MINUTES VILLAGE OF LOS LUNAS THURSDAY, NOVEMBER 2, 2017 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, November 2, 2017 in regular session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Mayor Charles Griego, Councilman Gino Romero, Councilman Christopher Ortiz and Councilman Gerard Saiz. Councilwoman Paulette Sanchez-Montoya, excused. Mayor: Charles Griego Mayor Pro Tem: Gino Romero Council: Gerard Saiz Christopher Ortiz Paulette Sanchez-Montoya, Excused Also present were: Gregory D. Martin, Debra Sanchez, Martin Callahan, Sandy Schauer, Bob Anderson, Jim Rickey, and Deborah Fox. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: • CALL MEETING TO ORDER. • PLEDGE OF ALLEGIANCE. • APPROVAL OF AGENDA. • PUBLIC INPUT FORUM. 1. RESOLUTION 18-01 – VILLAGE OF LOS LUNAS OPEN MEETINGS ACT. 2. 2018 SCHEDULE OF COUNCIL MEETING DATES AND 2018 HOLIDAY SCHEDULE. 3. ORDINANCE 426 – AN ORDINANCE REPEALING ORDINANCE 263, WHICH ESTABLISHED THE WATER RIGHTS ORDINANCE, REPLACING CHAPTER 16.40 (WATER RIGHTS) AND ESTABLISHING CHAPER 13.24 (WATER RIGHTS REQUIRED) IN ORDER TO MODIFY THE VILLAGE OF LOS LUNAS REQUIREMENTS FOR THE PROVISION OF WATER RIGHTS FOR NEW AND EXISTING DEVELOPMENT. 4. EXECUTIVE SESSION. a. Village Administrator Annual Review. b. Hire Sewer Maintenance Operator – Water/Sewer Department / Public Works Division. 5. APPROVAL OF MINUTES: a. At 6:00 PM, Mayor Charles Griego brought the meeting to order and welcomed the audience. • PLEDGE OF ALLEGIANCE. Mayor Charles Griego asked Mr. Jim Rickey to lead the Mayor, Council and audience in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Charles Griego asked if there were any changes or corrections to the agenda – there were none. Mayor Charles Griego asked for a motion from Council. APPROVAL: Motion to approve agenda MOVED: Councilman Ortiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero - yes) FOR AND 0 AGAINST. • PUBLIC INPUT FORUM. None. 1. RESOLUTION 18-01 – VILLAGE OF LOS LUNAS OPEN MEETINGS ACT. Pursuant to the Open Meetings Act, NMSA 1978, staff are seeking Council approval to adopt the resolution for the Village of Los Lunas. Mayor Griego asked Council if they had any questions – there were none. Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve resolution 18-01 MOVED: Councilman Romero SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero - yes) FOR AND 0 AGAINST. 2. 2018 SCHEDULE OF COUNCIL MEETING DATES AND 2018 HOLIDAY SCHEDULE. Staff has reviewed and are seeking approval of the 2018 Council meeting dates and the 2018 Holiday Schedule. If approved, the schedules will be published on the Village website and Village calendar. Mayor Griego asked Council if they had any questions – there were none. Mayor Griego asked for a motion from Council. ORDINANCE 426 – AN ORDINANCE REPEALING ORDINANCE 263, WHICH ESTABLISHED THE WATER RIGHTS ORDINANCE, REPLACING CHAPTER 16.40 (WATER RIGHTS) AND ESTABLISHING CHAPTER 13.24 (WATER RIGHTS REQUIRED) IN ORDER TO MODIFY THE VILLAGE OF LOS LUNAS REQUIREMENT FOR THE PROVISION OF WATER RIGHTS FOR NEW AND EXISTING DEVELOPMENT. Mayor Griego asked for a motion to adjourn as Council and open in to a public hearing. APPROVAL: Motion to approve MOVED: Councilman Romero SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Romero– yes; Councilman Saiz – yes; Councilman Ortiz - yes) FOR AND 0 AGAINST. Mayor Griego asked for a motion from Council. APPROVAL: Motion to table until the next meeting at the recommendation of Planning & Zoning Commission MOVED: Councilman Romero SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Saiz – yes; Councilman Ortiz - yes) FOR AND 0 AGAINST. 4. EXECUTIVE SESSION. Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1978 Section 10-15-1, that the following matters would be discussed in closed session: annual review for the Village Administrator and hire Ft Sewer Maintenance Operator. APPROVAL: Motion to go into executive session pursuant to NMSA 1978 Section 10-15-1 (H) (2). MOVED: Councilman Romero SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero - yes) FOR AND 0 AGAINST. Adjourned at 6:10PM. At 7:35PM, Mayor Griego asked for a motion to reconvene to go back into open session after discussing: annual review for the Village Administrator and hire FT Sewer Maintenance Operator. APPROVAL: Motion to reconvene in open session pursuant to NMSA 1978 Section 10-15-1 (H) (2). MOVED: Councilman Romero SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero - yes) FOR AND 0 AGAINST. Mayor Griego mentioned that the annual review was discussed with Greg Martin, Village Administrator. Mayor Griego put up the name of Ray Vigil, Jr. for the position of FT Sewer Maintenance Operator. Ms. Christina Ainsworth presented item three. The proposed ordinance amendment modifies the water rights requirements for commercial users and moves the water rights chapter to title 13 – public services. Mayor Griego asked if there was anyone in the audience who wanted to speak for or against the area plan – there was none. Since there are no further questions, Mayor Griego asked for a motion to close the public hearing and reconvene as a Council.
