Due to the property affecting a Village owned parcel, the plat is submitted as a Minor Subdivision to receive Mayor and Council approval. Staff Comment: N/A Applicable Codes: Section 16.08.010 – Definitions "Area plan" means the initial plan for a contiguous area of land to be subdivided in phases that delineates the sequence and timing of development and that is reviewed and approved under this title. It is a plan submitted for the purpose of implementing an integrated development scheme for all phases of a proposed development and to foster general consensus regarding compliance with this title.  COMMUNITY DEVELOPMENT DEPARTMENT "Conditional approval" means approval of a preliminary or final plat by the approving authority which is granted upon the condition that certain requirements are met prior to final approval or recording in the office of the Valencia County Clerk. "Dedication" means the appropriation of land, or an easement therein, by the owner, for the use of the public, and accepted for such use by or on behalf of the public. "Right-of-way" means land reserved for uses as a street, alley, crosswalk, or other public ingress and egress. Section 16.12.010 – Conformance to design standards All subdivisions within the village and its planning and platting jurisdiction shall conform to minimum design standards established by the village with the approved "Village of Los Lunas Design Standards" document. Section 16.12.020 – Modifications and exceptions Whenever the tract to be subdivided is of such unusual size or shape and/or surrounded by such development or unusual conditions that the strict application of these regulations would result in real difficulties and substantial hardships, the council may vary or modify the requirements, so that the subdivider is allowed to develop the property in a reasonable manner, but at the same time so that the public welfare and interests of the village are protected and the general intent and spirit of these regulations are preserved. However, such relief may not be granted if it is detrimental to these regulations or the desirable development of the community in accordance with plans and policies of the village. Any modification granted shall be entered in the records of the council setting forth the reasons that justified the modification. Further, in granting modifications and exceptions, the council may place conditions that will in its judgment substantially secure the objectives of the standards or requirements involved. Section 16.24.060 - Land acceptance. Approval of the minor subdivision by the council shall be deemed to constitute acceptance by the village of dedication of proposed public easements, and public areas shown on the plat, excluding streets, provided the plat is properly recorded with the Valencia County Clerk and the community development director. Authority: Section 16.24.040 - Decision. Following review of the minor subdivision application package and following negotiations with the applicant on changes as may be deemed advisable, the commission shall issue a recommendation to council on the complete application package as submitted or modified. After the council holds a public hearing to review the application package and the recommendations of the commission, it may be approved by the council. 1. Approval. If the minor subdivision is approved by the council, such approval shall be recorded on the face of the original drawing of the plat and on three copies thereof and shall be dated and verified by the signature of the mayor or designated representative of the council. 2. Disapproval. Should the minor subdivision be disapproved, the council shall express in writing the reasons for disapproval. The reasons for disapproval shall be referenced and attached to two copies of the plat. One of the copies shall be returned to the subdivider and the other shall become part of the files of the community development director's office.  COMMUNITY DEVELOPMENT DEPARTMENT Section 16.32.040 – Decision (Final Plat) After the council holds a public hearing to review the final plat and they determine that it is in conformance with the preliminary plat as approved by the commission and conforms to these regulations, it may be approved by the council. Approval or disapproval shall be given within thirty-five days of the date of the receipt of a complete final plat application by the community development department. A. Approval. If the final plat is approved by council, such approval shall be recorded on the face of the original drawing of the final plat and on three copies thereof and shall be dated and verified by the signature of the mayor or designated representative of the council. B. Disapproval. Should the final plat be disapproved, the council shall express in writing the reasons for disapproval. The reasons for disapproval shall be referenced and attached to two copies of the final plat. One of the copies shall be returned to the subdivider and the other shall become part of the files of the community development department. Section 16.28.040 – Decision (Preliminary Plat) Following review of the required preliminary plat and other material and following negotiations with the subdivider on changes as may be deemed advisable, the commission shall, within thirty-five days of