questions raised on non-agenda items may be answered at a later date by letter in order to facilitate proper research. Written comments are welcome and should be given to the Village Administrator prior to the start of the meeting. ORDINANCE 276-2015-1 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. TAB 1. ACTION REQUESTED OF COUNCIL: PUBLIC HEARING. Approve or disapprove BACKGROUND AND RATIONALE: Paul Romero, acting as agent for Rosemarie Romero, has applied for a zone change for the property located in the subdivision of the Land of Joe Gonzales, Tract 3, 1.52A B-5-28 DC 321/604, for the purpose of allowing a medical clinic. The property is currently zoned incorrectly for a medical clinic, and therefore Mr. Romero wishes to change the zoning from R-1 to C-1. The Community Development Department has reviewed this application and has determined that a medical clinic on this site is consistent with the development in the area, and would be appropriate for this site. MICHAEL JARAMILLO 2. EL CERRO DE LOS LUNAS PRESERVE DESIGN REVIEW COMMITTEE. TAB 2. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: There has been a request by community residents to allow or permit new recreational uses within the El Cerro de Los Lunas Preserve. For changes in the management, operation or recreational use of the El Cerro de Los Lunas Preserve a Design Review Committee consisting of three (3) individuals shall be appointed serve. For review and to approve (or decline to approve) (a) plans of all improvements or granting easements within the El Cerro de Los Lunas Preserve. Staff is requesting appointment of one (1) “Resident at Large” by the Mayor of the Village with the advice and consent of the Village Council. Process and purpose regarding this request are located within the acceptance of Declaration of Covenants, Condition and Restrictions filed in the Valencia County Clerk’s Office 11/28/06. MICHAEL JARAMILLO 3. VALENCIA COUNTY OLDER AMERCIANS ADVISORY COUNCIL. TAB 3. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The Valencia County Older Americans Advisory Council is requesting the appointment of an elected official or Village personnel for the 2016 calendar year. This advisory member provides input and feedback regarding the needs or expectations of the Older American population within the community; in addition, is a key support representative for the participants of the Fred Luna Multi- Generational Center. CHRISTINE NARDI 4. REVISE COMMUNITY SERVICES DIRECTOR JOB DESCRIPTION. TAB 4. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: Staff is requesting approval to revise the current Community Services Director Job Description to remove oversight of the Streets Division, which has been re-assigned to the Public Works Director position. 5. TRAVEL: IN-STATE / OUT-OF-STATE. TAB 5. a) Village employees are requesting permission to travel in-state to Santa Fe, NM to attend the NMAC Legislative Conference, DWI Coordinators Affiliate Meeting, and NM EDGE Classes (January 19-21, 2016). Estimated cost: $1,115.00, which does not include cost of fuel. b) Village employees are requesting permission to travel in-state to Las Cruces, NM to attend the New Mexico Water and Wastewater Association Annual School and Testing (January 24-29, 2016). Estimated cost: $2,115.00, which does not include the cost of fuel. 6. APPROVAL OF MINUTES TAB 6. a) Minutes of November 19, 2015 Council Meeting. 7. ADJOURNMENT.
