VILLAGE OF LOS LUNAS
THURSDAY, NOVEMBER 16, 2017
The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, November 16,
2017 in regular session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Mayor
Charles Griego, Councilman Gino Romero, Councilman, and Christopher Ortiz . Councilwoman Paulette Sanchez-Montoya and
Councilman Gerard Saiz were excused.

In accordance with Ordinance 114A, the following agenda was prepared and circulated as required:

1. AMENDMENT TO RESOLUTION 17-10 – ADOPTING THE ACCOUNTING POLICIES AND PROCEDURES MANUAL.
2. ORDINANCE 426 – AN ORDINANCE REPEALING ORDINANCE 263, WHICH ESTABLISHED THE WATER RIGHTS
ORDINANCE, REPLACING CHAPTER 16.40 (WATER RIGHTS) AND ESTABLISHING CHAPER 13.24 (WATER RIGHTS
REQUIRED) IN ORDER TO MODIFY THE VILLAGE OF LOS LUNAS REQUIREMENTS FOR THE PROVISION OF WATER
RIGHTS FOR NEW AND EXISTING DEVELOPMENT.
3. ORDINANCE 429 – AN ORDINANCE AMENDING ORDINANCE NO. 276, THE COMPREHENSIVE ZONING REGULATIONS
AND ZONE MAP ATLAS IN ORDER TO REVISE 17.44.070 – FENCING.
4. ORDINANCE 430 – AN ORDINANCE REPEALING ORDINANCE 126, WHICH ESTABLISHED THE SUBDIVISION
ORDINANCE, AND REPLACING TITLE 16 (SUBDIVISIONS) IN ORDER TO MODIFY THE VILLAGE OF LOS LUNAS
REQUIREMENTS FOR THE REGULATION OF SUBDIVISIONS FOR NEW AND EXISTING DEVELOPMENT.
5. EXECUTIVE SESSION.
a. Hire FT Water Maintenance Operator – Water/Sewer Division / Public Works Department.
b. Hire Code Enforcement Specialist – Community Development.
6. APPROVAL OF MINUTES:
a. Minutes from November 2, 2017 Council Meeting.

At 6:00 PM, Mayor Charles Griego brought the meeting to order and welcomed the audience.
• PLEDGE OF ALLEGIANCE.
Mayor Charles Griego asked Gary to lead the Mayor, Council and audience in the Pledge of Allegiance.
• APPROVAL OF AGENDA.
Mayor Charles Griego announced that items 1, 2, 3, and 4 would not be presented – did not have a quorum of the governing
body. Mayor Charles Griego asked for a motion from Council.

5. EXECUTIVE SESSION.
Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1978 Section 10-15-1, that
the following matters will be discussed in closed session: hire FT Water Maintenance Operator and hire Code Enforcement
Specialist.
APPROVAL: Motion to go into executive session pursuant to NMSA 1978 Section 10-15-1 (H) (2).

CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Romero - yes) FOR AND 0 AGAINST.
Adjourned at 6:03PM.
At 6:33PM, Mayor Griego asked for a motion to reconvene to go back into open session after discussing: hire FT Water
Maintenance Operator and hire Code Enforcement Specialist.
APPROVAL: Motion to reconvene in open session pursuant to NMSA 1978 Section 10-15-1 (H) (2).

3. ORDINANCE 426 – AN ORDINANCE REPEALING ORDINANCE 263, WHICH ESTABLISHED THE WATER RIGHTS
ORDINANCE, REPLACING CHAPTER 16.40 (WATER RIGHTS) AND ESTABLISHING CHAPTER 13.24 (WATER RIGHTS

Ms. Christina Ainsworth presented item three. The proposed ordinance amendment modifies the water rights requirements
for commercial users and moves the water rights chapter to title 13 – public services. Mayor Griego asked if there was anyone
in the audience who wanted to speak for or against the area plan – there was none. Since there are no further questions,
Mayor Griego asked for a motion to close the public hearing and reconvene as a Council.

The Village of Los Lunas Council is pleased to have residents of the community take time to attend Village Council Meetings.
Attendance and participation is encouraged. Individuals wishing to be heard during Public Hearing proceedings are
encouraged to be prepared and will be limited to three (3) minutes in order to allow everyone the opportunity to be heard.
PUBLIC COMMENTS ARE EXPECTED TO BE CONSTRUCTIVE AND DEVOID OF CHARACTER ASSASSINATION. Questions raised
on non-agenda items may be answered at a later date by letter in order to facilitate proper research. Written comments are
welcome and should be given to the Village Administrator prior to the start of the meeting. Written materials will not be
accepted during regular agenda items in the interest of time.

BACKGROUND AND RATIONALE:
The Accounting Policies and Procedures Manual approved under Resolution 17-10 on June 22, 2017, requires an
amendment to SECTION 15. ANNUAL AUDIT to include language provided by the U.S. Department of Justice to
comply with federal reporting requirements for agencies receiving federal grant funds. In addition, SECTION 14.
BUDGETING requires a change to the DFA budget report due date from August 1st to July 31st found in the
Budget Process and Budget Preparation Schedule.

The proposed Ordinance amendment modifies 17.44.070 – Fencing in order to permit taller fences in front yards
under certain circumstances.

ORDINANCE, AND REPLACING TITLE 16 (SUBDIVISIONS) IN ORDER TO MODIFY THE VILLAGE OF LOS LUNAS
REQUIREMENTS FOR THE REGULATION OF SUBDIVISIONS FOR NEW AND EXISTING DEVELOPMENT.

BACKGROUND AND RATIONALE:
The Community Development Department has been revising the Los Lunas Subdivision Ordinance. The draft
ordinance was recommended to Council on October 18, 2017 by the Planning and Zoning Commission.