receipt of the complete application package act thereon as submitted or modified. If an extension of review time is granted, the commission shall act on the preliminary plat within twenty-one days after the last opinion requested of the village engineer or any agency is received. A. Action of Commission. If this preliminary plat is approved, the commission shall express its conditional approval and state the conditions of such approval, if any. If the plat is disapproved, the commission shall express its disapproval and its reasons therefor. The action of the commission shall be noted on two copies of the preliminary plat, referenced and attached to the condition determined. One copy shall be returned to the subdivider and the other retained by the commission. B. Approval of Final Plat. Approval of the preliminary plat is a commitment on the part of the village that a final plat conforming to the approved preliminary plat and any conditions will be approved and on the part of the subdivider that the approved preliminary plat and any conditions will be adhered to as agreed. The preliminary plat stage is the substantive decision point in the subdivision approval process. Any changes from the approved preliminary plat shall be submitted as for preliminary plat review and approval. C. Annexation and Rezoning. If annexation and/or rezoning is proposed or required to accomplish the development envisioned in connection with the plat, the commission shall withhold conditional approval of the preliminary plat until such time as annexation and/or rezoning shall be officially adopted by the council. The council shall have a written report available containing the commission's recommendation prior to the public hearing on the annexation and/or rezoning. Charles Griego Mayor, Village of Los Lunas Attest: DWI Planning Council Representative Village Clerk (SEAL) Revised: November 2024  STATEMENT OF ASSURANCES Local DWI Grant and Distribution Program Fiscal Year 2027: July 1, 2026 – June 30, 2027 The applicant hereby assures and certifies compliance with the following statutes, rules, regulations, and guidelines associated with the acceptance and use of funds under the New Mexico Local DWI Grant and Distribution Program: 1. Compliance with the provisions of the New Mexico Local DWI Grant Program Act, Sections 11-6A-1 through 11-6A-6 NMSA 1978 as amended, the NMAC Title 2, Chapter 110 Part 4 Regulations, and the approved LDWI Guidelines. 2. The applicant has the responsibility and legal authority to receive and expend funds as described in the grant and distribution project description, as well as to finance the grantee share (minimum 10%) of costs of the project, including all project overruns. 3. Compliance with the State Procurement Code, Sections 13-1-21 through 13-1-199, NMSA 1978 as amended, with the exception of Home Ruled Governments. All project-related services, activities or programs done through a service provider must be implemented through a professional services contract. Any project-related contract, subcontract, or agreement and related amendments, providing services to the grant or distribution program, must be submitted for administrative review by the Local Government Division prior to execution. 4. Adherence to all financial, accounting, and reporting requirements of the Department of Finance and Administration. Distribution programs will include the Exhibit F, the Local DWI Distribution Fund Financial Status Report. Grant programs will include the Local DWI Program Request for Payment/Financial Status Report, Exhibit D. The said reports shall include a narrative of successes and challenges, a detailed budget breakdown of expenditures to date, a summary of any screening fees collected and/or expended, the Database Quarterly Report, the Managerial Data Set (MDS) Report, Planning Council meeting agendas, sign in sheets, and minutes, the Quarterly Evaluation update and such other information following the objectives of the county's evaluation as may be of assistance to the Division in its evaluation. 5. Compliance with the requirement to not budget, nor expend, any of the grant amount awarded or the amount distributed for indirect administrative costs incurred during the grant or distribution fiscal period. Requests for payment or financial status reports shall document all direct program administrative expenditures and in-kind/match administrative expenditures. 6. Compliance with the requirement to not budget, nor expend, greater than ten percent of the grant amount awarded or the amount distributed for capital purchases incurred during the grant or distribution fiscal period. Requests for payment or financial status reports shall  specify all capital purchases. The ten percent cap for capital purchases does not apply to the Detoxification Grants. 