MINUTES VILLAGE OF LOS LUNAS THURSDAY, OCTOBER 19, 2023 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, October 19, 2023 in regular session at 6:00 PM. Roll call was taken, and the following were present: Mayor Charles Griego, Councilman James Runyon, Councilman Christopher Ortiz, Councilman Cruz Munoz and Councilman Gino Romero. Martin, Debra Sanchez, Luis Brown, Erin Callahan, and Craig Donahoe. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: 1. APPROVAL OF MINUTES: a) Minutes from October 5, 2023, Council Meeting. 8. ADJOURMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. Mayor Griego announced that Councilman Runyon was excused. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Ralph Mims to lead the Council and WebEx participants in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Griego asked if there were any comments regarding the agenda – there were none, the Mayor asked council for a motion. APPROVAL: Motion to approve agenda. Mayor Griego asked the audience if there was anyone who wanted to speak to the Council who did not have an item on the council agenda. Mr. Mims approached the podium – he wanted to invite everyone to the 10-year anniversary celebration in Rio Communities runs for 2 days, groundbreaking starts at 10:30AM – tour of City Hall and the business incubator. 1. DESIGNATED USE PERMIT FOR 447 CAPITAL DR. SW. Mayor Griego asked for a motion from Council to recess as a council and go into a public meeting. Ms. Debra Sanchez swore in participants who would be testifying for/against item. APPROVAL: Motion to approve MOVED: Councilman Ortiz SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Runyon – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. 6:02PM Recommendation 23-12 – Village of Los Lunas Planning Commission, whereas Octavio B. Arballo has applied for a Designated Use Permit for the property described as Subd: Los Lunas Acres lot 14 block 2 1.30 acres with a street address of 447 Capital Dr. SW for the purpose allowing an accessory apartment. Commission held a public hearing and has met public notice requirements – Planning and Zoning Commission recommends the Los Lunas Village Council approve the designated use permit as presented with the following recommendations/findings: the applicant is in conformance with the Village of Los Lunas Municipal Code and Comprehensive Plan. APPROVAL: Motion to approve designated use and the findings of Planning & Zoning. MOVED: Councilman Ortiz SECONDED: Councilman Runyon CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Runyon – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. 2. INFRASTRUCTURE ACCEPTANE FOR PIONEER TRAIL NW. Mr. Alex Ochoa presented item two. This is the road that wraps around the Amazon Building from Hwy 6 – north side of the Amazon structure. The applicants have asked for acceptance for Village maintenance. Mayor Griego asked if there were any questions for staff – there were none. Mayor Griego asked for a motion from Council. DEDICATION OF PART ACREAGE – LOS CERRITOS PARK PHASE II. Ms. Erin Callahan presented item three. This is a new requirement of our subdivision ordinance that when a new subdivision is developed there is certain amount of land to be set aside to develop a park. Before us tonight is the dedication of park acreage within the Fiest Plan area for the expansion of Los Cerritos Park Phase II. They have created a legal track of land for that park acreage. They are here today for the Village accept that item. Subdivision ordinance requires that the land be dedicated by either a warranty deed or special warranty deed. The applicant, Sivage Community Development LLC, has requested that happen through a special warranty deed. Staff and our legal counsel have reviewed this item and is comfortable with the deed. So we recommend that this park acreage be accepted into the Village’s inventory of parks acreage. Mayor Griego asked Council if there were any questions. Councilman Munoz asked if this park would be connected to the other one. Erin replied, yes, all the way to the north. Mayor Griego asked for a motion from Council. RESOLUTION 23-19 – DEDICATION OF PROPERTY AS PUBLIC RIGHT OF WAY. Ms. Erin Callahan presented item four. This resolution is for dedication of property as public right of way for the I-25/Morris Road East/West Corridor Project. This is requirement by DOT and FHWA that certain parcels of property that are described on this resolution were purchased prior to our current acquisition process. Property files are being certified by DOT to show in fact that they are going directly towards the right of way efforts. DOT has asked that we submit this resolution that these are all for the corridor project. Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve resolution 23-19. MEMORANDUM OF AGREEMENT (MOA) RENWAL – 2024 RIO METRO REGIONAL TRANSIT DISTRICT FLEET MAINTENANCE MECHANIC. Mr. Michael Jaramillo presented item five. Rio Metro Regional Transit has requested a MOA to the continuation of fully funding the annual salary and benefits of one FT Heavy Duty Mechanic position within the Fleet Division of the Public Works Department. RMRTD understands this MOA request will continue to support the needs within fleet maintenance services provided to RMRTD and the Village of Los Lunas fleet. Mayor Griego aske for a recommendation from Council. APPROVAL: Motion to approve MOA. Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1978 Section 10-15-1(H), the following matters may be discussed in a closed session: hiring of a Community Development Director, hiring of a PT Museum Technician; and the hiring of a Commercial Driver. Martin, Village Administrator Mayor Griego, Mayor  MINUTES VILLAGE OF LOS LUNAS THURSDAY, OCTOBER 19, 2023 1. DESIGNATED USE PERMIT FOR 447 CAPITAL DR. SW. Mr. Alex Ochoa presented item one. Octavio Arballo has applied for a designated use permit for 1.3 acres – street address of 447 Capital Dr. SW for the purpose of allowing an accessory apartment. The Planning & Zoning Commission heard about this item on October 4, 2023. Back in July 2023, permit was issued for construction of a house – there is a request for a secondary house (740 sq. ft.) at the rear of the property attached to a garage. The item is being heard tonight for the final decision on the designated use. From the Village staff review – item is compliant with all six items of the Municipal Code. Mayor Griego asked Council if they had any questions. Councilman Romero asked what the second dwelling was going to be used for. Mr. Octavio Arballo approached the podium – he replied that it would be a place for his mother to live. Councilman Runyon asked if this was unique for the area. Alex responded, for this area, it’s the only designated use permit. It will not be rented or used as a rental. Councilman Munoz asked if garage was going to be in the back with the guest house or in the front. Mr. Arballo replied that the front already has a six-car garage, and he will be building another six-car garage attached to the guest house. He explained that he is a car collector – he collects exotic cars. Mayor Griego asked if there was anyone else who wanted to speak in favor – there were none. He then asked if anyone wanted to speak against – Ms. Josephine MacAphie, she lives across the street (432 Capital Dr./36 years) from where the house is being built. She thinks he is moving his business to his residence. She is also assuming that the guest house in the back is where his business office will go. She’s opposed to it and does not like that idea. She has been complaining about trucks blocking her driveway – she thinks they are doing it on purpose. She asked Council to deny his request. Ms. Julie Aragon also spoke against the request. She complained about the construction trucks in the way – she’s also concerned about additional traffic in that area. She was concerned about the six-car garage. Mr. Arballo explained that he has a separate location for his roofing/construction company – located at 3578 Hwy 47. Mr. David Duran, lives with Josephine (her son) – his mother is a model resident. He commented that he wished he would have talked with the neighbors. He complained about the construction work/noise. He does not trust the man. Comments were made and Mayor Griego asked him to focus on the ordinance as presented. Mayor Griego asked the audience and staff if there were any comments – there were none. Mayor Griego asked for a motion to close the public hearing and go back into a regular meeting.
