MINUTES VILLAGE OF LOS LUNAS THURSDAY, NOVEMBER 2, 2023 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, November 2, 2023 in regular session at 6:00 PM. Roll call was taken, and the following were present: Mayor Charles Griego, Councilman Christopher Ortiz, Councilman Cruz Munoz and Councilman Gino Romero. Councilman James Runyon was excused. The meeting was conducted in person and recorded through TEAMS. Mayor: Charles Griego Mayor Pro Tem: James Runyon, excused Council: Gino Romero Christopher Ortiz Cruz Munoz Also present were Gregory D. Martin, Debra Sanchez, Luis Brown, Erin Callahan, and Craig Donahoe. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: 1. UPDATE – VALENCIA COUNTY BUSINESS INCUBATOR (VCBI). 2. RESOLUTION 24-01 – VILLAGE OF LOS LUNAS OPEN MEETINGS ACT RESOLUTION, 2024 COUNCIL MEETING DATES AND HOLIDAY SCHEDULE. 3. RECORDS DESTRUCTION – FINANCE DEPARTMENT. 4. UPDAE – PERSONNEL ORDINANCE REVISIONS. 5. EXECUTIVE SESSION a) Hire Police Officers – Police Department. b) Hire Park Technician I – Parks Division / Parks & Recreation Department. 6. APPROVAL OF MINUTES: a) Minutes from October 19, 2023, Council Meeting. 7. ADJOURMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. Mayor Griego announced that Councilman Runyon was excused. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Timmy to lead the Council and WebEx participants in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Griego asked if there were any comments regarding the agenda – there were none, the Mayor asked council for a motion. APPROVAL: Motion to approve agenda. MOVED: Councilman Ortiz SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. • PUBLIC INPUT FORUM. None. 1. UPDATE – VALENCIA COUNTY BUSINESS INCUBATOR (VCBI). Mr. Ben Romero gave a brief update on the Business Incubator. He has had twelve businesses join with more to come; they provide mentorship and focus on a business plan; networking and trainings; collaborate with other entrepreneurs. They want to work with partnerships and youth non-profits; have lots of support from community. Working on setting up micro-loans from $250.00 to $10,000.00. they recently received a $20,000.00 grant from Facebook and in turn they bought computers to loan out. Mr. Romero invited everyone to come visit their office in Rio Communities. 2. RESOLUTION 24-01 – VILLAGE OF LOS LUNAS OPEN MEETINGS ACT RESOLUTION, 2024 COUNCIL MEETING DATES AND HOLIDAY SCHEDULE. Mr. Gregory D. Martin presented item two. Staff is seeking approval of the 2024 Open Meetings Act Resolution and the 2024 Council Meeting dates and Holiday schedule. Mayor Griego asked if there were any questions for staff – there were none. Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve resolution 24-01. MOVED: Councilman Ortiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. 3. RECORDS DESTRUCTION – FINANCE DEPARTMENT. Ms. Cheryl Cates presented item three. Cheryl presented a list of financial records that were due for destruction. Mayor Griego asked if there were any questions from Council – there were none. Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve records destruction. MOVED: Councilman Romero SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. 4. UPDATE – PERSONNEL ORDINANCE REVISIONS. Mr. Marcos Castillo presented item four. Marcos started his presentation of the revisions to the Personnel Ordinance. Revisions were passed through the Village Attorney – they were minimal, no big-ticket changes. The last full revision was passed and adopted on April 12, 2007 with minor revisions in 2014, 2015, 2018, and 2021. Goals for this revision: remove antiquated polices that are no longer valid or in practice; clarify wording and procedures to minimize ambiguity in the application of policy; and recommend new provisions to align the Village with industry trends and standards. Housekeeping: reformat document provided to employees to match the Municipal Code; collective bargaining section relocated ; term “casual” and “limited term” employees removed; 2007 provision for sick leave removed; performance valuation section updated; compensation and classification section updated; holidays updated to reflect our current 13 holiday schedule; and departments required to report during inclement weather updated. Marcos continued into the proposed major changes and updates: definition of safety-sensitive position, police officers’ probation, minimum qualification timeline, preselection prohibited, outside employment and conflict of interest, discrimination and workplace harassment, drug and alcohol policy (testing and results), abuse of power, fitness reimbursement, parental leave, remote work, additional departmental rules, and technical resources. Remote work is up to he supervisors and monitored. Very limited and on a case-by-case basis. Regarding drug abuse – weed if legal, opioids are illegal. Mayor would like more time with the ordinance – needs to be looked at…they need alternatives. Councilman Romero complimented Marcos for a job well done. Councilman Ortiz does not like working from home – are we liable if they get hurt at home. Marcos will run question by attorney. Councilman Ortiz asked for a draft that had the old ordinance with the proposed changes. Item 4 was informational. 5. EXECUTIVE SESSION. Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1978 Section 10-15-1(H), the following matters may be discussed in a closed session: hiring of Police Officers and hiring of a Park Technician I. APPROVAL: Motion to adjourn into executive session MOVED: Councilman Ortiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST 7:16PM At 7:42PM, Mayor Griego asked for a motion reconvene from Council indicating the hiring of Police Officers and hiring of a Park Technician I APPROVAL: Motion to approve MOVED: Councilman Ortiz SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST Regarding the hiring of a Police Officer – Mayor Griego recommended Andres Lucero. APPROVAL: Motion to approve MOVED: Councilman Munoz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST Regarding the hiring of a Police Officer – Mayor Griego recommended Bryce Gallegos. APPROVAL: Motion to approve MOVED: Councilman Munoz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST Regarding the hiring of a Park Technician I – Mayor Griego recommended Aden Pairett. MINUTES. Mayor Griego asked if there were corrections to the Council minutes of October 19, 2023 Council Meeting – there were none.