7. Compliance with all required reports, including but not limited to: the first quarter narrative and fiscal reports due on the last working day of October; the second quarter narrative and fiscal reports due on the last working day of January; the third quarter narrative and fiscal reports due on the last working day of April; and the fourth and the final quarter Grant Fiscal report due by the 10th of July and the fourth and final narrative and distribution fiscal reports for the fiscal year due the last working day of July. Annual protocols for the screening, treatment, and compliance monitoring components are due the last working day of July for the current fiscal year. The annual reports which include program evaluation are due the last working day of August for the prior fiscal year. 8. Compliance with the current Local DWI Grant Program Screening Guidelines. To avoid any conflict of interest, or appearance of conflict of interest, screeners should not be affiliated with any contracted treatment agency. 9. If applicable to the applicant, compliance with the requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Department of Health and Human Services regulation entitled “Standards for Privacy of Individually Identifiable Health Information”, 45 CFR Parts 160 and 164, applicable to entities covered by HIPAA; (the HIPAA Regulations). 10. Any distribution program under run amount for the fiscal year must be returned to the Local DWI Grant Fund by September 30 of the following fiscal year. Failure to remit an under run to the Local DWI Grant Fund will cause suspension of grant reimbursements and/or future distributions until the remittance is made. 11. Grant program under runs revert to the Local DWI Grant Fund. 12. Compliance with all applicable conditions and requirements prescribed by the Division in relation to receipt/accountability of State Funds. 13. The grant applicant will follow the scope of work for the grant program, as negotiated with the Local Government Division, and in accordance with the local planning council's approved plan. The applicant will submit any proposed modifications/amendments to the scope of work to the Division for its approval, prior to execution. 14. The distribution program applicant will follow the application as approved by DWI Grant Council in the application review process. The applicant will submit any proposed modifications/amendments to this proposal to the Division for its written approval, prior to execution of changes to programs. 15. Compliance with conflict of interest prohibitions whereby no member, officer, or employee of the grant or the distribution program, or its designee or agents, no voting member of the local  planning council or of the governing body of the locality in which the program is situated, and no other public official of such locality who exercises any functions or responsibilities with respect to the program during his/her tenure (or for one year thereafter) shall have any interest, direct or indirect, in any contract or subcontract for work to be performed in the program. The grant and/or the distribution program shall incorporate, in all such contracts or subcontracts, a provision prohibiting such interest pursuant to the purposes of these stated provisions. 16. Compliance with the maintenance of records as will fully disclose the amount and disposition of the total funds from all sources budgeted for the grant or distribution agreement period, the purpose of undertaking for which such funds were used and the amount and nature of all contributions from other sources, and such other records as the Division shall prescribe. All Program records must adhere to the New Mexico State Records Center and Archives Rule for Functional Retention and Disposition Schedule, 1.21.2 NMAC. 17. The applicant will provide access to authorized State officials and representatives of all books, accounts, records, reports, files, and other papers, things, or property pertaining to the project in order to make audits, examinations, excerpts and transcripts. 18. That client identifying information will not be re-disclosed except back to the Program from which the information was obtained, or according to the terms of this MOU. 3. That in receiving, storing, processing, or otherwise dealing with any information from the Program about the clients in the Program, the Division acknowledges it is bound by the provisions of the Federal confidentiality regulations, 42 CFR Part 2. 4. That the Division shall undertake to resist any effort to obtain access to information pertaining to patients otherwise than as expressly provided for in the Federal confidentiality regulations, 42 CFR Part 2. 5. That the Division is not a “covered entity” as defined by the Department of Health and Human Services Regulations entitled “Standards for Privacy of Individually Identifiable Health Information”, 45 CFR Parts 160 and 164, implementing the Health Insurance Portability and Accountability Act of 1996 (HIPAA); (the HIPAA Regulations). 6. That the Division shall never possess treatment or maintain any “individually identifiable health information” or transmit “protected health information” as defined by the HIPAA Regulations and in the Health Information Technology for Economic and Clinical Health Act of 2009 (HITECH Act). The program funded the following components in FY25: Alternative Sentencing (Misdemeanor Compliance), Community Wellness & Outreach (Includes Prevention, Enforcement & Teen Court), Program Administration, and Treatment—Screening is a component that is self-sustained but is also provided through the DWI Program. VLL/VC LDWI program in FY25 partnered: with Argus Private Security Force LLC to oversee Alternative Sentence/Drug Testing services, Youth Development Inc./Valencia that provides Teen Court, and Valencia Shelter Services for the Domestic Violence services piece. State Funding for LDWI Funding: • $473,352 = Distribution Grant • $184,458 = Administrative In-kind • $209,859 = Competitive Grant • $40,324 = Collected Fees Demographics – DWI Offender Profile: According to the NOBLE: Client Demographic Report not before: 7/1/2024 and not after: 6/30/2025 Demographics: Total Total offenders screened: 160 Average age of offenders: 35 Percentage of male clients: 73% Percentage of female clients: 27% % African American: 2% % Asian: 1% % Hispanic: 74% % Native American: 3% % Native Hawaiian or Other Pacific Islander: 1% % Multi-Racial/Other: 1% % White: 18% % that had 11 years or less of education: 17% % that had 12 years of education: 64% % that had 12 or more years of education: 19% % that had an income less than $10,000: 26% % that had an income between $10,001 and $20,000: 18% % combined income less than $20,000: 45% % combined income less than $30,000: 64% % that were not employed for at least 3 months or more last year: 15% Village of Los Lunas/Valencia County LDWI Data Between 2017 and 2023 • Valencia County is responsible for 3.1% (281 of 8928) of the total DWI Arrests in New Mexico during 2023. • Alcohol Related Motor Vehicle Traffic Crash Deaths decreased from 5.2% in 2016-2020 down to 3.9% in 2017-2021. • The number of alcohol related crashes in Valencia County increased between 2022 and 2023 decreased by 9 crashes (70 down to 61) after increasing between 2021 and 2022 by 19 crashes (51 to 70) after a decrease from 60 in 2020 to 51 in 2021. • Sadly, after having Alcohol involved Teen crash fatalities remaining at 0 since 2015, in 2021 and again in 2022 we suffered (1) Alcohol involved Teen fatality bringing the total to (2) Teen crash fatalities in the past seven years where data was available. • In 2023, the District Court had 29 cases with a 51.7% Conviction rate. • In 2023, the Magistrate Courts had 302 cases with a 48.7% Conviction rate.  * Source: University of New Mexico Division of Government Research, New Mexico Department of Transportation, Valencia County Report, 2023 Under Contract #C06380 by the Traffic Research Unit, UNM and the Jan. 2023 NM Substance abuse EPI Report, and 2023 Administration of Courts Report. DWI Planning Council Includes 11 members representing over (7) sectors to include: Law Enforcement (3 separate agencies), County Clerk’s Office, Valencia Shelter Services, DWI Drug Court Valencia County, Community Wellness Council, Youth Development Inc., Valencia, Valencia County Detention Center. General Board membership has active representation from: Magistrate Courts, Law Enforcement, District Attorney’s Office, Department of Health, DWI Drug Court, Community Wellness Council, La Vida Felicidad, Presbyterian Community Health/Office of Substance Abuse Prevention, NM Veteran’s Administration, Juvenile Justice Board, Juvenile Probation, TNT Boxing and Youth Mentoring and community members. The VLL/VC DWI Program has a very active and supportive DWI Planning Council that advocates for community collaboration to increase conviction rates, successful outcomes in probation/compliance, access to effective treatment and the implementation of evidence-based prevention activities, programs, and community wide policies. Compliance Monitoring for District, Magistrate and Municipal Courts Within the last 13 fiscal years (July 1, 2012 through June 30, 2025) while the DWI Program has been offering supervised probation services, there have been 2,716 clients/cases referred to the Compliance Program. • 193 clients monitored/tracked during FY25 by three compliance officers • 145 cases closed successfully (completed all probation requirements) • 23 cases closed unsuccessfully (did not complete probation requirements) Community Wellness & Outreach: Enforcement VLL/VC Underage Drinking Taskforce includes: Belen P.D., Bosque Farms P.D., Isleta Tribal P.D., Los Lunas P.D., New Mexico State Police/Special Investigations Unit, and Valencia County Sheriff’s Department. A total of 13 operations were funded through the VLL/VC Local DWI program this year to include: (8) Underage Enforcement operations and (2) Directed Patrols, (2) Compliance Checks, and (1) Warrant Round Up with participation from: Belen P.D., Bosque Farms PD, Isleta Tribal, P.D., Los Lunas P.D, New Mexico State Police/Special Investigations Unit, and Valencia Sheriff’s Department. Collaborative work to decrease Adverse Childhood Experiences (ACE), substance misuse, DWI, Underage Drinking, and violence while increasing resilience, access to mental/physical health care and treatment. Additionally, VLL/VC Prevention Program partners with the Community Wellness Council on the 100% Community Initiative which has (10) Taskforces. (5) Taskforces to address Surviving: Food, Housing, Transportation, Behavioral/Mental Health, and Medical/Dental and (5) Taskforces for Thriving: Early Childhood, Parental Supports, Community Schools, Jobs Training, and Mentoring. Once all (10) Taskforces are fully sustained and operating within our community with the ultimate goal of positively impacting Adverse Childhood Experiences and ensure 100% of our Community has access to the resources needed to survive and then to thrive! • Conducted 242 prevention based activities throughout the community reaching 3182 participants. • 28 Sessions of 1 hour each (28 hours total) of Envision your Future with YSC and 7 sessions of 2 hours each (14 hours total) of Alcohol Literacy Challenge classes . • Coordinated Youth Success Core (YSC). YSC is largely focused on partnering with Teen Court, Juvenile Probation, Reception and Assessment Center (RAC) and Restorative Justice for referrals. The curriculum used is Envision Your Future and it is coupled with community service/civic projects and mentoring. • Provided Free Tutoring to YSC and TNT Boxing/Youth Mentoring Center participants with funding from VLL/VC LDWI and Donations from Los Lunas Magistrate Courts. Screening: The VLL VC DWI Program does not request funds for the screening component and is able to fund the program through fees collected for screening. As every offender convicted of a DWI is required to receive a screening, the VLL/VC DWI program continues to provide screening to fill this need within our community. • 172 total offenders screened • 97.09% of total clients screened. Treatment: Treatment: 45% of our clients make less than $20,000.00 annually and 64% make less than $30,000.00 annually (FY 25 NOBLE). VLL/VC provides free treatment/Auricular Detox services on site filling an important gap in service in our community. In FY20 our program completed the process to become a recognized treatment provider through SAMHSA allowing our program to provide treatment for out of state clients and to be recognized on SAMSHA’s nation-wide treatment provider list. Our LSAA has 24 of experience. Our program works closely with the Judicial Community. An overwhelming majority of the clients who go through the VLL/VC DWI Program’s Treatment program report their counseling experience to be positive and they regularly express great appreciation for the Counselor and the Compliance Officers. With the retirement of our Licensed Alcohol and Drug Abuse Counselor (LADAC), our program now covers the supervision of our LSAA and Spanish speaking only clients that are uninsured through a MOU with treatment provider Heart & Soul of New Mexico. • 103 offenders were referred to treatment • 1463 total treatment hours provided • 65 Successful Completions • 10 Unsuccessful Completions  MINUTES VILLAGE OF LOS LUNAS THURSDAY, DECEMBER 4, 2025 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, December 4, 2025 in regular session at 6:00PM. Roll call was taken, and the following were present: Mayor Charles Griego, Councilman Gino Romero (Joined via Teams), Councilman James Runyon, Councilman Cruz Munoz and Councilman Christopher Ortiz was excused. Mayor Griego asked Ken to lead the Council and TEAMS participants in the Pledge of Allegiance. • PUBLIC INPUT FORUM. Mayor Griego asked the audience if there was anyone who wanted to address the council that did not have an item on the agenda – there was none. Mayor Griego announced the this was the last council meeting for Councilman Munoz. Councilman Munoz was honored for his years of work on the council and presented a plaque. 1. RESOLUTION 25-37: INTERIM BUDGET ADJUSTMENTS 2025. Ms. Cheryl Cates presented item one. I'm bringing forward resolution 25-37, which is an interim budget adjustment for the �iscal year of 2026. VILLAGE OF LOS LUNAS ADMISSION TO OPIOID REMEDIATION COLLABORATIVE BOARD. Mr. Gregory D. Martin presented item two. This is a follow up item from things that we have discussed in the past. We are receiving opioid settlement funds as you just heard. We received recently the $213,000 for the for the fund and this is regulated fairly heavily by the criteria. We've been accumulating the funds over probably about three years now and the balance of that fund is around $1.6 million at this point. In June or July of 2025, we had a presentation you may recall by a person named Shawna Hartley and she informed us about the opportunity and possibility of collaborating and joining our funds with other counties in order to both have effective use of the funds as well as to have a better opportunity to use them on purposes that are allowed. So recently we did receive notice that the board the ORC board, it's ORC for opioid remediation collaborative. In your packet you know you have the JPA that governs the overall board. Councilman Runyon asked – we got $1.6, why would we not keep it here? Greg responded, we felt like it was worth looking at pooling those funds together to make a larger pool to be able to address those problems both here in Valencia County as  well as some of the other counties that that are part of the board. Valencia County just happens to be the �iscal agent for the whole board. So in other words, all of the entities are sending the money they receive into the ORC board as well. I am prepared to recommend that deputy Village administrator Nancy Gonzalez, you know, be our representative for a couple of reasons. One she's worked with opioid funds in the past and a prior position with the Pueblo of Isleta. She oversees the DWI program within the village of Los Lunas and can also advocate for the village as well as the county's needs in that area in in cooperation with the DWI program. So that's my recommendation. Mayor Griego asked council if there were any other questions – there were none.
